Would the President give details of the actual cost of the financial settlement with the former Chief Executive of the Policy and Resources Department, the terms of which were set out in his statement of 21st January 2003?

Answer

I am unable to give details of the actual cost of the financial settlement with the former Chief Executive of the Policy and Resources Department. I advised the States on 21st January 2003, of the terms of the settlement, but I am unable to add to this because of the following:-

( i)  given what I have said, to give the actual cost of the settlement would effectively reveal the salary of the

former Chief Executive. There is a longstanding convention over many years now not to disclose publicly the salaries and terms and conditions of service of individual senior officers employed by the States. The Committee negotiates with these officers on a personal basis. In the Committee's view, therefore, there is an implied  condition of confidentiality in these negotiations. The  policy of the Committee is that everyone's individual remuneration is private and confidential, regardless of whether they are members of a bargaining group or individual employees who negotiate their own terms and conditions of employment;

( i i) our legal advisers have advised us that to do as asked could infringe the former Chief Executive's

Human Rights (in particular his right to respect his private and family life); and,

(i ii)  as  is  normal  practice  the  settlement  agreement  with  the  former  Chief  Executive  contains  a

confidentiality clause.
