Question

Would the Minister consider whether the new operator of the amphibious service to Elizabeth Castle should pay compensation to the Jersey Heritage Trust in view of the proposed closure of Elizabeth Castle and the non- availability of the Hydra Terra amphibious vehicles from the 1st April 2007 through to the 31st May 2007?

Answer

The contract entered into between the Jersey Heritage Trust and the new operator of the amphibious service to Elizabeth Castle includes provision for compensation in the event that the operator should fail to fulfil his obligations. If those obligations are not fulfilled, it will be for the Jersey Heritage Trust to determine whether to enforce such a provision, taking into account all relevant circumstances including the implications of any alternative interim arrangements made to facilitate access to the Castle.
