In June 2005, the then Harbours and Airport Committee approved heads of terms to the Octa Group Limited for a lease of La Folie Inn in order to redevelop the site. The same company presented proposals to convert a cruise liner into a floating hotel to be located in the harbour. This proposal was rejected.

During the exploratory period of redevelopment, prior to the signing of a lease, a complaint was made by the Department to the States Police and in December 2005 the Committee's lawyers wrote to the company confirming that Jersey Harbours would no longer proceed with Octa Group Limited.

The full exposure to the Department was approximately £1,000 in professional and legal fees.
