Re P.106/2019 Draft Public Health and Safety (Rented Dwellings) (Licensing) (Jersey) Regulations 201-. – Public Review Hearing – Additional Written Questions
Thank you for your letter dated 17 December 2019. Please see below response to the Panel's questions:
Do the regulations extend to individuals who let a room or rooms out in their private property? No. The regulations cover those dwellings as defined in the Principal Law.
- We understand that Lodging Houses are to be covered by the regulations and question why this is necessary when registration and inspection of these is covered by the Lodging Houses (Registration) (Jersey) Law 1962 and the Lodging Houses (General Provisions) (Jersey) Order 1962 and there is already the ability to inspect premises under the Public Health and Safety (Rented Dwellings) (Jersey) Law 2018?
Lodging houses are exempted from the suggested charging scheme to prevent "double charging".
Is it still the intention to repeal the Lodging Houses Law and the Order?
The Lodging Houses Law and associated subordinate legislation does not fall under the remit of the Minister for the Environment. There are elements within the Law that deal with population matters and it is the intention to repeal the Law only when these matters can be suitably dealt with elsewhere.
Can you advise what the current cost of maintaining the Lodging House Register is? Officers will begin to prepare a breakdown of the costs and will revert back to the Panel in January 2020.
