Dear Chair,
Corporate Services Scrutiny panel – Non-Disclosure Agreements
In response to the request of the Panel for information about the use of non-disclosure agreements, I can confirm the following numbers:
| Department | 2018 | 2019 | 2020 (to date) |
| COO | 7 |
| 2 |
| GHE | 1 | 3 | 2 |
| HCS | 10 | 4 | 2 |
| JHA | 1 | 4 | 2 |
| Non-Mins | 2 | 1 | 2 |
| CLS |
| 1 |
|
| CYPES | 6 | 1 | 3 |
|
| 27 | 14 | 13 |
The numbers above represent what I believe you have asked for, which is the number of compromise agreements signed by employees. Within the compromise agreement there is not a specific non- disclosure agreement, although confidentiality clauses are standard for both parties. Non-disclosure agreements (NDA) are wider documents used to protect commerciality, risk or prevent conflicts of interest and are used with contractors, employees and volunteers from time to time. There is no central register of NDA's.
The States of Jersey Code of Conduct will be completed by the end of the year. I am advised that it will be simplified and less specific than the current one, given the number of other people management policies that have superseded the current Code of Conduct. The new Code of Conduct will focus on values, behaviours and standards in public service.
Yours sincerely,
Senator John Le Fondré Chief Minister
