You may be aware that on the 18th September 2020, the Minister for Economic Development, Tourism,  Sport  and  Culture  (the  Minister')  lodged  a  proposition  that  would  make  an amendment to the Shops (Regulation of Opening and Deliveries) (Jersey) Law 2010 (the "2010 Law"). The proposed amendment to the 2010 Law makes a number of changes, but principally it would allow GP's the flexibility to operate on a Sunday, and if required, meet the demands of an enhanced flu vaccination programme while allowing pharmacies to administer vaccines as part of the ordinary course of their business during Sunday trading hours.

As you will also be aware, the 2010 Law already allows pharmacies in Jersey to operate on Sunday's without a permit, but only for the sale of medicines and related items. The proposed amendment to the 2010 Law in respect of pharmacies, means that an additional provision for the administration of vaccines, will be added to the activities that may be carried out by pharmacies. The proposed amendment was originally due to be debated on 22nd September, however, in order to allow for proper scrutiny of the proposition and its implications, the Minister has agreed to postpone the debate until the 6th October 2020.

The purpose of this letter is to canvas your views about the proposed amendment to the 2010 Law, and its implications for the operation of pharmacies on Sunday's. In particular, in respect of the following change that would follow as a result of the proposed amendment:

1.  Please could you provide the Panel with your views about the proposed amendment to enable pharmacies to administer vaccines as part of an enhanced flu vaccination programme, during Sunday trade, and the implications this might have for local pharmacies?

As part of our review of the proposals, we would like to determine what consultation methods were used by the Department. In that regard, please could you also let us know whether you or your colleagues were consulted on the proposals?

Due to the short timeframe under which the Panel is carrying out its scrutiny of this proposition, we would be grateful if you could provide a response to this letter on or before Monday 28th September. We appreciate that the timescale is extremely tight and hope that it does not prevent you from submitting your views on this matter.
