Dear Deputy Chief Minister,
Migration and Population Review Panel Entitled status granted on grounds of hardship
The Panel has noted that a number of Ministerial Decisions have been made in recent months relating to applications made for Entitled status to be granted under Regulation 2(1) (f) of the Control of Housing and Work (Residential and Employment Status) (Jersey) Regulations 2013 on the grounds of hardship.
As part of the work that the Panel is undertaking on the forthcoming Population Policy and associated amendments to the Control of Housing and Work Law, it is interested to understand the context of these applications. Please could you provide a breakdown of the following information for the period from 1 January 2019 to date:
• The number of applications, refused and accepted
• The sector in which the applicant was to be employed at the time of application
• Main reasons for refusal or acceptance
The information is requested to allow the Panel to consider trends over the time period and so it would also be useful to understand if, in your view, there has been a rise in the number of applications over the period, or more recently, and, if yes, the reasons why that increase has occurred.
The Panel understands that written reports accompanying the decisions are exempt under Article 25(1) of the Freedom of Information (Jersey) Law 2011. The Panel would be appreciative if as much detail as possible is provided in a public format, however, remains accepting of receiving exempt information in a confidential manner when required.
We would be grateful for your response by Monday 13th December 2021, however, the Panel is also aware that the information may not already exist in the format outlined above and would ask for liaison with Scrutiny officers as soon as possible should more time be required to provide the information requested.
