Dear Senator Moore

Changes to the objects and purpose of the Ann Alice Rayner Fund (P.92/2021) Thank you for your further correspondence dated 12th January.

The consultation process in relation to the Office of the Public Trustee (OPT') is currently at the scoping stage and I expect the process to take between 9 and 12 months as it is intended that the outcome is available before the end of the 18-month pilot programme for the AA Rayner Fund, as described in P92/2021.

Given your Panel's interest in this area I propose to ask officers to ensure that you are provided with the opportunity to contribute. At this stage it is too early to determine the outcome of the consultation and how that might impact on the responsibilities of the Treasurer of the States.

I think it is important to highlight that the OPT consultation is not a consequence of the current need to change the income administrators for the AA Rayner Fund. It is a separate piece of work which is determining if the current model of oversight of all Charitable Funds through their Trustees is appropriate within the context of modern governance requirements. Proposition P.92/2021 has no significant direct impact on the current arrangements or obligations for the Trustee of the AA Rayner Fund.

In relation to the 18-month pilot programme I feel it would be more beneficial for me to provide an earlier interim update to Members after 12 months, in the form of a public Report. The outcome of the pilot programme will most likely be shaped by the evaluation of the Charities Commissioner and his views on the suitability of a corporate income administrator as a long-term solution.

I believe that officers have undertaken significant and relevant consultation on the proposals that are now before the Assembly and I am confident that such consultation and transparency will continue as the pilot programme progresses.

I hope this assures the Panel and States Members that unilateral changes to the Fund cannot be made without the level of transparency that is expected and that any changes to the specific objects will still require the Assembly's approval.
