Corporate Services Scrutiny Panel Independent Taxation Legislation
The Corporate Service Scrutiny Panel wish to thank you for the briefing received on 16th February 2023 by your Assistant Minister, Deputy Elaine Millar , and Officers to update us on the progress to date of the final stage of the Independent Taxation legislation.
Subsequent to discussing the briefing and our potential scrutiny approach of the draft legislation at our meeting on 21st February 2023, the Panel has agreed to request further information to facilitate our scrutiny process in order to avert any unintended delays, where possible, to the Government's intended timeline for the legislation. As such, the Panel requests to receive clarity on the following items:
- Confirmation of the intended lodging timeline of the draft legislation.
- Confirmation of when the Panel will receive the draft legislation.
- Whether the draft legislation could be shared in confidence with the Panel prior to lodging and as early as possible.
- Whether the lodging timeline will allow for potential amendments to be made to the draft legislation should concerns be highlighted as a result of the Panel's review.
- Whether having the draft legislation referred to the Panel for further scrutiny (under Standing Order 72), should the draft legislation be approved in principle by the States Assembly, would impact on the Government's intended timeline for the workstream.
Please be advised that it is the Panel's intention to present Comments ahead of the States' debate on the proposition and to engage targeted stakeholders to inform its contents. The Panel wish to ensure that the process runs as smoothly as possible whilst affording appropriate scrutiny of the draft legislation.
In light of the above, the Panel look forward to receiving this information via a formal written response by no later than Thursday 2nd March 2023. Please be aware that it is our intention to publish the response received on the States Assembly Website.
