Legal advice Protocol

The  Committee  considered  the  above  matter  in  light  of  the meeting of the same day with the Council of Ministers. Whilst the Committee was of the opinion that the paper provided by H.M. Attorney General contained a number of inaccuracies, it agreed that  it  would  await  the  outcome  of  the  Council  of  Ministers consideration prior to taking any further action.

It  did,  however,  agree  that  should  the  Council  of  Ministers approve the draft protocol it would proceed accordingly to lodge the draft Code of Practice for Scrutiny Panels and PAC. In the event that the Council did not approve the protocol, it would inform the Council that it would proceed with the lodging of the draft Code of Practice with the inclusion of the section on legal advice.

On a related matter, it was agreed to circulate the draft Code of Practice, excluding the legal advice section, to all Scrutiny Panel members and PAC. I was important that members recognised that the document was in draft form and was for their information only.

Strategic Plan 2006 -2011

The Committee noted that the Panels had scheduled time to consider the above and it was agreed that it was important for scrutiny to have a high profile in respect of this matter.

It  was  noted  that  the  next  Chairmen's  Committee  meeting scheduled for 21st April 2006 had been cancelled and would now be held on 20th April 2006 commencing at 9.30am
