1. Policing of Events – User Pays

The Panel considered the evidence it had received during the review and  discussed  the  eventual  content  of  its  final  report.   The  Panel requested the Officer to draft Heads of Report for its consideration.

The Panel recalled that at the Public Hearing that morning, it had been advised  that  the  States  of  Jersey  Police  could  at  times  recover expenses from Court and Case Costs. The Officer was requested to research this situation.

2. Records of Meetings

The Panel approved and signed the following records of its meetings:

  • 12th October 2007 [Private Session]
  • 29th October 2007 – Briefing on Event-led Tourism
  • 30th October 2007 [Private Session]
  • 12th November 2007

The Panel noted that whilst its meeting on 12th October 2007 had been held in private session, the record of the meeting did not contain any information of a confidential or sensitive nature. The Panel agreed to release the record into the public domain. It requested the Officers to check the records of other meetings that had been held in private session with a view to identifying records that could legitimately be placed in the public domain.

3. Rôle of the Centenier in the Magistrate's Court

The Panel considered and approved an evaluation form for the review. It was noted that the draft Code of Practice for Scrutiny Panels and the Public Accounts Committee required that an evaluation occur at the end of each review. The Panel was advised that the current format of the evaluation form had recently been developed.

The Panel considered a paper concerning responses to The Rôle of the Centenier  in  the  Magistrate's  Court  (SR18/2007)  and  noted  that responses had been requested from the following parties:

 

 

  • Minister for Home Affairs
  • H.M. Attorney General
  • Magistrate
  • Comité des Chefs de Police

The Panel noted that responses had been received from the Minister for Home Affairs and H.M. Attorney General. The Panel was advised that the Chairman had recently met a Centenier and had been informed that the Comité des Chefs de Police would respond in due course. It was agreed not to contact the Magistrate at this time, pending a response from the Comité des Chefs de Police.

4. Code of Practice

The Panel noted correspondence (dated 9th November 2007) that had been received by the President of the Chairmen's Committee from the Chief Minister regarding the draft Code of Practice for Scrutiny Panels and the Public Accounts Committee.

The Panel considered comments on the draft Code of Practice that it had previously identified and confirmed that they could be forwarded for the Chairmen's Committee's attention.

5. Machinery of Government Review

The Panel was advised that a request had been made for its comments on Machinery of Government Review (R.105/2007) to be forwarded by 4th  December  2007  for  the  Chairmen's  Committee's  attention. It identified comments relating to recommendations 17 and 25.

6. Action Updates and Matters Arising

The Panel noted the actions undertaken in response to requests made at its previous meetings.

7. HMP La Moye

The Panel was advised that Mr. R. Pittman had been informed that the Panel  would  consider  the  issues  he  had  raised  when  it  came  to consider its next review topic.

8. Overdale

The Panel was advised that the Chairman, along with other members of the former Social Affairs Scrutiny Sub-Panel (Overdale Review), would meet the Minister for Health and Social Services on 27th November 2007 in connection to the Overdale Review.

 

 

9. Forthcoming Propositions

The Panel noted that no propositions had recently been lodged by the Minister for Education, Sport and Culture or the  Minister for Home Affairs.

 

 

10. Ministerial Decisions

The Panel noted that the following decisions had been made by the Minister for Home Affairs:

  • Amendment  of  the  Community  Provisions  (Control  of  Dual-Use Items and Technology)(Application)(Jersey) Regulations 2002 (MD- HA-2007-0076) – 25th October 2007
  • Request for extension of Temporary Release at Christmas (MD-HA- 2007-0077) – 1st November 2007

 

 

11. Questions to Ministers

The Panel noted that the Minister for Social Security and the Chief Minister would answer questions without notice at the States sitting of 4th December 2007.

 

 

12. Media Release

The Panel agreed it would not issue a media release following the

 

 

meeting.

 

 

13. Future Meetings

The Panel noted that its next scheduled meeting would occur at 9:30am on 10th December 2007.

14. Disorderly Conduct and Harassment

The Panel recalled that, on 30th November 2006, it had advised the Minister for Home Affairs of its view on the draft  Crime (Disorderly Conduct  and  Harassment)(Jersey)  Law  200-. It  agreed  to  defer consideration of the most recent draft of the law to its next scheduled Panel Meeting.

15. Early Years

The  Panel  noted  arrangements  for  27th  to  29th  November  2007 including for the Public Hearing with the Minister for Education, Sport and Culture accompanied by Dr. S. Mountford, Administrator Day Care Registration. Consideration was given to the question plan for the Hearing. It was noted that a copy of Dr. Mountford's thesis had been received. The Panel was advised that whilst the thesis could potentially be used, it could not be copied.

Copies of written submissions that had recently been received in the Scrutiny Office were distributed. The Panel also received an update on requests that had not yet been answered.
