1. Customs and Immigration

The Panel received copies of the draft Heads of Report. It was agreed that  Panel  Members  would  consider  the  document  and  forward comments to the Scrutiny Office. Following the postponement of the Public Hearings of 25th July 2008, it was noted that advice had been received of the availability for Hearings of Senator W. Kinnard, Minister for Home Affairs, during August 2008.

2. Police Force Law

a) General Matters

The Panel noted receipt from the Department of Home Affairs of a law- drafting brief, dated 4th March 2004, for the Draft Police Force (States) (Jersey) Law 200-.

The  Panel  was  advised  by  the  Chairman  that  the  Chairmen's Committee had passed comment on the proposed timescale of the review at the Committee's meeting on 18th July 2008.

The Panel considered the subsequent steps to be taken on the review and noted that, dependent on the format chosen, a call for submissions from the public could potentially be made before the draft law was lodged.

The Panel recalled that a scoping document and provisional Terms of Reference  had  been  approved  for  the  review.   The  Officer  was requested to bring copies to the next meeting.

It was noted that the Panel would most likely seek the views of the Comité des Connétable s and the Comité des Chefs de Police. The Officer was requested to contact both Comités to advise them of this fact and to ascertain how quickly the Comités would be able to respond to any request made.

The Panel recalled that advice had been received on the availability of the Minister for Home Affairs in August 2008. Consideration was given to the potential timescale of the Police Force Law Review and it was agreed  that  the  week  beginning  11th  August  2008  would  be  most suitable for Public Hearings to be held. The Officer was requested to make inquiries as to whether the Minister could attend on 11th or 12th August 2008.

It was noted that the draft law had been distributed for comment to all States Members. It was further noted that one Member had forwarded for the Panel's attention a copy of the submission that the Member had made to the Minister for Home Affairs. It was agreed that a request should be made for the Panel to receive a copy of all the consultation correspondence received by the Minister.

b) Advisor

The  Panel  held  an  interview  with  a  prospective  candidate  for  the position of expert advisor. This part of the meeting was held in private session under Articles 3.2.1(a)(i), 3.2.1(a)(xii) and 3.2.1(a)(xiii) of Code of Practice on Public Access to Official Information.

3. Social Inclusion – Mont-à-l'Abbé

The  Panel  noted  that  a  draft  report  had  been  prepared  for  its consideration. It was further noted that the draft report might not have reached all Panel Members and the Officer was therefore requested to circulate the draft by e-mail.
