1.  Draft Criminal Procedure (Jersey) Law 201-

The Sub-Panel recalled the briefing from HM Attorney General and Officers  from  the  Law  Officers  Department  and  the  Department  for Community and Constitutional Affairs. It was agreed that the draft law was a welcome change to the criminal justice system, however further scrutiny was required in order to identify areas that could be improved.

The Officer advised that the closing date for submissions to the Panel's review was currently Friday 12th January 2018.

The Sub-Panel discussed the major changes that would be created if the draft law was adopted. It was noted that an email had not yet been sent to all States Members informing them of the Sub-Panel's intention to call in the draft law under standing order 72, due to the Christmas break. The Officer advised that a draft would be circulated later in the day for Sub- Panel approval, after which it would be sent out. It was agreed that this email would also include a list of the key changes that would be brought in should the draft law be adopted.

The Sub-Panel agreed that it would issue comments prior to the debate on 16th January 2018. It was agreed that the comments would be presented in a similar format to the email to all States Members, with the key  changes  being  elaborated  further.  The  Officer  advised  that  the comments would need to be issued by Friday 12th January and a first draft would be circulated shortly.

The Sub-Panel noted that the Access to Justice Review submissions were available on the States of Jersey website and requested that any submissions relating to court proceedings be circulated. The Officer advised that the Director for Criminal Justice would be consulted as to what crossover there was, if any, with the Access to Justice review and the draft law. It was noted that the Law Society had published a response to the Draft Criminal Procedure (Jersey) Law 201- on its website. The Sub-Panel requested that this be circulated for information.

2.  Future Meetings

The Sub-Panel agreed that it would next meet at 1:00pm on Thursday 18th January 2018. The Officer advised that a meeting request would be sent out shortly.
