Regulations for the licensing, production and export of Medicinal Cannabis in Jersey – Withholding of Information

Following on from my letter to you dated 30th June, I write to inform you that the Panel has yet to receive the details of applicants seeking licences to undertake work in the medicinal cannabis industry.

We understand our officer has been in correspondence with officers from your Department and the matter of sharing this information with the Panel and its advisers is being looked at by the Law Officers. However, to speed up the process, we now invite and request you to immediately share the documentation with the Panel on the basis that we will keep it confidential and not pass it on to our advisers at this stage. Please note that the Panel regard this as an interim measure for the purpose of enabling our advisers to complete their report and with a view to avoiding further delay. This suggestion should not therefore be construed as a substitute for the Panel and its advisers receiving the full unredacted information to which it is entitled and which it expects to so receive once you have the appropriate advice from the Law Officers.

We respectfully remind you that, at our recent public hearing, you informed the Panel that we could have sight of this information; however, on subsequently requesting it, our officer was informed that whilst the Department was content to pass this information to the Panel, it was reluctant to give approval for it to be shared with the Panel's advisers. We therefore trust you will find this short-term solution acceptable and that the Panel can look forward to receiving the information imminently.
