Our greatest concern regarding migration to the island is around the abuse and misuse of migrant workers across industries. The focus of the panel appears to be mainly around population control/housing permission, although section 8 of the Migration Control Policy does touch on migrants' rights.
We are currently involved in an evidence gathering exercise of the experiences of migrant workers who come to Jersey on the promise of contracts, are used for six months by the employer and then dismissed (didn't pass probation') with no redundancy and no rights to stay in Jersey. These workers may well have given up a job and family home in their country of origin, spent a lot on relocating and now find themselves with no job, no home to return to and no savings to get home.
We would like to see something within the review that looks at providing a safety net for migrant employees unwittingly caught in this trap and potential sanctions to stop unscrupulous employers from using the Employment Law in conjunction with migration controls to undertake this kind of sharp practise.
We would be happy to discuss this further with the review panel and to provide some case studies that illustrate the problems faced by migrants treated in this way.
