STATES OF JERSEY LAW 2005: DELEGATION OF FUNCTIONS – PLANNING AND ENVIRONMENT – REVISED DELEGATIONS NOVEMBER 2014

REPORT

On 1st December 2014, the Minister for Planning and Environment made a Ministerial Decision delegating certain of his functions under Article 28 of the States of Jersey Law 2005 (MD-PE-2014-0107, available at www.gov.je).

Article 28 of the States of Jersey Law 2005 permits a Minister to delegate, wholly or partly, functions to an Assistant Minister or an officer.

The Law states, inter alia

"28  Power of Minister to delegate functions

  1. A Minister may delegate, wholly or partly, functions conferred upon or vested in the Minister by or under this Law or any other enactment or any enactment of the United Kingdom having effect in Jersey, to –
  1. one of his or her Assistant Ministers;
  2. an officer.
  1. A Minister shall not delegate –
    1. any power to make an enactment;
    2. any power to decide an appeal under an enactment;
    3. any function the delegation of which is prohibited by an enactment.
  2. The delegation of functions by a Minister under this Article shall not prevent the Minister exercising those functions personally.
  3. Where  any  licence,  permit  or  authorization  is  granted  in  purported exercise  of  functions  delegated  under  paragraph (1),  no  criminal proceedings shall lie against any person for any act done, or omitted to be done, in good faith and in accordance with the terms of the licence, permit  or  authorization,  by  reason  that  the  functions  had  not  been delegated,  or  that  any  requirement  attached  to  the  delegation  of  the functions had not been complied with.
  4. In this Article –

"Minister" includes the Chief Minister;

"officer"  means  a  States'  employee  within  the  meaning  of  the Employment  of  States  of  Jersey  Employees  (Jersey)  Law 2005  and includes a member of the States of Jersey Police Force and an officer appointed  under  paragraph 1(1)  of  Part 1  of  Schedule 2  to  the Immigration Act 1971 as extended to Jersey by the Immigration (Jersey) Order 1993.

  1. The  States  may  by Regulations  amend  the  definition  "officer"  in paragraph (5)."

1.  Background:

Article 28 of the States of Jersey Law 2005 allows a Minister to delegate any function for which they have responsibility, to an Assistant Minister or an Officer.

The Scheme of Delegation ensures that decisions are made at the appropriate level to ensure the efficient administration of the Minister's duties and responsibilities.

No delegations made prevent the Minister from exercising those functions personally.

2.  Delegations to the Assistant Minister

In pursuance of Article 28(1) of the States of Jersey Law 2005, the Minister delegates all powers and functions in respect to the Department of the Environment, including all other areas  where  the  Minister  would  otherwise  have  to  act  and  be  advised, to his  Assistant Minister, Connétable S.W. Pallett of St. Brelade , for any periods when he is unavailable or out of the Island.

3.  Delegations to Officers – Public Finances (Jersey) Law 2005

In pursuance of Article 28(1) of the States of Jersey Law 2005, the Minister delegates the following powers and functions in respect to the Department of the Environment to officers subject to the conditions as stated.

The conditions

1.  Authorised Officers refer to those Officers indicated in the table above.

2.  Proposals  which,  if  approved,  would  involve  a  departure  from  the  Island  Plan,  any

guidelines or policies published in accordance with Article 6 of the Planning and Building

(Jersey) Law 2002, or any other approved planning policy or Ministerial Guidance may

only be considered by the Planning Applications Panel (PAP) and nominated Authorised

Officers and where, in their opinion, there are good grounds to consider approving the

application it may grant such a permission.

3.  Where the Planning Applications Panel is minded to reach a decision on an application

which is fundamentally contrary to the Department's recommendation, the decision will

not  be  taken  at  that  meeting,  but  referred  to  the  Minister,  who  may  seek  further

information, issue advice to the Panel, or decide the application him/herself.

4.  Neither the Planning Applications Panel, nor any Authorised Officer, will make any

decision or otherwise exercise any function in any case in which the Minister has given

notice  that  he  wishes  to  make  the  decision  or  exercise  the  function  himself.  Such

indication may be given at any stage prior to the making of the decision or exercise of the

function in pursuance of the delegated powers.

5.  Where it is considered beneficial, the Minister may sit with the Planning Applications

Panel.

6.  In relation to all powers indicated above – save for those in relation to the Building Bye-

Laws, Dangerous Structures and Caravans – all decisions made by an Authorised Officer

will  be  made  on  the  basis  of  a  recommendation  from  another  Officer.  Any  such

recommendation shall be made in writing and must identify all the material considerations

relevant to the decision to be taken or the action to be taken.

7.  In considering applications for planning permission, Authorised Officers may determine

applications where representations have been received, where those representations have

been accommodated by revisions to the application or by the imposition of relevant

conditions.

8.  In considering applications for planning permission, Authorised Officers may determine

applications where representations have been received from 3 or less individuals, where

each individual appears to be from a separate address – when the representations are

contrary to the recommendation.

9.  In deciding whether to include a building or place on a List of Sites of Special Interest,

Authorised Officers may take a decision when representations have been received in

connection  with  the  process  but  where  those  representations  are  not  material  in

considering whether to include the building or place on any List.

10. In deciding whether to include a tree or group of trees on a List of Protected Trees,

Authorised Officers may take a decision when representations have been received in

connection  with  the  process  but  where  those  representations  are  not  material  in

considering whether to include the tree or group of trees on a List.

11. In granting permission to import a caravan, campervan or any other vehicle with sleeping,

etc.  accommodation  into the  Island  the  Hospitality  and  Leisure  Manager  (Economic

Development department) must attach the following conditions –

(a) Caravans can only be accommodated on the following sites –

 Beuvelande ( St. Martin ),

 Daisy Cottage Campsite ( St. Ouen ),

 

 Rozel Camping Park ( St. Martin ),

 Jersey Accommodation and Activity Centre ( St. Martin ).

(b) Where  the  visitor  is  staying  at  a  private  address  or  tourist  accommodation

motorhomes may not be used for overnight accommodation although they will be

permitted to circulate the Island providing a valid permit is shown.

(c) The maximum duration of stay is 31 days from the date of arrival in Jersey.

(d) Visiting Caravans are restricted to one journey to and one journey from the campsite

to the port. Caravans must remain on the designated site for the period of the permit.

Motorhomes/campervans may circulate on the Island on a daily basis but must return

to the designated campsite each night.

(e) Where it is necessary to change vessels when in transit in either direction between the

UK and France motorhomes/campervans are permitted to circulate the Island subject

to a valid permit being displayed.

(f)  A permit displaying the dates for which the permission is valid must be displayed in

the vehicle towing the caravan or motorhome/campervan.

(g) The caravan or motorhome/campervan shall have in effect at all times during the

duration of the visit a valid policy or policies of insurance against public and third

party liability.

(h) The maximum dimensions allowed are –

(i)  Width of caravan, motorhome or towing vehicle 2.3 metres;

(ii)  Length of any caravan 6.7 metres (excluding the means of attachment to the

towing vehicle). Length of any motorhome/campervan 9.3 metres;

(iii)  Caravan and towing vehicle 16.50 metres (to include any projection to the front

or rear of the vehicle)

 

12. In deciding an application and any requirement for remedial action in connection with a

submission under the High Hedges (Jersey) Law 2008, Authorised Officers may only

make a decision when representations have not been received from the owner of the

hedge that is the subject of the application.

The  Animal  Welfare  (Jersey)  Law 2004  to  restrict  the  powers  of  an inspector  appointed  under  Article 22, prohibiting  them  from  exercising functions in relation to licensing if the licensed activity is also undertaken by the inspector or his/her employers.

Conservation of Wildlife (Jersey) Law 2000

 A  Law  to  protect  scheduled  wild animals  and  birds  and  their  nest  or dens  from  death,  damage  or disturbance.

Article 16 allows for the licensing of normally  prohibited  activities  under Articles 6, 8, 9, 10, 11 and 15.

Licences  may  only  be  issued  if  the thing  to  be  done  is  for  scientific, research  or  educational  purposes (e.g. ringing,  marking,  tracking); preserving public health or public or air  safety;  the  re-introduction  of  a species, the purpose of conservation or the  prevention  of  the  spread  of diseases, preventing serious damage to livestock and crops, AND

there  is  no  other  satisfactory solution  and  that  anything Authorised by the licence will not be  detrimental  to  the  survival of the population concerned'.

 Community Provisions (Welfare of Animals during Transport) (Jersey) Regulations 2013

The object of these Regulations is to ensure  the  application  and implementation of 2 European Council Regulations that deal with the welfare of  animals  when  they  are  being transported.

Those  Regulations  are   Council Regulation  (EC)  No  1/2005  and Council Regulation (EC) No 1255/97 which  harmonise  applicable  animal welfare controls as well as preventing the occurrence and spread of infectious animal diseases. These Regulations put in  place  more  stringent  requirements than previously, so as to prevent pain and suffering in order to safeguard the welfare and health of animals during and after transport.

Pursuant to Article 9(1) of the Law, the Minister for Planning and Environment is  designated  as  the  Scientific Authority.
