LA RUE DU CIMETIERE – EXTINGUISHMENT OF PART OF THE BY-ROAD;

TRANSFER OF OWNERSHIP OF PART OF PUBLIC LAND FOR INCORPORATION INTO LA RUE DU CIMETIERE.

REPORT

Decision(s):  Under  Standing  Order  168(3)  the  Minister  for  Infrastructure  hereby notifies the States that he has accepted the recommendation of the Property Holdings Department to agree to the following –

  1. Land transaction –

To grant a 9-year lease under the terms and conditions set out in the report accompanying the Ministerial Decision; and to rescind MD-PH-2017-0047.

The Minister hereby authorises, as applicable, the Attorney General and the Greffier of the States to pass any contract which is required to be passed on behalf of the Public; and the Director of Property Holdings to conclude any contract which is required to be concluded on behalf of the Public.

After the expiry of 15 days following presentation to the States the transaction may be concluded.

  1. Land transaction –

In accordance with Article 2(2) of the Extinguishment of Roads (Jersey) Law 1972, the Minister represented to the Parish of St. Brelade Roads Committee that the extinguishment of 2 areas of the by-road known as La Rue du Cimetière (being: (i) a small section measuring 15.53 m.² forming an entrance leading to the car park of the St. Brelade Social Club; and (ii) the site of the kerbing forming the north and west limits of the said by-road) is necessary or desirable in connection with the proper development of the new Les Quennevais School and its appurtenances.

The Minister hereby authorises, as applicable, the Attorney General and the Greffier of the States to pass any contract which is required to be passed on behalf of the Public; and the Director of Property Holdings to conclude any contract which is required to be concluded on behalf of the Public.

After the expiry of 15 days following presentation to the States the transaction may be concluded.

  1. To approve the transfer of a 44.27 m² section of land owned by the Public of the Island to the Parish of St. Brelade for incorporation into the Parish By-Road known as La Rue du Cimetière.
  2. Upon extinguishment, to receive a 15.53 m² section of land (formally designated as a By-Road) owned by the Parish of St. Brelade in order for  the  delivery  of  the  new  Les  Quennevais  School  and  its appurtenances in accordance with Planning Permit P/2017/1015, the said  areas  required  for  incorporation  in  the  proposed  cycle  track extension.

The Minister hereby authorises, as applicable, the Attorney General and the Greffier of the States to pass any contract which is required to be passed on behalf of the Public; and the Director of Property Holdings to conclude any contract which is required to be concluded on behalf of the Public.

After the expiry of 15 days following presentation to the States the transaction may be concluded.
