REPORT

On 24th June 2024, theMinister for Education and Lifelong Learning made a Ministerial Decision delegating certain of his functions under Articles 28, 30 and 30A of the States of  Jersey  Law  2005 (see  Decision  reference  MD-ELL-2024-495,  available  at www.gov.je).

In accordance with Article 31(4) of the Education (Jersey) Law 1999, the Minister for Education and Lifelong Learning may by written direction delegate the power to receive and determine any appeal under paragraph (2)(g) to the Chief Officer or to a panel of persons appointed by the Minister for the purpose, subject to the conditions, exceptions or qualifications that the Minister may specify in the direction.

The terms of the delegations, and the legislation under which those delegations were made, were recorded in a Report attached to the Ministerial Decision, as shown below –

 

Delegate:

A panel of persons in accordance with the conditions, exceptions or qualifications as described below

Functions delegated:

To receive and determine any appeal under paragraph (2)(g) of the Education (Jersey) Law 1999.

Scope of delegation:

The panel of persons shall consist of:

  1. A Senior officer within the Children, Young People, Education and Skills (CYPES) department;
  1. An independent member of high standing possessing a demonstrable understanding of Special Educational Needs; and
  1. The Chief Officer of CYPES.

Members of the panel must not have a vested interest in the outcome, or any involvement in an earlier stage, of the proceedings.
