The Council of Ministers notes that the Minister for Economic Development has issued a detailed comment in relation to this proposition.
In connection with paragraph (a)(ii) of the proposition, the Council of Ministers supports the view of the Minister for Economic Development that the fulfilment industry has already been the subject of comprehensive reviews in the recent past, and that a further review at this stage is unnecessary.
In relation to paragraph (b) of the proposition, the Economic Affairs Scrutiny Panel has proposed that the Council of Ministers should carry out a review of the current mechanisms across all ministerial departments for appeals against ministerial decisions under statutory powers, together with the mechanisms for dealing with requests for reconsideration of such decisions, and should then bring forward a code of practice in respect of such appeals and requests for reconsideration for consideration by the States. In support of this proposal, the Scrutiny Panel has stated in its report that it considers it would be appropriate for there to be a standard method of appeals.
The Council of Ministers is not persuaded that it would be desirable to introduce standard arrangements across all departments, especially given the nature and range of the different kinds of decisions that are taken by Ministers. The Council would nonetheless be willing to carry out the proposed review and to report back to the States with recommendations. However, this is a significant piece of work that cannot be delivered by 30th April. It will involve consultation with all States departments at a time when the Council is already fully engaged with the implementation of the Strategic Plan, and the Council therefore proposes that the deadline for this report should be changed to 31st December 2007.
