THE STATES assembled on Tuesday, 24th  February,  1981  at  10.15 a.m. under the Presidency of the Bailiff , Sir Frank Ereaut.

Subordinate legislation tabled.

The  following  enactments  were  laid  before  the  States, namely –

  1. Airport Dues (Tariff) (Jersey) Order, 1981. R & O–6906.
  2. Road  Traffic (Saint  Clement)  (Amendment  No. 3) (Jersey) Order, 1981. R & O–6907.
  3. Road Traffic (Saint Saviour) (Amendment No. 6) (Jersey) Order, 1981. R & O–6908.

Draft Administrative Decisions (Review) (Jersey) Law, 198 . P.18/81.

Presented  by  the  Special  Committee  to  consider relationship  between  Committees  and  the  States.  The States decided to take this subject into consideration on 24th March, 1981.

Glasshouse growers: financial assistance (P.115/80).

THE STATES noted that Senator Richard Joseph Shenton had withdrawn his Proposition regarding financial assistance to glasshouse growers (P.115/80 – lodged on 19th August, 1980) having lodged a revised Proposition at the meeting of 17th February, 1981 (P.14/81).

Aid to Glasshouse Industry (P.14/81).

THE STATES, on the proposition of Deputy Philip George Mourant of St. Helier , decided to take the Proposition regarding aid to the glasshouse industry of Senator Richard Joseph Shenton into consideration on 24th March, 1981, having rejected the request of Senator Shenton that the Proposition be considered on 10th March, 1981.

Bellozanne Valley – purchase of land, inclusion of covenants in contract.

THE STATES, adopting a Proposition of the Island Development Committee, approved the inclusion of the following clauses in the proposed contract between Mr. John Gordon Cudlipp and the Public for the acquisition of approximately 0.489 vergées of land (area D at Bellozanne Valley) approved for purchase by the States on 24th June, 1980, namely that –

  1. the Public will never establish or construct a public road on the land to be sold by Mr. Cudlipp to the Public;
  2. the Public will never cause or permit on the said land to be sold by Mr. Cudlipp to the Public any activity or user which by its odour, smoke, noise or any other characteristic will cause any nuisance (as understood under English Law) to the said Mr. Cudlipp, his heirs or assigns in respect of his enjoyment of the land retained by him in the neighbourhood.

Balmain Nursery, St. Helier : transfer of administration.

THE STATES, adopting a Proposition of the Education Committee –

  1. referred to their Act of 16th September, 1969, approving the purchase from Balmain Gardens and Nurseries Limited, if necessary in accordance with the provisions of the Compulsory Purchase of Land (Procedure) (Jersey) Law, 1961, as amended, of the property known as Balmain Gardens and Nurseries, measuring approximately 4 vergées 29 perch, shown outlined in red on Drawing No. APP.5/80, for the purpose of providing a site for a primary school, and agreed to transfer to the Housing Committee the administration of this property;
  2. authorised the Greffier of the States to sign the said Drawing on behalf of the States.

Unemployment benefit.

THE STATES rejected a Proposition of Deputy Norman Stuart Le Brocq of St. Helier that the Social Security Committee be instructed to prepare legislation for the payment of unemployment benefit, such benefit to be limited to unemployed persons with at least three years' Jersey residence, and such other qualifications as the Committee considered necessary.

The Bailiff having informed the House of the announcement of the engagement of His Royal Highness The Prince Charles, the States unanimously adopted a resolution in the following terms –

"The Members of the States of Jersey assembled, having learned with profound pleasure of the announcement of the engagement of Your Royal Highness to the Lady Diana Spencer, offer your Royal Highness their loyal and affectionate greetings and their good wishes on this joyous occasion."

The States requested the Bailiff to arrange for the terms of the foregoing resolution to be communicated to His Royal Highness.

Patents (Amendment) (Jersey) Law, 1981.

THE STATES, subject to the sanction of Her Most Excellent Majesty in Council, adopted a Law entitled the Patents (Amendment) (Jersey) Law, 1981.

La Collette Land Reclamation Scheme – Ballast Nedam Groep N.V., contractor.

THE STATES, adopting a Proposition of the Harbours and Airport Committee, approved the settlement in respect of all outstanding claims from Ballast-Nedam Groep N.V., the contractor for the La Collette Reclamation Scheme, in the sum of £1,200,000, together with interest at the rate of 13 per cent on that figure between the date of the acceptance of the settlement by the States and the date of the April Supply Day.

Archlow Villa, St. Peter – purchase.

THE STATES, adopting a Proposition of the Harbours and Airport Committee –

  1. approved the purchase of "Archlow Villa", St. Peter , from Mr. Francis Edward Tressard for a consideration of £50,000 for the realty plus legal expenses, and subject to Mr. Tressard retaining the right to occupy the property until 30th June, 1981;
  2. authorised the Attorney General and the Greffier of the States to pass the necessary contract in the matter;
  3. authorised the Island Development Committee to transfer a sum sufficient to meet the costs of purchase and legal expenses from the Capital Vote of Credit granted to it under the heading "Acquisition of Land – Major Reserve" (Vote No. C.0904), to a new Capital Vote of Credit under the heading "Purchase of Archlow Villa, St. Peter " to be administered by the Harbours and Airport Committee.
