Standing Order 55A – remote participation
THE STATES, with reference to their Act dated 14th September 2021, in which they had agreed that, notwithstanding Standing Order 55A(1), members who did not wish to attend in the States Chamber might continue to take part in States meetings using Microsoft Teams (until the States had considered and voted upon a proposition to re-apply Standing Order 55A(1) or to repeal or vary the terms of the Standing Order), assembled in accordance with Standing Order 55A with members able to participate remotely using Microsoft Teams.

The Deputy Bailiff informed the Assembly that the Bailiff had received a letter from Dr. Mark Egan, Greffier of the States, in which the Greffier had indicated his intention to resign from his post in the summer of 2022.
Written Questions
WQ.427/2021 1. The Minister for Infrastructure had tabled an answer on 3rd November 2021 to a question
asked by Deputy R.J. Ward of St. Helier regarding the Government's contract with LibertyBus.
WQ.428/2021 2. The Minister for Infrastructure had tabled an answer on 3rd November 2021 to a question
asked by Deputy R.J. Ward of St. Helier regarding the travel on buses by carers with prams.
In light of the fact that a number of recent responses to written questions had not been submitted by the deadline prescribed by Standing Orders, the Deputy Bailiff informed the Assembly that Ministers should ensure that sufficient priority was given to written questions so that they were responded to within the prescribed deadline.
The Deputy Bailiff , in accordance with Standing Order 12(4)(b), ruled that the answer tabled on 3rd November 2021, by the Minister for Infrastructure to the question asked by Deputy Robert James Ward of St. Helier (WQ.428/2021) contravened Standing Order 12(2A), and directed the Minister for Infrastructure to submit an answer that did not contravene the Standing Order.
The Deputy Bailiff , following the referral by Senator Kristina Louise Moore of the answer to her written question to the Minister for Health and Social Services (WQ.425/2021), ruled, in accordance with Standing Order 12(4)(b), that the answer tabled on 1st November 2021 to the question did not contravene Standing Order 12(2A) and that an alternative answer was therefore not required.

Competent Authorities Ministers: Release of minutes of meetings to Scrutiny P.86/2021
THE STATES, resumed consideration of a proposition of the Corporate Services Scrutiny Panel entitled Competent Authorities Ministers: Release of minutes of meetings to Scrutiny' (P.86/2021), and an associated amendment of the Council of Ministers (P.86/2021 Amd.).
The Deputy Bailiff , in accordance with Standing Order 167, ruled that the proposition of the Corporate Services Scrutiny Panel should be read alongside the Code of Practice for Engagement between Scrutiny Panels and the Public Accounts Committee and the Executive', adopted by Act of the States on 10th April 2018; that there would need to be clear words in a proposition to oust, or set aside, the constitutional convention regarding advice from the Law Officers recognised in Paragraph 36 of the Code of Practice for Engagement; and that, consequently, the reference to the provision of minutes "without redactions" in the proposition of the Corporate Services Scrutiny Panel did not extend to the provision of legal advice from the Law Officers.
THE STATES resumed consideration of the amendment of the Council of Ministers (P.86/2021 Amd.) and, acceded to a request of the Chief Minister, made in accordance with Standing Order 69(4), that the amendment be withdrawn.
THE STATES, adopting the proposition of the Corporate Services Scrutiny Panel, agreed that, on request by the Scrutiny Liaison Committee, any approved minutes of meetings of the Competent Authorities Ministers should be shared in confidence and without redactions by the Chief Minister with that Committee for distribution to the relevant Scrutiny Panels.
