After the words "the draft Island Plan 2022-25" insert the words "except that the Corbière Walk (as spatially defined in the Policing of Parks (Jersey) Regulations 2005) should be designated as protected open space and subject to Policy CI7, with the draft Island Plan 2022-2025 Proposals Map and the draft Island Plan 2022-2025 amended accordingly."

THE STATES are asked to decide whether they are of opinion

to approve, in accordance with Article 3(1) of the Planning and Building (Jersey) Law 2002, as amended by the Covid-19 (Island Plan) (Jersey) Regulations 2021, the draft Island Plan 2022-25, except that the Corbière Walk (as spatially defined in the Policing of Parks (Jersey) Regulations 2005) should be designated as protected open space and subject to Policy CI7, with the draft Island Plan 2022-2025 Proposals Map and the draft Island Plan 2022-2025 amended accordingly.

REPORT

This amendment seeks to bring an additional layer of protection to both the land at Pont Marquet Country Park and the Corbière Walk (better known as the Railway Walk). The Corbière Walk, together with other amenity areas adjacent to it, is already defined as a park' under the Policing of Parks (Jersey) Regulations 2005 (relevant maps included at Appendix A).

By bringing the Corbière Walk and Pont Marquet Country Park under Policy CI7, the area becomes a protected open space which essentially means that development of any kind will not be supported unless under exceptional circumstances.

The Outdoor Open Space, Sport and Recreation Study 2008 references parks as embracing a wide range of functions, including:

Informal recreation and outdoor sport

Play space of many kinds (including for sport and children's play)

Providing attractive walks to work

Offering landscape and amenity features

Areas of formal planting

Providing areas for events'

Providing habitats for wildlife

and Pont Marquet Country Park is no exception - it is also reportedly one of the best places to see red squirrels. The Corbière Walk shares some of these attributes and provides an opportunity to amble along a well-maintained path in the midst of the countryside. Its level surface allows the use of buggies, wheelchairs etc making the Corbière Walk attractive – and importantly, accessible to many.

By enhancing the protection for the area, this amendment also supports the Inspiring An Active Jersey 2020-2030 Mission – "More active people for a healthier island".

I ask Members to support this amendment and provide this extra level of protection for the area.

Financial and manpower implications

There are no financial or manpower implications in relation to the adoption of this amendment.

This amendment has been assessed in relation to the Bridging Island Plan CRIA. It is considered that this amendment safeguards access to open green spaces for children and ensures that, in particular, children's rights under Article 31 (leisure, play and culture) of the UN Convention of the Rights of the Child are maintained and reinforced.
