THE STATES, with reference to their Act dated 14th September 2021, in which they had agreed that, notwithstanding Standing Order 55A(1), members who did not wish to attend in the States Chamber might continue to take part in States meetings using Microsoft Teams (until the States had considered and voted upon a proposition to re-apply Standing Order 55A(1) or to repeal or vary the terms of the Standing Order), assembled in accordance with Standing Order 55A with members able to participate remotely using Microsoft Teams.

THE STATES, resuming consideration of a proposition of the Council of Ministers entitled Proposed Government Plan 2023-2026' (P.97/2022), as amended, commenced consideration of an amendment of the Connétable of St. Helier (P.97/2022 Amd.(24)) and, adopting an amendment of the Council of Ministers (P.97/2022 Amd.(24)Amd.), agreed that, after the words ", except that in Summary Table 5(ii)", the remaining words should be replaced with the words –

"the 2023 Head of Expenditure for Infrastructure Rolling Vote and Regeneration including St. Helier will include preparatory work for St Helier urban renewal work including Havre des Pas, with additional funding of £300,000 in 2024 and £350,000 in each of 2025 and 2026 to be included in future Government Plans"

THE STATES noted that, in accordance with the provisions of Standing Order 106, the Connétable of St. Clement  declared  an  interest  in  the  subject  of  the  amendment  of  the   Connétable  of  St.  Helier (P.97/2022 Amd.(24)) to the proposition of the Council of Ministers, in that he had a business interest in the Runnymede Court Hotel.

THE STATES resumed consideration of the proposition of the Council of Ministers, as amended, and rejected an amendment of Deputy Samuel Yves Mézec of St. Helier South (P.97/2022 Amd.(23)) that, after paragraph (h), there should be inserted a new paragraph (i) –

"(i) to agree that the Upper Earnings Limit, as defined within the Social Security (Jersey) Law

1974,  should  be  removed,  abolishing  the  upper  earnings  limit  cap  on  Social  Security Contributions and on Long Term Care Contributions, increasing the estimated closing balance of the relevant Funds by £7 million and £6.5 million respectively by the end of 2023;"

and that the existing paragraph (i) should be re-designated as paragraph (j).

THE STATES noted that, in accordance with the provisions of Standing Order 106, both Deputy Stephen George Luce of Grouville and St. Martin and Deputy Kristina Louise Moore of St. Mary , St. Ouen and St. Peter declared an interest in the subject of the amendment of Deputy Samuel Yves Mézec of St. Helier South (P.97/2022 Amd.(23)) to the proposition of the Council of Ministers, in that they (or a person relevant to them) would be directly impacted by the amendment, if adopted, and, as the interest was a financial interest that was personal to them or a relevant person, they both withdrew from the Chamber for the duration of the debate and vote on the amendment.

THE STATES, adopting a proposition of the Chair of the Privileges and Procedures Committee, agreed the Assembly would meet at 9.00 a.m. on Friday 16th December 2022.

THE STATES noted that, following the rejection of the amendment of Deputy Raluca Stefana Kovacs of St. Saviour (P.97/2022 Amd.(2)Amd.) to the amendment of Deputy Max Brennan Andrews of St. Helier North (P.97/2022 Amd.(2)) to the proposition of the Council of Ministers entitled Proposed Government Plan 2023-2026' (P.97/2022), the amendment of Deputy Raluca Stefana Kovacs of St. Saviour (P.97/2022 Amd.(3)) to the same proposition was deemed to have been withdrawn.

Proposed Government Plan 2023-2026 P.97/2022

THE STATES, resuming consideration of the proposition of the Council of Ministers entitled Proposed Government Plan 2023-2026' (P.97/2022), as amended, commenced consideration of an amendment of Deputy Max Brennan Andrews of St. Helier North (P.97/2022 Amd.(8)) and, adopting an amendment of Deputy Max Brennan Andrews of St. Helier North (P.97/2022 Amd.(8)Amd.), agreed that, for the words "rate bands by one-third in addition to a 0.5 percent increase to the existing proportioned charges" there should be substituted the words "by 50 pence on each £100 payable".

THE STATES rejected the amendment of Deputy Max Brennan Andrews of St. Helier North, as amended, that, in paragraph (i), re-designated as paragraph (j), after the words "Appendix 3 to the Report" there should be inserted the words –

", except that on page 33 of Appendix 3, after the words "relatively short period of time." there should be inserted a new section as follows –

"Stamp Duty on immovable property

Stamp Duty is made payable on immovable property upon the discharge of a will in line with Item 46 of Schedule 1 (3) of the Stamp Duty and Fees (Jersey) Law 1998, made payable on the net value of immovable property at the time of death of the Testator. The current proportioned Stamp Duty rates on immovable property range from £250 to £429,500 on market value bands ranging from £50,000 to £6,000,000. In appraising the current Stamp Duty rate against market values on immovable properties it has been proposed that the Stamp Duty rates remain disproportionately low to immovable property market values.

To ensure the broadening of revenue raising streams, Stamp Duty on immovable property upon the discharge of a will shall be increased, no later than 1st January 2024, by raising the Stamp Duty by 50 pence on each £100 payable.".

THE STATES, resuming consideration of the proposition of the Council of Ministers, as amended, commenced consideration of an amendment of Deputy Stephen George Luce of Grouville and St. Martin (P.97/2022 Amd.(13)) and, adopting an amendment of the Council of Ministers (P.97/2022 Amd.(13)Amd.), agreed that, for the paragraph that began "From 1st January 2024" there should be substituted the words "As part of the 2024 Budget, which will be delivered in 2023 and focus on innovation and enterprise, Ministers will consider a range of measures to encourage and stimulate investment, including the case for increasing the rate for capital allowances available to businesses that make qualifying capital purchases."

"Enhanced capital allowances

Currently businesses are able, under part 12A of the Income tax (Jersey) Law 1961, to claim capital allowances on qualifying capital expenditure to offset against allowable profits at a rate set at 25% per annum on a reducing balance basis.

As part of the 2024 Budget, which will be delivered in 2023 and focus on innovation and enterprise, Ministers will consider a range of measures to encourage and stimulate investment, including the case for increasing the rate for capital allowances available to businesses that make qualifying capital purchases.".

", except that, on page 37, the words "The wider scheme, which was noted in the mini-budget replaces and improves the commitment made by the Assembly in P.66/2022", should be substituted with the following words, "The Assembly's decision made to exempt all menstrual sanitary products from GST will however be  respected  unless  a  specific  proposition rescinding that decision is brought forward and adopted by the Assembly".

THE STATES resumed consideration of the proposition of the Council of Ministers, as amended, and rejected an amendment of the Connétable of St. Helier (P.97/2022 Amd.(5)) that, in paragraph (i), re- designated as paragraph (j), after the words "Appendix 3 to the Report" there should be inserted the words ", except that in Table 21 on page 54 –

  1. there should be inserted a new line for an additional feasibility project entitled " St. Helier Country Park" and the figure of £100,000 inserted in the column for the 2023 estimate in the line; and
  2. in the line for "Emerging Projects" the figure in the column for 2023 should be reduced by £100,000".

Changes in Presidency

The Bailiff retired from the Chamber during consideration of the amendment of Deputy Samuel Yves Mézec of St. Helier South (P.97/2022 Amd.(19)) to the proposition of the Council of Ministers entitled Proposed Government Plan 2023-2026' (P.97/2022) and the meeting continued under the Presidency of Mr. William John Charles Millow , Deputy Greffier of the States. The Bailiff returned to the Chamber during consideration of the same amendment and meeting continued under his Presidency.

Arrangement of public business for the present meeting

THE STATES noted that, in accordance with Standing Order 34(1), the Connétable of St. Helier had informed the Greffier of the States that his amendment (P.97/2022 Amd.(7)) to the proposition of the Council of Ministers entitled Proposed Government Plan 2023-2026' (P.97/2022) had been withdrawn.

THE STATES resumed consideration of the proposition of the Council of Ministers entitled Proposed Government Plan 2023-2026' (P.97/2022), as amended, and, commencing consideration of an amendment of the Council of Ministers (P.97/2022 Amd.(21)), commenced consideration of an amendment of Deputy Thomas Antony Coles of St. Helier South (P.97/2022 Amd.(21)Amd.).

THE STATES noted that, in accordance with the provisions of Standing Order 106, Deputy Samuel Yves Mézec of St. Helier South declared an interest in the subject of the amendment of Deputy Thomas Antony Coles of St. Helier South (P.97/2022 Amd.(21)Amd.) to the amendment of the Council of Ministers (P.97/2022 Amd.(21)) to the proposition of the Council of Ministers, in that he was the tenant of a property adjacent to the Play.com site.

THE STATES adjourned, having agreed to reconvene on Friday 16th December 2022 to continue consideration of the proposition of the Council of Ministers entitled Proposed Government Plan 2023- 2026' (P.97/2022), as amended, and the other outstanding propositions listed for the meeting.
