THE STATES, with reference to their Act dated 14th September 2021, in which they had agreed that, notwithstanding Standing Order 55A(1), members who did not wish to attend in the States Chamber might continue to take part in States meetings using Microsoft Teams (until the States had considered and voted upon a proposition to re-apply Standing Order 55A(1) or to repeal or vary the terms of the Standing Order), assembled in accordance with Standing Order 55A with members able to participate remotely using Microsoft Teams.

States Meetings – Remote participation and Proxy voting P.63/2022

THE STATES resumed consideration of a proposition of Deputy Inna Gardiner of St. Helier entitled States Meetings – Remote participation and Proxy voting' (P.63/2022) and, adopting paragraph (a), agreed that, at any time when remote participation in States meetings was permitted generally, members should be able to participate remotely from outside Jersey in the event that unforeseen circumstances prevented their participation from in the Island, with the circumstances permitting such participation to be determined in accordance with guidance issued by the Bailiff .

Greffier of the States: Consent to Appointment P.72/2022

THE STATES commenced consideration of a proposition of the Privileges and Procedures Committee entitled Greffier of the States: Consent to Appointment' (P.72/2022). The Bailiff , in accordance with Article 41(12) of the States of Jersey Law 2005 and the provisions of Standing Order 82, ordered all strangers to withdraw from the precincts of the States and the doors of the Chamber to be closed.

THE STATES, having concluded the debate  in camera, proceeded to vote in public assembly and, adopting the proposition of the Privileges and Procedures Committee, consented, in accordance with the provision of Article 41(3) of the States of Jersey Law 2005, to the appointment of Mrs. Lisa-Marie Hart to the office of Greffier of the States in replacement of the present officeholder, Dr. Mark Egan.

Amendments to Standing Orders – Machinery of Government Sub-Committee (P.64/2022)

THE STATES commenced consideration of a proposition of Senator Tracey Anne Vallois entitled Amendment to Standing Orders Machinery of Government Sub-Committee' (P.64/2022) and, adopting an amendment of the Council of Ministers (P.64/2022 Amd.), agreed that, in the proposed amendment to the Standing Orders of the States of Jersey, after the words "the Privileges and Procedures Committee", there should be inserted the words "and Council of Ministers".

THE STATES, adopting the proposition of Senator Tracey Anne Vallois, as amended, agreed an amendment to the Standing Orders of the States of Jersey with effect from 22nd June 2022.

Monitoring of Arm's Length organisations and Green and White Papers P.65/2022

THE STATES commenced consideration of a proposition of Senator Tracey Anne Vallois entitled Monitoring of Arm's Length organisations and Green and White Papers' (P.65/2022) and, adopting an amendment of the Council of Ministers (P.65/2022 Amd.), agreed that –

in Paragraph (a) –

the word "supervisory" should be deleted and, after the word "comprising", there should be inserted the words "Executive and non-Executive";

after the words "and to", for the words "request the Minister for Treasury and Resources, in consultation with the Council of Ministers," there should be substituted the words "support responsible Ministers and the Assembly in discharging their responsibilities, and to request the Council of Ministers,";

after the words "the next States Assembly by no later than", for the words "30th September 2022" there should be substituted the words "31st October 2022"; and

in Paragraph (b) –

after the words "agreed criteria for the preparation of", for the words "'green papers' (initial consultations on policy or legislative proposals) and white papers' (detailed proposals for legislation)" there should be substituted the words "initial consultations on policy or legislative proposals and detailed proposals for legislation".

THE STATES, adopting the proposition of Senator Tracey Anne Vallois, as amended, agreed –

  1. that  a  Committee  comprising  Executive  and  non-Executive  States  Members  should  be established in order to monitor the performance of Arm's Length Organisations, and to support responsible Ministers and the Assembly in discharging their responsibilities, and requested the Council of Ministers to commission officers to draw up options for this, so that a projet could be considered by the next States Assembly by no later than 31st October 2022;
  2. that clear, agreed criteria for the preparation of initial consultations on policy or legislative proposals and detailed proposals for legislation should be established, and requested the Chief Minister to commission officers to draw up proposals for this, with a view to a report being presented to the States on the outcome of the work by no later than 30th September 2022.

GST on menstrual sanitary products P.66/2022

THE STATES commenced consideration of a proposition of Senator Kristina Louise Moore entitled GST on menstrual sanitary products' (P.66/2022) and rejected an amendment of the Minister for Treasury and Resources (P.66/2022 Amd.) that –

in Paragraph (a) –

at the beginning of the paragraph the words "to agree in principle, subject to a review," should be inserted and the words ", or zero-rated for the purposes of," should be inserted after the word "from"; and

in Paragraph (b) –

at the beginning of the paragraph there should be inserted the words "if that review concludes that those products should be exempt or zero-rated"; for the words "to issue law-drafting instructions in order that" there should be substituted the words "bring forward"; and the words "may be brought forward" should be deleted.

Draft Domestic Abuse (Jersey) Law 202- P.69/2022

THE STATES, resuming consideration of the Draft Domestic Abuse (Jersey) Law 202- and, having been informed that the  relevant scrutiny panel had indicated that it did not wish to scrutinise  the  draft legislation, commenced consideration of Articles 1 to 19 and, adopting an amendment of the Minister for Home Affairs (P.69/2022 Amd.) agreed that –

in Article 9 –

for paragraph (1)(b) there should be substituted –

"(b) the person's circumstances have changed in the time since the order was issued to such an

extent that the terms of the order are no longer necessary or proportionate."; and

in Article 14 –

for paragraph (1)(b) there should be substituted –

"(b) the person's circumstances have changed in the time since the order was issued to such an

extent that the terms of the order are no longer necessary or proportionate.".

THE STATES adopted Articles 1 to 19, as amended.
