Standing Order 55A – remote participation

THE STATES, with reference to their Act dated 14th September 2021, in which they had agreed that, notwithstanding Standing Order 55A(1), members who did not wish to attend in the States Chamber might continue to take part in States meetings using Microsoft Teams (until the States had considered and voted upon a proposition to re-apply Standing Order 55A(1) or to repeal or vary the terms of the Standing Order), assembled in accordance with Standing Order 55A with members able to participate remotely using Microsoft Teams.

Authorisation of Deployment and use of energy conductive devices (Tasers') by the States of Jersey Police P.117/2021

THE STATES commenced consideration of a proposition of the Minister for Home Affairs entitled Authorisation of Deployment and use of energy conductive devices (Tasers') by the States of Jersey Police' (P.117/2021) and rejected an amendment of the Children, Education and Home Affairs Scrutiny Panel (P.117/2021 Amd.) that –

  1. after the words "the following principles" there should be inserted the words "and subject to a further trial period of 18 months dating from 1st March 2022".
  2. the existing paragraph should be designated as paragraph 1 and, after this paragraph, the following paragraphs should be inserted –

"2. to request the Minister for Home Affairs to review the impact of the use of Tasers on

policing in Jersey after 1 year of the further trial period and to report to the States on the success, or otherwise, of the trial, with the report to include data in respect of –

  1. the number of times a Taser has been used on a person under the age of 18;
  2. the number of times a Taser has been used to resolve a situation involving a person undergoing a mental health crisis or episode;
  3. a breakdown of the gender, age, and cultural and ethnic groups of the people on whom a Taser has been used; and
  4. the number of times a Taser has been deployed by a police officer who is on their own.
  1. to agree that deployment and use of Tasers in accordance with the principles outlined in the proposition should not continue beyond the further trial period of 18 months without the prior approval of the States Assembly.".

THE STATES, adopting the proposition of the Minister for Home Affairs, endorsed the decision of the Minister for Home Affairs to authorise the use and deployment of Energy Conductive Devices (Taser) by the States of Jersey Police according to the following principles:

  1. A Taser would only be issued to a uniformed police officer who had completed a Taser course (to the national standard).
  2. The use of a Taser would be at the discretion of the police officer who was carrying the Taser and would not be subject to a specific firearms authority.
  3. Usual supervision of the use of Taser would apply and the individual officer's usage would have to be justified  and compliant with all existing legislation and  associated  College of Policing Guidelines.
  4. Any use of a Taser would have, wherever practicable, to be recorded on body-worn cameras by all officers attending the situation in which use occurred, with the footage to be submitted, retained and logged alongside the use of force form from the incident.

THE STATES noted that, in accordance with the provisions of Standing Order 106, the Connétable of St. Ouen declared an interest in the subject of the proposition of the Minister for Home Affairs entitled Authorisation of Deployment and use of energy conductive devices (Tasers') by the States of Jersey Police' (P.117/2021), in that his son-in-law was a States of Jersey Police Officer.

Draft Children (Convention Rights) (Jersey) Law 202- P.19/2022

THE STATES commenced consideration of the Draft Children (Convention Rights) (Jersey) Law 202- and adopted the principles.

THE STATES, having been informed that the relevant scrutiny panel had indicated that it did not wish to scrutinise the draft legislation, adopted Articles 1 to 5.

THE STATES commenced consideration of Article 6 and, adopting the first part of an amendment of the Children, Education and Home Affairs Scrutiny Panel (P.19/2022 Amd.), agreed that –

  1. in paragraph (6) for "The Minister may, by Order," there should be substituted – "The States may, by Regulations,".
  2. paragraph (7) should be deleted and the subsequent paragraphs and cross-references re- numbered accordingly.

THE STATES, resuming consideration of Article 6, as amended, commenced consideration of an amendment of the Children, Education and Home Affairs Scrutiny Panel (P.19/2022 Amd.(2)).
