THE STATES, with reference to their Act dated 14th September 2021, in which they had agreed that, notwithstanding Standing Order 55A(1), members who did not wish to attend in the States Chamber might continue to take part in States meetings using Microsoft Teams (until the States had considered and voted upon a proposition to re-apply Standing Order 55A(1) or to repeal or vary the terms of the Standing Order), assembled in accordance with Standing Order 55A with members able to participate remotely using Microsoft Teams. Maximum Employment Probation Periods (P.103/2023).

THE STATES commenced consideration of a proposition of Deputy Max Brennan Andrews of St. Helier North entitled Maximum Employment Probation Periods' (P.103/2023) and, adopting an amendment of Deputy Max Brennan Andrews of St. Helier (P.103/2023 Amd.), agreed that paragraph (b) should be substituted with the following paragraph –

"(b) ensure that any extension in an employment probation period can only be made once and does

not result in the total probation period exceeding the maximum employment probation period set out in (a);".

THE STATES resumed consideration of the proposition of Deputy Max Brennan Andrews of St. Helier North , as amended, and rejected paragraphs (a), (b) and (d) (re-designated as paragraph (c)) of the proposition to agree that employment probation periods should be amended within the Employment (Jersey) Law 2003 to –

  1. set a maximum employment probation period of no more than 6 months;
  2. ensure that any extension in an employment probation period could only be made once and did not result in the total probation period exceeding the maximum employment probation period set out in (a); and
  3. ensure that any employee on a fixed term contract of 6 months or less would not be subject to a work probation period;

and to request the Minister for Social Security to bring forward the necessary legislative changes to implement these amendments no later than June 2025.

Remote participation to the States Assembly for the purpose of election of a Chief Minister or Minister P.3/2024

THE STATES, adopting a proposition of Deputy Mary Rose Scott of St. Brelade entitled Remote participation to the States Assembly for the purpose of election of a Chief Minister or Minister' (P.3/2024) agreed, in accordance with Standing Order 167, that the ruling of the Bailiff dated 28th September 2020 should be reviewed and that, further to the adoption of Vote of No Confidence: Chief Minister' (P.1/2024), any elected Member absent from Jersey, as a result of any travel arrangement made by that elected Member prior to the date P.1/2024 was lodged, would be permitted to participate remotely in the subsequent meetings to select a Chief Minister designate and other Ministers in the resultant new Council of Ministers.
