Misuse of Drugs (Miscellaneous Amendments) (No. 8) (Jersey) Order 2019.
This Order makes a number of amendments to the Misuse of Drugs (Jersey) Law 1978 (the "Law"), as well as to various Orders made under that Law, on the basis of recommendations of the Jersey Advisory Council on the Misuse of Drugs.
Article 1 amends the Law to add 3-fluorophenmetrazine, a stimulant that is susceptible to abuse, to the list of controlled drugs under the Law. The Article also adds gabapentin and pregabalin, drugs used to treat epilepsy that may cause harm when misused, as controlled drugs.
Article 2 amends the Misuse of Drugs (General Provisions) (Jersey) Order 2009 to add references to the three drugs mentioned above to the Order's Schedules. The Order is also amended so that trace amounts of cannabinol and cannabinol derivatives, when contained in a preparation of cannabidiol (which is not a controlled drug), are exempt from certain provisions of the Law.
Article 3 amends the Misuse of Drugs (Designation) (Jersey) Order 1989 to implement the exemption of trace amounts of cannabinol and cannabinol derivatives referred to in the previous paragraph.
Article 4 deletes the requirement in the Misuse of Drugs (Addicts) (Jersey) Order 1980 that prescribers must notify the Medical Officer of Health in certain circumstances.
Article 5 sets out the name by which this Order may be cited. It also states that the Order comes into force on the day after the day on which the Order is made, with the exception of the provisions relating to gabapentin and pregabalin. Those provisions come into force on the 30th day after the day on which the Order is made.
The Order was made on 26th June 2019 and comes into force in accordance with Article 5.
