Road Traffic (Miscellaneous Amendments – Coastguard Vehicles) (Jersey) Order 2021. Minister for Infrastructure.
This Order amends 3 Orders under the Road Traffic (Jersey) Law 1956 (the "Law") so that various requirements under that Law, including the requirement to comply with traffic lights, do not apply to vehicles used for emergency purposes by the Jersey Coastguard service. (Such vehicles are referred to in this note as "Coastguard vehicles"). The provisions are similar to those that already exist for vehicles used by ambulance, fire and rescue and police services.
Article 1 amends the Motor Vehicles (Construction and Use) (Jersey) Order 1998 so that the requirement in that Order which prohibits motor vehicles from being fitted with a bell, gong, siren or 2-tone horn does not apply to Coastguard vehicles.
Article 2 amends the Road Traffic (Lighting) (Jersey) Order 1998 so that Coastguard service vehicles are included in the definition of "emergency vehicles". The effect of the amendment is that, as an "emergency vehicle" blue flashing lights can be fitted to a Coastguard vehicle.
Article 3 amends the Traffic Signs (Jersey) Order 1968 so that, provided certain conditions in the Law are met, drivers of Coastguard vehicles are not guilty of offences under the Law for failing to comply with traffic lights and traffic signs prescribed in that Order.
Article 4 sets out the title of this Order and provides for it to come into force 7 days after the day it is made. The Order was made on 10th May 2021 and came into force on 17th May 2021.

Motor Traffic (Cabs – General) (Jersey) Order 2021. Minister for Infrastructure.
This Order repeals the Motor Traffic (Taxi-Cabs – General) (Jersey) Order 2002 ("2002 Order") and replaces it with conditions of use which remove the current distinction between private-hire cabs and taxis. There are no longer different conditions of use depending on whether the public service licence in force in respect of a vehicle restricts the use of taxi ranks (currently the case with private-hire vehicles) or allows taxi ranks to be used without restriction (currently the case with taxis). Limousines providing cab services are unaffected.
Article 1 is an interpretation provision. The Motor Traffic (Jersey) Law 1935 defines "cab" to mean "a motor vehicle providing a cab service". "Cab service" is defined in that Law as "a service that consists of the carriage by motor vehicles of passengers for hire or reward under a contract expressed or implied for the use of the vehicle as a whole at a fixed rate or for an agreed sum.". "Taxi-cabs" are defined in this Order to mean all cabs which have a public service licence that permits them to use taxi ranks. "Limousine- cabs" are defined in this Order to mean all cabs which have a public service licence that does not permit them to use taxi ranks. In this Order, "cab" means a "limousine-cab" or a "taxi-cab": there are no other categories of "cab".
Article 2 prohibits any vehicle that is not a taxi-cab from stopping, waiting, or picking up passengers at a taxi rank.
Articles 3 to 8 prohibit a taxi-cab from being used to provide a cab service unless –
• it has a sign showing that it is a taxi-cab and whether it is available for hire;
• its public service licence number is displayed;
• its fares and charges are displayed;
• it is fitted with a properly operating taxi meter for calculating fares and charges;
• it is fitted with a properly operating device for electronic payments;
a notice is displayed indicating that electronic payments may be made.
Article 9 sets out conditions of use for limousine-cabs relating to payment and signs.
Article 10 prohibits a passenger in a cab from behaving in various disorderly or distracting ways.
Article 11 sets out criminal offences for breach of the various prohibitions in this Order. The maximum penalty is a fine of level 2 on the standard scale, that is £1,000.
Article 12 is a transitional provision which is triggered by the date that the Motor Traffic (Public Service Vehicles (Conditions of Fitness)) (Amendment No. 3) (Jersey) Order 2021 ("amending Order") comes into force, that is, on 31st May 2021. The amending Order sets out "accessibility requirements" with which taxi-cabs must comply in order for a certificate of fitness to be issued. The accessibility provisions re-enact, with modifications and subject to a phasing-in period, provisions that are equivalent to Articles 26 to 30 and 31 of the Motor Traffic (Public Service Vehicles (Conditions of Fitness)) (Jersey) Order 2003 (the "2003 Order") as in force before 31st May 2021. The requirements relate to specified features, such as swivel cushions and door threshold strips.
With respect to taxis, Article 12 allows taxis to continue to use taxi ranks and pick up passengers under Article 2 of the 2002 Order until the date (the "specified date") that the taxi must meet the accessibility requirements under the 2003 Order after 31st May 2021.
If the existing licence expires on or after 1st December 2021, the specified date under the 2003 Order is the date that the existing licence expires. If the existing licence expires between 31st May 2021 and 30th November 2021 inclusive and the taxi does not comply with the accessibility requirements on the date of expiry, the specified date is 6 months after the date a new licence is granted provided that date is on or before 31st May 2022.
Once the specified date is reached and a taxi complies with the accessibility requirements, a public service licence that is granted in respect of the taxi will allow it to access taxi ranks without restriction and the need for Article 2 of the 2002 Order will fall away.
With respect to private-hire cabs that do not meet the accessibility requirements, Article 12 continues the restrictions regarding access to taxi ranks under the 2002 Order. Such restrictions continue until the date the private hire cab complies with the accessibility requirements.
Article 13 repeals the 2002 Order.
Article 14 sets out the title of this Order and provides for it to come into force on 31st May 2021. The Order was made on 10th May 2021 and came into force on 31st May 2021.

Motor Traffic (Public Service Vehicles (Conditions of Fitness)) (Amendment No. 3) (Jersey) Order 2021. Minister for Infrastructure.
This Order amends the Motor Traffic (Public Service Vehicles (Conditions of Fitness)) (Jersey) Order 2003 (the "2003 Order") so as to require all cabs, apart from limousine taxi-cabs, to be compliant with conditions so that they can be used by persons with a disability.
Article 1 is an interpretation provision enabling this Order to be construed as amending the 2003 Order.
Article 2 inserts definitions relating to different kinds of cab. The Motor Traffic (Jersey) Law 1935 defines "cab" to mean "a motor vehicle providing a cab service". "Cab service" is defined in that Law as "a service that consists of the carriage by motor vehicles of passengers for hire or reward under a contract expressed or implied for the use of the vehicle as a whole at a fixed rate or for an agreed sum.". This Order also defines a "limousine taxi-cab" to mean a motor vehicle providing a cab service which excludes picking up passengers at a taxi rank. "Taxi-cab" is defined in this Order to mean a motor vehicle providing a cab service that includes picking up passengers at a taxi rank. "Taxi rank" is also defined in this Order to mean a stand established by the Minister under the Motor Traffic (Jersey) Law 1935.
Article 3 substitutes Part 2A of the 2003 Order setting out the conditions of fitness for cabs and Article 4 inserts a new Schedule.
The requirements in the new Part 2A relate to seats, signs, markings, meters and accessibility requirements. With the exception of a requirement relating to seats, supports and maximum passenger number signs, the requirements apply to taxi-cabs but not to limousine-cabs. Part 2A also requires all taxi-cabs to comply with accessibility requirements set out in Part 1 of the new Schedule inserted by Article 4. Part 2 of the Schedule sets out requirements with which taxi-cabs must comply if the taxi-cab can accommodate at least one person seated in a wheelchair. Limousine taxi-cabs are not required to comply with the requirements in the Schedule.
The new Part 2A also includes a transitional provision. It applies to private-hire cabs and taxis within the meaning of the Motor Traffic (Taxi-Cabs – General) (Jersey) Order 2002 ("2002 Order") in respect of which (a) a public service licence ("existing licence") is in force on 30th May 2021; and (b) on 31st May 2021, the requirements of Part 1 of the Schedule are not met.
For those vehicles, the 2003 Order continues to apply as if this amending Order were not in force until the existing licence is no longer in force. However, if the existing licence expires on or before 30th November 2021 and the taxi or private-hire cab does not comply with Part 1 of the Schedule on the expiry date, one certificate of fitness may be granted as if this amending Order were not in force provided the certificate lasts for 6 months only and expires on or before 31st May 2022. Under Article 10(2) of the Motor Traffic (Jersey) Law 1935, a public service licence of a vehicle is suspended during any period when a certificate of fitness is not in force in respect of it. This means that when the 6 month certificate of fitness expires, a taxi or private-hire cab will not be able to resume providing cab services under the public service licence until the requirements of Part 1 of Schedule 1 are met and a new certificate of fitness is granted.
A further transitional provision is made in respect of taxis or private-hire cabs which, on 31st May 2021, do not meet the requirements in Part 1 of the Schedule relating to airbags when a vehicle is transporting an assistance dog or to storage space for wheelchairs and mobility scooters. Those requirements do not apply to such a vehicle until the holder of the public service licence for the vehicle submits a different vehicle for examination for use as a taxi-cab.
Article 5 sets out the title of this Order and provides for it to come into force on 31st May 2021. The Order was made on 10th May 2021 and came into force on 31st May 2021.

Immigration (Fees) (Amendment No. 6) (Jersey) Order 2021.

The Immigration (Fees) (Amendment No. 6) (Jersey) Order 2021 inserts 2 new definitions into Article 1 of the Immigration (Fees) (Jersey) Order 2017, and amends the table of fees in Article 2(2).
The Order amends Article 1 by inserting two definitions: "seasonal employment", being employment in the agriculture sector, hospitality sector or as crew on a fishing vessel; and "sector-based employment", being employment in the construction industry.
In the table of fees in Article 2, the Order amends paragraph (c) so that the current description of work permit by reference to "employment in an unskilled job" is replaced with the new reference to "seasonal employment".
New paragraph (ca) specifies the fee for a person whose work permit authorises sector-based employment for a period not exceeding one year and which may be extended.
New paragraph (cb) specifies the fee for a person whose work permit under (ca) is extended so that the total period of work exceeds one year.
New paragraph (cc) specifies the fee for a dependant of a person with a work permit that has been extended to exceed one year in total. Paragraphs (d) and (e) are amended to reflect new paragraph (cb).
The Order comes into force on the day after it is made.

Covid-19 (Workplace Restrictions) (Amendment No. 12) (Jersey) Order 2021. Minister for Health and Social Services.
This Order amends the Covid-19 (Workplace Restrictions) (Jersey) Order 2020 to widen the purposes for which food and drink premises may be open. In the case of food and drink premises that are part of wider premises that include an auditorium or a stadium, the premises may be open for the purpose of selling food or drink (other than alcoholic drinks) to customers for consumption in the auditorium or stadium. Otherwise the food or drink must be sold to be taken outside the wider premises or to be consumed at a table in the premises.
The Order was made on 17th May 2021 and came into force on 18th May 2021.

Mental Health (Miscellaneous Provisions and Prescribed Forms) (Amendment No. 2) (Jersey) Order 2021. Minister for Health and Social Services.
This Order amends Article 3 of the Mental Health (Miscellaneous Provisions and Prescribed Forms) (Jersey) Order 2018. The Order allows the Minister for Health and Social Services to attach a condition to the approval of the appointment of a registered medical practitioner ("doctor") as an approved practitioner under the Mental Health (Jersey) Law 2016 to limit it to appointment as a medical member of the Mental Health Review Tribunal, provided a certain requirement is fulfilled. Currently the requirement is that the doctor has such degree of experience or training in mental health matters as would reasonably be expected to provide him or her with enough understanding of the medical issues likely to arise before the Mental Health Review Tribunal to be an effective medical member. In future the doctor must also have completed the Mental Health (Jersey) Law 2016 Approved Practitioner Training Programme.
The Order was made on 25th May 2021 and came into force on 1st June 2021.

Road Traffic ( St. Peter ) (Amendment No. 11) (Jersey) Order 2021. Minister for Infrastructure.
This Order amends the Road Traffic ( St. Peter ) (Jersey) Order 1992 with the effect of prohibiting the parking of vehicles in parts of Le Vieux Beaumont and restricting the parking of vehicles in a section of that road to a maximum of 12 hours in a period of 24 hours.
This Order comes into force 7 days after the day it is made.
The Order was made on 28th May 2021 and came into force on 4th June 2021.

Emergency Powers and Planning (Medicines and Vaccines – Covid-19) (Third Period) (Jersey) Order 2021.

This Order is a renewal of the Emergency Powers and Planning (Medicines and Vaccines – Covid-19) (Jersey) Order 2021 which relaxes controls on medicines to facilitate a plan for vaccination against Covid-19, which in turn was a renewal of the Emergency Powers and Planning (Medicines and Vaccines – Covid-19 and Influenza) (Jersey) Order 2020.
The Order expires 3 months after it comes into force (under the Emergency Powers and Planning (Jersey) Law 1990 it cannot remain in force for longer unless renewed). This Order comes into force on 5th June 2021 and will therefore expire at the end of 4th September 2021.

"Given the response to Written Question 464/2019 referenced the commitment in the Government Plan for 2020 to the "development of a model of dental services for children with a preventative focus", will the Minster –
- advise what progress, if any, has been made on this model;
- state whether he intends to implement the ten short and long-term options outlined in the Review of Dental Health Services and Benefits (R.91/2015); and, if not, why not; and
- request confirmation from the Minister for Social Security as to how many families have been participating in the Jersey Dental Fitness Scheme over the five years since the publication of that review?"

"Following the adoption of Bus Service Contract – Hoppa' (P.156/2011) by the States Assembly, and the subsequent May 2021 debate on the pedestrianisation of Broad Street, will the Minister state –
- the projected timescale for the introduction of the St. Helier Hoppa Bus', including the anticipated start date of the service;
- the planned route this service will take;

"Will the Minister state –
- how the decision for implementation of the green light status' travel scheme was reached, and which body was responsible for confirming this decision;
- the Ministers that were responsible for the implementation of this scheme;
- which Ministers, if any, voted against this scheme at the agreement stage;
- the reasons why this scheme falls under the remit of the Minister for Economic Development, Tourism, Sport and Culture rather than the Minister for Health and Social Services;

"Further to the response to Written Question 6862 on 15th May 2012, when the Chief Minister of the time indicated his satisfaction that the use of zero-hours contracts by departments was regularly reviewed to ensure appropriate use, will the Chief Minister advise what action is being undertaken to stamp out poor practice and to ensure the appropriate use of such contracts currently to prevent staff from losing out on pension rights, holiday and sickness terms; and what ongoing monitoring of such contracts is taking place?

- why there has been a delay in registering the planning applications for the skateparks at Les Quennevais and South Hill;

In accordance with Standing Order 104A, a time limit of 15 minutes applies to speeches made during debate, unless discretion has been exercised to allow for a longer, or shorter, time limit. No time limit applies to either speech made by the proposer.
Discretion is exercised by the Presiding Officer in accordance with guidance issued by the Bailiff , following consultation with the Privileges and Procedures Committee. The current guidance was presented to the States in the report Time Limits on Speeches in Debates: Guidance on the Exercise of Discretion' (R.3/2021). The report states that discretion may be exercised to allow for a longer speech than 15 minutes where the member speaking is designated as the main respondent' to the debate.
