Social Security (Collection of Class 1 and Class 2 Contributions) (Amendment No. 2) (Jersey) Order 2022. Minister for Social Security.

This Order amends the Social Security (Collection of Class 1 and Class 2 Contributions) (Jersey) Order 2013 (the "principal Order") to amend the date on which payment of Class 1 and Class 2 contributions must be made from a date after the contribution quarter to which they relate to the 15th day of the month following the month in respect of which they are payable.

Article 1 amends the principal Order. It amends Article 1 to remove the definition of "contribution quarter", which is no longer needed, and to insert a definition of "payment due date" in relation to Class 1 and Class 2 contributions. This is the 15th day of the month following the month in respect of which they are payable.

It substitutes new paragraphs (1) to (2) into Article 5, which deals with the collection of Class 1 contributions. These replace paragraphs (1) to (4) and specify the payment due date and require that payment of Class 1 contributions are accompanied by the information relating to it that the Comptroller requires, in a form approved by the Comptroller.

It also substitutes a new Article 6, which deals with the collection of Class 2 contributions. This sets out the payment due date, and gives the Comptroller the power to extend it by up to 2 months in any particular case or type of case. Payment of Class 2 contributions are to be accompanied by the information relating to it that the Comptroller requires, in a form approved by the Comptroller.

Article 2 makes a consequential amendment to the Social Security (Contributions) (Covid19) (Jersey) Order 2020.

Article 3 provides the name by which the Order may be known and that it comes into force on 1st October 2022.

The Order was made on 31st March 2022 and comes into force on 1st October 2022

Sanctions and Asset-Freezing (Implementation of External Sanctions) (Russia – Amendment No. 4) (Jersey) Order 2022.

Minister for External Relations and Financial Services.

This Order amends the Sanctions and Asset-Freezing (Implementation of External Sanctions) (Jersey) Order 2021, to implement a further change in UK sanctions in relation to Russia which is made by the Russia (Sanctions) (EU Exit) (Amendment) (No. 7) Regulations 2022 of the UK (which came into force at 5 p.m. on 30th March 2022).

This Order makes it an offence to breach a prohibition on directly or indirectly providing technical assistance, relating to an aircraft or a ship, to a person who is a designated person for the purposes of the Sanctions and Asset-Freezing (Jersey) Law 2019.

This Order comes into force immediately after the midnight following its making. The Order was made on 31st March 2022 and came into force on 1st April 2022.

This Order amends the Road Traffic ( Trinity ) (Jersey) Order 1988 so that waiting and stopping by motor vehicles is prohibited in parts of La Rue du Mont Pellier and parts of Les Ruelles.

This Order comes into force 7 days after the day it is made.

The Immigration (Fees) (Jersey) Order 2022 repeals and re-states the Immigration (Fees) (Jersey) Order 2017, and prescribes the fees payable on application for a passport.

Article 1 is an interpretation provision, which re-states Article 1 of the Immigration (Fees) (Jersey) Order 2017 except that a definition of "passport" has been added; the definition "seasonal employment" has been updated to include short-term work in the construction industry; and an expired cross-reference has been updated.

Articles 2-4 re-state the equivalent Articles in the Immigration (Fees) (Jersey) Order 2017, except that the table in Article 2 has been updated to meet modern drafting standards.

Article 5 prescribes the fees payable on application for a United Kingdom passport in Jersey. Article 6 repeals the Immigration (Fees) (Jersey) Order 2017.

Article 7 gives the citation and provides that the Order comes into force at the same time as the Immigration (Jersey) Order 2021, which comes into force on 12th April 2022.

The Order was made on 8th April 2022 and came into force on 12th April 2022.

Wildlife (Areas of Special Protection) (Jersey) Order 2022. Minister for the Environment.

The Wildlife (Areas of Special Protection) (Jersey) Order 2022 will designate 4 areas within Les Ecréhous as areas of special protection ("ASPs") and will specify certain requirements relating to those areas, certain activities that are prohibited within those areas and the penalty for committing an offence under the Order.

Article 1 contains the definitions of various terms used in the Order.

Article 2 designates the following 4 areas within Les Ecréhous as ASPs:

• The area that comprises the bird breeding area on Maîtr'Île and the area outside the bird breeding area which is within and including a boundary line which is 150m from the boundary of the bird breeding area (the "150m boundary line") (as indicated in Schedule 1);

• The area that comprises the bird breeding area on Le Blanche Île and the area outside the bird breeding area which is within and including the 150m boundary line (as indicated in Schedule 2);

• The area that comprises the bird breeding area on La Grande Brecque and the area outside the bird breeding area which is within and including the 150m boundary line (as indicated in Schedule 3);

• The area that comprises the bird breeding area on La Marmotière and the area outside the bird breeding area which is within and including the 150m boundary line (as indicated in Schedule 4).

Article 3 provides that it is an offence for a person other than an authorised person to enter a bird breeding area during the relevant breeding period for that area.

Article 4 sets out various activities that are prohibited within an ASP during the relevant breeding period for that ASP.

These activities include operating a vessel at a speed of 5 knots or more (except in cases of emergency), using or operating an unmanned aircraft unless authorised by the Minister, discharging a firearm, lighting a firework, bringing a dog on to land and playing music at a volume which may alarm or otherwise disturb a protected wild bird.

Article 5 requires an owner or occupier of premises within an ASP to inform a person that they have authorised to enter that ASP during the relevant breeding period, for the purpose of visiting, staying in or carrying out maintenance work in relation to the premises, of the requirements of the Order relating to that area. A person who operates a vessel that brings a person on to land within an ASP during the relevant breeding period for that ASP must inform the person of the requirements of the Order relating to that land.

Article 6 provides that a person who commits an offence under this Order is liable to a fine of level 3 on the standard scale.

Article 7 gives the title by which this Order may be cited and provides for it to come into force 7 days after it is made.

The Order was made on 11th April 2022 and came into force on 18th April 2022.

Financial Services Commission (Financial Penalties) |(Amendment No. 2) (Jersey) Order 2022. Minister for External Relations and Financial Services.

This Order amends the Financial Services Commission (Financial Penalties) (Jersey) Order 2015 (the "principal Order") to make changes regarding the calculation of the maximum level of penalty that may be imposed on a person by the Commission, and the persons on whom the maximum penalty may be imposed. These changes are consequential the changes made to the Financial Services Commission (Jersey) Law 1998 (the "Law") by the Financial Services Commission (Amendment No. 8) (Jersey) Law 202-.

Article 1 introduces the amendments to the principal Order.

Article 2 amends Article 1 of the principal Order to update definitions of words and expressions used throughout that Order in line with the changes introduced by this Order.

Article 3 deletes Article 2 of the principal Order as references to the meaning and calculation of relevant income are no longer required.

Article 4 amends Article 3 of the principal Order so that the level of penalties that the Commission may impose for contraventions by principal persons would also apply to contraventions by key persons or persons perform or performed a senior management function.

Article 5 amends the Schedule so that the maximum level of penalty that may be imposed on a person would be a percentage of the average annual turnover. The expression "average annual turnover" in respect of a registered person is now defined in Article 1(1) of the principal Order as the average of the annual turnover derived from all the business activities of the registered person carried on in or from within Jersey for the 5 financial years, or for the period of existence of the registered person, prior to the issuance of a final notice by the Commission under Article 21C of the Law.

Article 6 provides that where a notice of intent was issued and served under Article 21C of the Financial Services Commission (Jersey) Law 1998, any amount of the penalty required to be paid in a final notice issued under that Article is calculated on the basis of that Law and the Financial Services Commission (Financial Penalties) (Jersey) Order 2015as they were in force at the time of the issuance of the notice of intent.

Article 7 gives the name by which this Order may be cited as the Financial Services Commission (Financial Penalties) (Amendment No. 2) (Jersey) Order 2022 and provides for it to come into force on the same day as the Financial Services Commission (Amendment No. 8) (Jersey) Law 202- comes into force.

The Order was made on 19th April 2022 and comes into force on the same day as the Financial Services Commission (Amendment No. 8) (Jersey) Law 202- comes into force.

Sanctions and Asset-Freezing (Implementation of External Sanctions) (Russia – Amendment No. 5) (Jersey) Order 2022.

Minister for External Relations and Financial Services.

This Order amends the Sanctions and Asset-Freezing (Implementation of External Sanctions) (Jersey) Order 2021, in relation to further changes in UK sanctions on Russia which were made by the Russia (Sanctions) (EU Exit) (Amendment) (No. 8) Regulations 2022 (S.I. 2022/452 of the UK). Those Regulations came into force at 5 p.m. on 14th April 2022 and had immediate effect in Jersey subject to modifications, except where they created fresh offences.

This Order extends the existing Jersey offence (carrying imprisonment for up to 7 years and an unlimited fine) of breaching implemented sanctions provisions, so that it applies to breaches of the new prohibitions related to directly or indirectly supplying (or delivering or making available) luxury goods or acquiring (or supplying or delivering) iron and steel products.

This Order comes into force immediately after the midnight following its making. The Order was made on 19th April 2022 and came into force on 20th April 2022.

1. what due diligence has been undertaken to ensure that the independent expert working on improvements to Greenfields (who is the Deputy CEO of the Independent Children's Home Association, who have described themselves as a politics lobbying organisation for the private residential care sector), has no conflicts of interest;
2. whether the use of Greenfields is significantly higher than that of comparable facilities in the UK and if so, will the Minister explain why this is the case; and
3. how many times the Police have been called to assist at Greenfields in the last four months?"

10. The Minister for Children and Education tabled an answer on 11th April 2022 to the following question asked by the Connétable of St. John :

"In relation to Children's Services, will the Minister advise –

1. Whether the service has used unregulated children's homes in the past 2 years, despite assurances that this would not happen and indicate how many times this has occurred during that period–
2. what is the staff turnover in residential care;
3. of those leaving, how many staff had exit interviews; and,
4. what improvements, if any, have been made from any lessons learned."

11. The Minister for Social Security tabled an answer on 11th April 2022 to the following question asked by Deputy G.P. Southern of St. Helier :

"Given that in her statement to the Assembly on support for those impacted by rising costs the Minister said that "as Minister, my focus is on supporting those who are most in need of help"; will she advise –

1. whether she accepts that those who are most in need are those who cannot work and who are totally reliant on Income Support;
2. if she accepts (a), does she agree that the figures given in her response to WQ.54/2021 show that a single person reliant on adult and household components is £11.70 per week worse off due to the fact that Income Support components are not fully indexed;
3. whether she considers the award of £20 per month is inadequate to deal with inflation and if not, why not; and
4. if she accepts that the absence of full indexation can only increase income inequality rather that reducing it?"

12. The Minister for Economic Development, Tourism, Sport and Culture tabled an answer on 11th April 2022 to the following question asked by Deputy G.P. Southern of St. Helier :

"Will the Minister advise what tangible proposals he has under consideration to ameliorate the impact of the spike in inflation in the U.K on our own economy, and does he have estimates for the extent and duration of such inflationary pressures?"

13. The Chair of the Privileges and Procedures Committee tabled an answer on 11th April 2022 to the following question asked by Deputy S.M. Wickenden of St. Helier :
