Planning and Building (Caravans) (Jersey) Order 2023. Minister for the Environment.
The Planning and Building (Caravans) (Jersey) Order 2023 makes provision, for the purposes of Article 99 of the Planning and Building (Jersey) Law 2002 (the "Law"), for the regulation and restriction of –
- the importation of caravans into Jersey; and
- the stationing and use of caravans in Jersey.
Article 1 contains the definitions of certain words and expressions that are used throughout the Order, including a definition of "motorhome" as a type of caravan as defined in Article 98 of the Law.
Article 2 sets out that this Order is for the purposes of Article 99 of the Law, which prohibits the importation or use of a caravan except in accordance with permission granted by an Order made under that Article.
Article 3 allows a person to import a caravan into Jersey, or use or station a caravan in Jersey, to the extent permitted by Articles 4 or 5; in other circumstances an application must be made to the Chief Officer for permission to do so.
Article 4 gives general permission for a person to bring a caravan to Jersey, without the need for a permit, for a period of up to 31 days. This general permission only applies if certain other conditions are met in relation to the dimensions of the caravan, where it is stationed and its use on public roads.
Articles 5 to 12 apply if a person wishes to keep a caravan in Jersey for a period of more than 31 days.
Article 5 gives general permission for a person to keep a caravan in Jersey for a period of more than 31 days if certain conditions are met. These conditions include the caravan being registered under the Motor Vehicle Registration (Jersey) Law 1993. The caravan must also be stationed out of public view at the address at which it is registered unless it is stationed on a designated camp site or being moved from one location to another. The caravan must not be used as overnight accommodation at any time unless it is stationed on a designated camp site.
Articles 6 to 8 make provision for –
- the publication by the Chief Officer of notices of applications for permission to import, use or station a caravan (otherwise than in accordance with Article 4 or 5);
- the display of site notices on land to which an application for permission relates; and
- the making of written representations by any person in relation to applications for planning permission, and the treatment of representations in a public inquiry.
These Articles provide that the Chief Officer must send to the applicant a site notice and that the applicant must certify that the site notice has been correctly displayed. The Chief Officer must provide appropriate forms for these purposes. (The Order does not prescribe the forms to be used since it is no longer standard drafting practice to prescribe forms in legislation.)
Article 9 sets out the factors that the Chief Officer must consider when determining an application for permission to import, use or station a caravan, which include environmental considerations. This Article enables the Chief Officer to either grant permission unconditionally, grant permission subject to conditions, or refuse to grant the permission sought.
Article 10 states that, for the purposes of Article 101 of the Law, any condition attached to a grant of permission under Article 9 must be fair and reasonable in relation to the proposed use or stationing of the caravan; these may include conditions relating to fire safety and sanitary facilities.
Article 11 provides that the Chief Officer may grant permission to station a caravan on land where the caravan has already been stationed without permission or where a condition imposed has not been complied with. This permission can be backdated to the date on which the caravan was first stationed on the land.
Article 12 provides that the Chief Officer may revoke or modify permission that has been given under this Order, by giving at least 7 days' written notice to the person having the control of or an interest in the caravan to which the permission relates. Specified provisions of the Law relating to compensation and appeals are applicable in this case.
Article 13 gives the title of the Order and provides for it to come into force 7 days after it is made. The Order was made on 24th May 2023 and came into force on 31st May 2023.

The Planning and Building (Application Publication) (Jersey) Order 2023 makes updated provision for –
- the publication by the Chief Officer of notices of applications for planning permission;
- the display of site notices on land to which an application for planning permission relates; and
- the making of written representations by any person in relation to applications for planning permission, and the treatment of representations in a public inquiry.
The Order provides that the Chief Officer must send to the applicant a site notice and that the applicant must certify that the site notice has been correctly displayed. The Chief Officer must provide appropriate forms for these purposes. (The Order does not prescribe specific forms to be used since it is no longer standard drafting practice to prescribe forms in legislation.)
The Order also repeals the Planning and Building (Application Publication) (Jersey) Order 2006 and makes a consequential amendment to the Planning and Building (Public Inquiries) (Jersey) Order 2008.
The Order comes into force 7 days after it is made.
The Order was made on 24th May 2023 and came into force on 31st May 2023.

Planning and Building (Moveable Structures – Amendment No. 2) (Jersey) Order 2023. Minister for the Environment.
This Order amends the Planning and Building (Moveable Structures) (Jersey) Order 2006 to align the requirements in that Order with the requirements in the Planning and Building (Application Publication) (Jersey) Order 2023 in relation to –
- the publication by the Chief Officer of notices of applications concerning moveable structures;

- the making of written representations by any person in relation to applications concerning moveable structures.

The Chief Officer must provide appropriate forms for these purposes but Schedules 2 and 3 (which prescribe specific forms) are deleted since it is no longer standard drafting practice to prescribe forms in legislation.
The Order comes into force 7 days after it is made.

Planning and Building (Display of Advertisements – Amendment No. 2) (Jersey) Order 2023. Minister for the Environment.
This Order amends the Planning and Building (Display of Advertisements) (Jersey) Order 2006 to align the requirements in that Order with the requirements in the Planning and Building (Application Publication) (Jersey) Order 2023 in relation to –
- the publication by the Chief Officer of notices of applications to display advertisements;
- the display of site notices on land or a building to which an application to display an advertisement relates; and
- the making of written representations by any person in relation to applications to display advertisements, and the treatment of any representations in a public inquiry.
The Order provides that the Chief Officer must send to the applicant a site notice and that the applicant must certify that the site notice has been correctly displayed. The Chief Officer must provide appropriate forms for these purposes but Schedules 2 and 3 (which prescribe specific forms) are deleted since it is no longer standard drafting practice to prescribe forms in legislation.
The Order also creates a new category of approved advertisement for the purpose of indicating –
- that a car park or parking place is allocated for use by particular people, or classes of people, or for the parking of particular vehicles or classes of vehicles, on land that the landowner permits to be used for that purpose; or
- that land is private land.
The Order comes into force 7 days after it is made.
The Order was made on 24th May 2023 and came into force on 31st May 2023.

Sanctions and Asset-Freezing (Automatic Implementation of UK Sanctions on Belarus) (Jersey) Order 2023. Minister for External Relations.
This Order amends the Sanctions and Asset-Freezing (Implementation of External Sanctions) (Jersey) Order 2021 (the "Sanctions Order") to provide for automatic implementation of certain future amendments to the UK's Republic of Belarus (Sanctions) (EU Exit) Regulations 2019 (S.I. No. 2019/600, as amended, the "UK Belarus Regulations").
The effect of the amendments is that if in future the UK amends the UK Belarus Regulations to add a new prohibition or obligation, breach of which is a criminal offence in the UK, then the existing Jersey offence of breaching implemented sanctions provisions (carrying imprisonment for up to 7 years and an unlimited fine) will apply automatically to a breach of that new prohibition or obligation in Jersey. There will be no need for the Sanctions Order to be amended again to update column 5 of the table in its Schedule 1 to implement new UK prohibitions and obligations in relation to Belarus, because that column will no longer list specific regulations from the UK Belarus Regulations. But the Minister retains the power to modify or disapply a particular prohibition or obligation by amending the Sanctions Order.
The Order comes into force the day after the day on which it is made.
The Order was made on 9th June 2023 and came into force on 10th June 2023.

- state the total number of Roll-on/Roll-Off (RoRo) and Lift-on/Lift-Off (LoLo) shipping arrivals from the UK that operated more than three hours later than scheduled in the last 12 months;

- the dates on which she became aware of the Inspection Reports (or any of the expected content thereof) on the three Unregistered Children's Homes published by the Jersey Care Commission and dated 13th January 2023 and 17th February 2023; and
- what specific actions, if any, she is either undertaking or supporting to ensure that the following cultural problems within Government, that were identified in the Independent Jersey Care Inquiry Report, are being transparently addressed within the Children, Young People, Education and Skills Department, namely –
