Planning and Building (Caravans) (Jersey) Order 2023. Minister for the Environment.

The Planning and Building (Caravans) (Jersey) Order 2023 makes provision, for the purposes of Article 99 of the Planning and Building (Jersey) Law 2002 (the "Law"), for the regulation and restriction of –

1. the importation of caravans into Jersey; and
2. the stationing and use of caravans in Jersey.

Article 1 contains the definitions of certain words and expressions that are used throughout the Order, including a definition of "motorhome" as a type of caravan as defined in Article 98 of the Law.

Article 2 sets out that this Order is for the purposes of Article 99 of the Law, which prohibits the importation or use of a caravan except in accordance with permission granted by an Order made under that Article.

Article 3 allows a person to import a caravan into Jersey, or use or station a caravan in Jersey, to the extent permitted by Articles 4 or 5; in other circumstances an application must be made to the Chief Officer for permission to do so.

Article 4 gives general permission for a person to bring a caravan to Jersey, without the need for a permit, for a period of up to 31 days. This general permission only applies if certain other conditions are met in relation to the dimensions of the caravan, where it is stationed and its use on public roads.

Articles 5 to 12 apply if a person wishes to keep a caravan in Jersey for a period of more than 31 days.

Article 5 gives general permission for a person to keep a caravan in Jersey for a period of more than 31 days if certain conditions are met. These conditions include the caravan being registered under the Motor Vehicle Registration (Jersey) Law 1993. The caravan must also be stationed out of public view at the address at which it is registered unless it is stationed on a designated camp site or being moved from one location to another. The caravan must not be used as overnight accommodation at any time unless it is stationed on a designated camp site.

Articles 6 to 8 make provision for –

1. the publication by the Chief Officer of notices of applications for permission to import, use or station a caravan (otherwise than in accordance with Article 4 or 5);
2. the display of site notices on land to which an application for permission relates; and
3. the making of written representations by any person in relation to applications for planning permission, and the treatment of representations in a public inquiry.

These Articles provide that the Chief Officer must send to the applicant a site notice and that the applicant must certify that the site notice has been correctly displayed. The Chief Officer must provide appropriate forms for these purposes. (The Order does not prescribe the forms to be used since it is no longer standard drafting practice to prescribe forms in legislation.)

Article 9 sets out the factors that the Chief Officer must consider when determining an application for permission to import, use or station a caravan, which include environmental considerations. This Article enables the Chief Officer to either grant permission unconditionally, grant permission subject to conditions, or refuse to grant the permission sought.

Article 10 states that, for the purposes of Article 101 of the Law, any condition attached to a grant of permission under Article 9 must be fair and reasonable in relation to the proposed use or stationing of the caravan; these may include conditions relating to fire safety and sanitary facilities.

Article 11 provides that the Chief Officer may grant permission to station a caravan on land where the caravan has already been stationed without permission or where a condition imposed has not been complied with. This permission can be backdated to the date on which the caravan was first stationed on the land.

Article 12 provides that the Chief Officer may revoke or modify permission that has been given under this Order, by giving at least 7 days' written notice to the person having the control of or an interest in the caravan to which the permission relates. Specified provisions of the Law relating to compensation and appeals are applicable in this case.

Article 13 gives the title of the Order and provides for it to come into force 7 days after it is made. The Order was made on 24th May 2023 and came into force on 31st May 2023.

The Planning and Building (Application Publication) (Jersey) Order 2023 makes updated provision for –

1. the publication by the Chief Officer of notices of applications for planning permission;
2. the display of site notices on land to which an application for planning permission relates; and
3. the making of written representations by any person in relation to applications for planning permission, and the treatment of representations in a public inquiry.

The Order provides that the Chief Officer must send to the applicant a site notice and that the applicant must certify that the site notice has been correctly displayed. The Chief Officer must provide appropriate forms for these purposes. (The Order does not prescribe specific forms to be used since it is no longer standard drafting practice to prescribe forms in legislation.)

The Order also repeals the Planning and Building (Application Publication) (Jersey) Order 2006 and makes a consequential amendment to the Planning and Building (Public Inquiries) (Jersey) Order 2008.

The Order comes into force 7 days after it is made.

The Order was made on 24th May 2023 and came into force on 31st May 2023.

The Order provides that the Chief Officer must send to the applicant a site notice and that the applicant must certify that the site notice has been correctly displayed. The Chief Officer must provide appropriate forms for these purposes but Schedules 2 and 3 (which prescribe specific forms) are deleted since it is no longer standard drafting practice to prescribe forms in legislation.

The Order also creates a new category of approved advertisement for the purpose of indicating –

1. that a car park or parking place is allocated for use by particular people, or classes of people, or for the parking of particular vehicles or classes of vehicles, on land that the landowner permits to be used for that purpose; or
2. that land is private land.

The Order comes into force 7 days after it is made.

The Order was made on 24th May 2023 and came into force on 31st May 2023.

Sanctions and Asset-Freezing (Automatic Implementation of UK Sanctions on Belarus) (Jersey) Order 2023. Minister for External Relations.

This Order amends the Sanctions and Asset-Freezing (Implementation of External Sanctions) (Jersey) Order 2021 (the "Sanctions Order") to provide for automatic implementation of certain future amendments to the UK's Republic of Belarus (Sanctions) (EU Exit) Regulations 2019 (S.I. No. 2019/600, as amended, the "UK Belarus Regulations").

The effect of the amendments is that if in future the UK amends the UK Belarus Regulations to add a new prohibition or obligation, breach of which is a criminal offence in the UK, then the existing Jersey offence of breaching implemented sanctions provisions (carrying imprisonment for up to 7 years and an unlimited fine) will apply automatically to a breach of that new prohibition or obligation in Jersey. There will be no need for the Sanctions Order to be amended again to update column 5 of the table in its Schedule 1 to implement new UK prohibitions and obligations in relation to Belarus, because that column will no longer list specific regulations from the UK Belarus Regulations. But the Minister retains the power to modify or disapply a particular prohibition or obligation by amending the Sanctions Order.

The Order comes into force the day after the day on which it is made.

The Order was made on 9th June 2023 and came into force on 10th June 2023.

"Will the Minister advise -

1. whether Housing Policy HD56 is still the current policy for managing under occupancy and, if it is, how many occupancy reviews have been sent to tenants who occupy family size accommodation in each of the last five years;
2. if HD56 is not still a current policy, what has replaced it and how is the replacement being monitored and utilised;
3. how many tenants have reported under occupancy to the Affordable Housing Gateway; and
4. how many tenants have subsequently been re-housed as a consequence of under-occupancy?"

21. The Minister for Economic Development, Tourism, Sport and Culture tabled an answer on 6th June 2023 to the following question asked by Deputy R.S. Kovacs of St. Saviour –

"Further to Written Question 223/2023, will the Minister confirm that the £19,700,000 shown as a grant into the Tourism Development Fund was a transfer from the Tourism Investment Fund and already allocated, at the time of transfer, against various projects; will he further indicate whether there is any intention to activate and use this Tourism Development Fund, and if not, why not?"

22. The Minister for Health and Social Services tabled an answer on 6th June 2023 to the following question asked by Deputy R.S. Kovacs of St. Saviour –

"Will the Minister advise, in relation to the Nutritious Food Strategy 2017-2022 –

1. the number of recipients of funding from the Health Start Programme per year for each of the last five years;
2. the annual cost of the programme for each of the last five years;
3. the requirements for families to benefit from the programme; and

will she further advise when the replacement nutritious food strategy, for which work was commenced on 4th May 2023, will be in place; and whether this replacement strategy will include support for those not on Income Support?"

26. The Chief Minister tabled an answer on 12th June 2023 to the following question asked by Deputy S.G. Luce of Grouville and St. Martin :

"Given the current international situation and the increased risks to supply chains, will the Chief Minister –

1. provide the formal definition of one day's food supply in Jersey broken down per adult, child, and infant;
2. provide (based on the definition provided in answer to (a) above) the methodology and calculation that produces the total food supplies required for an assumed population of 105,000 for both 14 days and 28 days;
3. reconcile the figures provided in response to (a) and (b) with the supply of food held by retailers and wholesalers quoted in the Chief Minister's reply to Written Question 207/2023;
4. state the total volumes of fresh, frozen, and ambient food stocks held in the Island; and
5. state whether a physical inspection, or audit, of fresh, frozen, and ambient stocks has ever been undertaken in the Island?"

27. The Chief Minister tabled an answer on 12th June 2023 to the following question asked by Deputy S.G. Luce of Grouville and St. Martin :

"Will the Chief Minister –

1. state the total number of Roll-on/Roll-Off (RoRo) and Lift-on/Lift-Off (LoLo) shipping arrivals from the UK that operated more than three hours later than scheduled in the last 12 months;
2. explain whether an independent risk assessment of Jersey's maritime supply chain has been undertaken by Government in the last year, and if not, why not; and
3. advise whether the Government has, in the last year, asked retailers and wholesalers to hold increased contingency stocks of food and other essential items (liquid fuel and medical supplies, in particular) on Island as at other times in recent decades, and if not, why not?"

28. The Minister for Treasury and Resources tabled an answer on 12th June 2023 to the following question asked by Deputy S.Y. Mézec of St. Helier South :

"For each of the years 2015 to 2021, will the Minister advise –

1. how many taxpayers were found to have under-declared their income to the Tax Department;
2. how much income in total was undeclared;
3. how much tax was liable on that total undeclared income;
4. how much of that tax liability was eventually paid; and
5. how many prosecutions were sought for undeclared income on which tax was liable?"

"Will the Minister, as shareholder representative, advise –

1. how many of the completed apartments in the Horizon development are –

1. one bedroom, below the current minimum space standards for a single-occupancy one- bedroom flat (i.e. below 34.5 square metres);
2. one bedroom, between the current minimum space standards for a single-occupancy one- bedroom flat and a double-occupancy one-bedroom flat (i.e. 34.5 square metres to 51 square metres);
3. one bedroom, above the current minimum space standards for a double-occupancy one- bedroom flat (i.e. above 51 square metres);

"Will the Minister provide details of the amount of interest tax relief that has been claimed for buy-to-let mortgages, broken down by year for the last 5 years?"

31. The Minister for the Environment tabled an answer on 12th June 2023 to the following question asked by Deputy S.G. Luce of Grouville and St. Martin :

"In relation to the Jersey Tree Detail map which the Minister produced to support his proposals for tree protection in Jersey, will he advise how the data was collected and what the total cost of the project was; and will he further advise when the map will be made available to the public?"

32. The Minister for Social Security tabled an answer on 12th June 2023 to the following question asked by Deputy G.P. Southern of St. Helier Central :

"Further to the recent announcement regarding the rise in medical benefit, will the Minister advise what measures, if any, are under consideration to index-link the subsidy paid to GPs to prevent spiralling costs in this sector; and what further discussions, if any, are being undertaken with GP representatives to plan for longer-term solutions to the cost of GP visits?"

33. The Minister for Children and Education tabled an answer on 12th June 2023 to the following question asked by Deputy R.J. Ward of St. Helier Central :

"Will the Minister state the current position of the Care Leavers' Offer in terms of –

1. the number of young people being supported;

"Will the Minister, as shareholder representative, advise –

1. what time is given for possible tenants to accept an offer of housing from Andium Homes;
2. whether rent for housing is payable on signing the tenancy agreement or on the date of moving into the home or at some other time; and
3. what provision, if any, is made for the situation in which a tenant may be paying rent on two properties during this period of time?"

35. The Minister for Economic Development, Tourism, Sport and Culture tabled an answer on 12th June 2023 to the following question asked by Deputy R.J. Ward of St. Helier Central :

"In light of comments made at a recent public hearing, at which the Minister stated that developments in the cannabis industry in Jersey have been overseen by the Economic Development Unit, and that "Jersey's reputation is pinned to the mast of high regulation and high quality", will the Minister explain what regulation exists in Jersey to control the medical use of cannabis, and how such regulation reflects the World Health Organisation (WHO) approach to the regulation of cannabis as a medicine?"

36. The Minister for the Environment tabled an answer on 12th June 2023 to the following question asked by Deputy M.R. Scott of St. Brelade :

"Will the Minister –

1. state the purpose of a character appraisal commissioned on the Minister's behalf and the role of such a character appraisal in informing the assessment of planning applications;
2. itemise the planning policies in the Bridging Island Plan and any Supplemental Planning Guidance (SPG), including any draft SPG, where a character appraisal would be relevant in informing the assessment of character of an area in Jersey, identifying in each case the applicability of those policies to both defined Built-Up Areas and areas outside the defined Built-Up Areas; and
3. explain why planning officers have not referred to the St. Brelade Character Appraisal in reports supporting the assessment of planning applications relating to sites within the scope of the St. Brelade Character Appraisal since that character appraisal was published?"

37. The Minister for Children and Education tabled an answer on 12th June 2023 to the following question asked by Deputy M.R. Scott of St. Brelade :

"Will the Minister advise –

1. the dates on which she became aware of the Inspection Reports (or any of the expected content thereof) on the three Unregistered Children's Homes published by the Jersey Care Commission and dated 13th January 2023 and 17th February 2023; and
2. what specific actions, if any, she is either undertaking or supporting to ensure that the following cultural problems within Government, that were identified in the Independent Jersey Care Inquiry Report, are being transparently addressed within the Children, Young People, Education and Skills Department, namely –

1. failures to manage conflicts of interest;
2. the lack of a culture of openness and transparency;
3. a silo mentality among public-sector agencies, States departments and institutions characterised by territorialism and protectiveness rather than openness to pooling resources and learning; and
4. that parts of the community feel that politicians and States employees cannot be trusted and that abusive practices have been covered up?"

38. The Chief Minister tabled an answer on 12th June 2023 to the following question asked by Deputy L.J. Farnham of St. Mary , St. Ouen and St. Peter :

"Will the Chief Minister explain how the Government's proposed new health facilities, as announced last week, will be more affordable than the previous plans for a single-site hospital at Overdale?"

39. The Minister for Infrastructure tabled an answer on 12th June 2023 to the following question asked by Deputy L.J. Farnham of St. Mary , St. Ouen and St. Peter :

"Following the announcement that the Government's new health facilities proposal will be approximately 30,000 m² bigger than the previous plans for a single site hospital at Overdale, is it the Minister's assessment that the capital costs of such a proposal will be significantly higher than the £804.5 million budget approved by the previous States Assembly?"

40. The Minister for Infrastructure tabled an answer on 12th June 2023 to the following question asked by Deputy L.J. Farnham of St. Mary , St. Ouen and St. Peter :

"Will the Minister advise whether any environmental impact studies have been carried out in relation to the provision of multi-site health facilities across the Island compared to the single site solution at Overdale; if so, what were the outcomes of these studies; and if none have been undertaken, why not?"

41. The Minister for Social Security tabled an answer on 12th June 2023 to the following question asked by Deputy G.P. Southern of St. Helier Central :

"Will the Minister advise to what extent, if any, the proposals outlined in Regulation 3 of the Draft Social Security (Amendment of Law No. 18) (Jersey) Regulations 202- (P. 24/2023), which would enable claimants of Short Term Incapacity Allowance to return to work while still claiming benefit, are similar to (or informed by) the restart' schemes operated by specialist agencies under guidance from the UK Department for Work and Pensions, which have reportedly been an expensive and inefficient means of getting people back into work (especially those with specialist health needs)?"

42. The Minister for the Environment tabled an answer on 12th June 2023 to the following question asked by the Connétable of St. Helier :

"Will the Minister state what Planning Obligation Agreement sums, if any, have been agreed with the developers of each of the following sites, whom any such sums were agreed by, and how the sums will be allocated –

1. the Randalls brewery site in Clare Street;
2. the Ann Street brewery site in Ann Street;
3. the Mayfair and Apollo Hotels;
4. the Play.com site (BOA warehouse); and
5. the Cyril Le Marquand House site in Union Street?"

"In light of the measurement of the  Jersey Health Account currently being undertaken by the Health Economics Unit, will the Minister advise whether the total cost of the care sector undertaken by agencies in the community, both funded and voluntary, is available?"

45. The Minister for Treasury and Resources tabled an answer on 12th June 2023 to the following question asked by Deputy L.V. Feltham of St. Helier Central :

"Will the Minister provide an update on all activities undertaken to date in relation to Point 12 of his Ministerial Plan, entitled "Establishing a Value for Money Programme", including but not be limited to –

1. whether a definition of value for money' has been agreed and if so by whom, and if not, why not;

48. The Minister for the Environment tabled an answer on 12th June 2023 to the following question asked by Deputy M.R. Scott of St. Brelade :

"Will the Minister explain –

1. the process whereby building design codes may be published by the Minister to improve the sense of place of any area; and
2. whether any planning policies or mechanisms in the Island's planning law currently support the development of neighbourhood plans as that concept is understood in UK planning law?"
