PROPOSITION

THE STATES are asked to decide whether they are of opinion

in accordance with Article 18(2) of The Law Society of Jersey Law 2005, to re-appoint Mrs. Margaret Ann Rondel as a lay member of the Disciplinary Panel of the Law Society of Jersey until the end of September 2018.

REPORT

The Law Society of Jersey Law 2005 came into force on 1st January 2007, and provides for the administration and disciplinary control of advocates and solicitors of the Royal Court.

The Law makes provision for the appointment of a Disciplinary Panel to consider and adjudicate  upon  complaints  against  members  of  the  legal  profession  who  are practitioners of the Royal Court.

In accordance with Article 18(1) of the Law, the Disciplinary Panel consists of "not less than 7 and not more than 15 fit and proper persons as lay members". Complaints against legal practitioners are submitted to the President of the Law Society and, in those cases where the President is satisfied that a complaint should be investigated, the matter will be  referred to a  Disciplinary Committee which will consist of  3 members  of the Disciplinary Panel, 2 of whom are lay members.

Article 19(1) of the Law states that a member of the Disciplinary Panel shall hold office for a term of 5 years, to be specified in the member's appointment.

The details of the current membership are set out below.

The re-appointment of the following lay members of the Disciplinary Panel for a second term of office was approved by the States on 10th July 2012 under P.50/2012

Mr. Maurice Adrian des Forges

Mr. Robin Charles Hacquoil (now deceased) Mr. Graham Edward Jennings

Mrs. Pamela Margaret Nisbet

Mr. Alfred David John Rosser.

The appointment of the following lay members of the Disciplinary Panel for a first term of office was approved by the States on 19th November 2013 under P.104/2013

Mr. Paul John Battrick, M.B.E. Mr. Ian Berry

Mrs. Annette Cullen

Mr. (Patrick) David McGrath Professor Edward Sallis, O.B.E. Mrs. Deborah Ann Thompson.

Appointment of lay member to the Disciplinary Panel

The  Chief Minister, in pursuance of Article 18(2) of The Law Society of Jersey Law 2005, is pleased to recommend to the States that Mrs. Margaret Ann Rondel be re-appointed as a lay member of the Disciplinary Panel of the Law Society of Jersey.

Mrs. Rondel  previously  served  as  a  lay  member  of  the  Disciplinary  Panel  from September 2009 to September 2014 and, other than for an administrative oversight, would have been recommended for re-appointment prior to the conclusion of her first term of office.

The  recommendation  of  this  appointment  has  been  approved  by  the  Jersey Appointments Commission, although, due to Mrs. Rondel having previously served a 5-year term of office, and including the subsequent period of administrative oversight, the Commission's approval is subject to Mrs. Rondel's term of office continuing only up to the end of September 2018.

Subject to approval by the  States Assembly,  Mrs. Rondel's term of office would commence from the date of re-appointment by the States (the date of adoption of this Proposition) and would be valid until the end of September 2018.

Mrs. Margaret Ann Rondel

Mrs. Rondel is Compliance Director at Stanhope Capital (Jersey) Limited.

She has a BSc. (Hons.) in Financial Services, a City and Guilds Unit Credit Certificate towards  Teaching  Practice  Stage  One  Further  and  Adult  Education  Teachers' Certificate, an International Diploma in Anti-Money Laundering, and an International Diploma in Compliance.

She is also an Associate Member of the Chartered Institute of Bankers, a Fellow of the International Compliance Association, and a Full Member of the Society of Trust and Estate Practitioners.

Mrs. Rondel has over 25 years of experience in the financial services sector, and has strong working relationships with the Jersey Financial Services Commission and the Joint Financial Crimes Unit. She also spent several years as a lecturer and exam-setter and moderator at Highlands College.
