PROPOSITION

THE STATES are asked to decide whether they are of opinion

in pursuance of Article 44 of the Rates (Jersey) Law 2005, to appoint –

Mr. Clive Borrowman Mr. Roger Goodwin Miss. Christine Vibert ,

and to re-appoint –

Mr. Graeme Marett Mr. Ian Ridgway Mr. Peter Routier

as members of the Rate Appeal Board, for a period of 3 years. MINISTER FOR TREASURY AND RESOURCES

REPORT

The Rate Appeal Board is established under the Rates (Jersey) Law 2005. Members are required to hear and determine appeals against rateable values in accordance with the Law.

Appointment of new members

The Minister is recommending to the States that the following individuals are appointed for a 3 year term of office –

Mr. Clive Borrowman Mr. Roger Goodwin Miss. Christine Vibert .

The recruitment process was run locally, advertised in the Jersey Evening Post, and applicants  were  invited  to  submit  their  intention  to  apply  in  writing.  A  total  of 3 candidates expressed an interest, and all 3 were shortlisted for interview. Interviews for this role were held on 10th and 21st March 2016.

All the candidates who were interviewed for the roles were of a high calibre, and brought with them relevant experience suited to the role.

Following the selection process, the Minister recommends that the following persons be appointed as Members of the Rate Appeal Board for a period of 3 years.

Mr. Clive Borrowman

Mr. Borrowman is an English solicitor. He has also been admitted as a solicitor and barrister in both Fiji and Papua New Guinea.

He started his professional career as the Assistant Solicitor to the Port of London Authority, before moving on to private practice in Auckland, New Zealand.

For the last 40 years he has concentrated on drafting legislation, with the result that he has drafted legislation for a total of 27 discrete jurisdictions.

For 13 years, Mr. Borrowman worked for the States of Jersey Law Draftsman's Office as an  Assistant Law Draftsman, drafting legislation  including –  the  Planning and Building (Jersey) Law 2002, the Public Finances (Jersey) Law 2005, the Competition (Jersey) Law 2005, the Financial Services (Jersey) Law 1998, the Financial Services (Extension) (Jersey) Law 2000, the Foundations (Jersey) Law 2009, and various other items of financial services legislation.

Mr. Borrowman has lived and worked in the United Kingdom, New Zealand, the Australian States of Victoria and Tasmania, Papua New Guinea, Norfolk Island, the Cayman Islands, the Island of St. Helena in the South Atlantic, the Island of Niue in the South Pacific, and Jersey.

He has worked as a consultant for a number of agencies, including – the United Nations, the Commonwealth Secretariat, and the British and Australian Governments.

Mr. Roger Goodwin

Mr. Goodwin is now retired, having started his professional career as a structural engineer, followed by senior roles and directorships within a number of major design, build and project management companies in the UK.

Latter roles have included participation in negotiation groups for public works contracts with UK local authorities, as well as large private sector commercial and retail projects, together with roles of an advisory nature.

Mr. Goodwin took early retirement in 2005 to take up residency in the Charente region of south-west France. He subsequently relocated to Jersey in September 2010.

Miss Christine Vibert

Miss Vibert obtained a degree in biochemistry from London University, and worked in various editorial roles in the UK and Jersey before settling into office administration.

She founded an office relocation business in Jersey in 1990, specialising in project management and office design, which oversaw the relocation of many of Jersey's finance houses and legal firms, as well as several States Departments.

Miss Vibert was a member of the States of Jersey Complaints Panel for over 9 years and, being now semi-retired, is keen to continue to serve the Island in a voluntary capacity.

Re-appointment of existing members

Under  Article 44  of  the  Rates  (Jersey)  Law  2005,  and  in  line  with  the  Jersey Appointments Commission Code of Practice for appointments to autonomous and quasi-autonomous public bodies and tribunals, the Minister is pleased to recommend the re-appointment of the following members for a further 3-year term of office –

Mr. Graeme Marett Mr. Ian Ridgway Mr. Peter Routier.

The Minister is grateful that they have put themselves forward for a further term, and would like to thank them for their service thus far.

The following members of the Board have reached the end of their appointment and, under the Jersey Appointments Commission rules, are not eligible for re-appointment –

Mr. Jethro Adams

Mr. Timothy George Cartwright Mr. Thomas Slattery.

The Minister would like to place on record his grateful thanks for their service to the Board.
