Migration and Population Review Panel Review of P.137/2020 Migration Control Policy

I write to inform you that the newly formed Migration and Population Review Panel ("the Panel") is undertaking its review of P.137/2020 - Migration Control Policy (P.137/2020) ("the Proposition").

The Panel's review is focussed on the proposed amendments to the Control of Housing and Work (Jersey) Law 2012 (the Law) and is being considered against the findings of the Migration Policy Development Board and the 2019 review of Population and Migration as undertaken by the Corporate Services Scrutiny Panel. This will serve as the first phase of a wider review by the Panel into the proposed changes to population policy in Jersey. Attached to this letter are the Terms of Reference for the review.

The Panel appreciates that both yourself and the Council of Ministers are eager to begin work on this issue, but it is vital that the proposed changes to the Law are thoroughly scrutinised with clear and detailed evidence from key stakeholders, and that relevant findings and recommendations should be provided where required. Also, Scrutiny had an extremely high workload in the last quarter of 2020 and Ministerial appointments affected the membership structure of the Panel. Therefore taking this into account, the Panel on reviewing its deadlines and engagement with key stakeholders would like to formally request that the debate on this proposition be delayed for one sitting until the 2nd March 2021, in order that the Panel can complete its review.

As part of the review, we would like to invite you to a Public Hearing and would also request that the former Chair of the Migration Policy Development Board, Deputy Judy Martin, attend this hearing as a witness.

We hope that the evidence that we gather, and the findings and recommendations of our report, will help inform the work of both your department and the Council of Ministers in developing migration policy.

Migration and Population Review Panel P.137/2020 Migration Control Policy Review - Phase 1 Terms of Reference

The Phase 1* review by the Review Panel will provide a high-level assessment of P.137/2020 - Migration Control Policy (Part C) which specifically relate to the proposed amendments to the Control of Housing and Work (Jersey) Law 2012.

The Panel will:

  1. Examine the rationale underpinning the proposed amendments to the Control of Housing and Work (Jersey) Law 2012.
  2. Assess if the proposed amendments to the Control of Housing and Work (Jersey) Law 2012 succeed in structuring migration in Jersey against clear strategic priorities.
  3. Evaluate if the proposed amendments to the Control of Housing and Work (Jersey) Law 2012 are fair and equitable.

(*Phase 1 correlates to the timeline associated with P137/2020. Subsequent phases will invariably be guided by the timeframes for Government action on the separate parts of the Proposition. This enables the Review Panel to examine the detail of each part through targeted reviews.)
