Motor Vehicle Registration (General Provisions) (Amendment No. 23) (Jersey) Order 2022. Minister for Infrastructure.

This Order amends the Motor Vehicle Registration (General Provisions) (Jersey) Order 1993 to allow the Inspector of Motor Traffic to remove a registered vehicle from the register of motor vehicles ("register") if, after making enquiries, the Inspector receives no information about whether the motor vehicle is in existence and its ownership and whereabouts.

Article 1 is an interpretation provision.

Article 2 replaces and updates existing Article 13 of the Order which makes provision for the Inspector to serve an initial notice on a person recorded in the register as the owner of a vehicle to provide the Inspector with particulars about the vehicle, including whether it still exists, has been permanently removed from Jersey or its owner has changed. The new Article 13 sets out the steps that the Inspector must take if the Inspector does not receive any of the information requested. After a period of not less than 3 months after the initial notice the Inspector must publish a notice in the Jersey Gazette of the recorded particulars of the vehicle and give notice that if the registered owner does not respond within one month, registration of the vehicle may be cancelled. If the Inspector has still not received any of the requested information 12 months after the initial notice, the Inspector may assume that the vehicle has been permanently removed from Jersey, broken up or destroyed and must cancel the registration of the vehicle unless exceptional circumstances apply.

Article 3 replaces and updates existing Article 15 of the Order which deals with amendment of the register if the Inspector thinks that particulars that are in the register may be incorrect or incomplete. The new Article 15 also provides for when the Inspector, having made some enquiries under Article 13 and initially failed to receive any of the requested information, subsequently receives some information upon making further enquiries under that Article. At that point, the Inspector may follow the steps set out in Article 15, to the extent appropriate, in determining whether to amend the register.

Article 4 replaces and updates existing Article 16 of the Order which sets out the circumstances in which the Inspector may cancel and replace a registration document. Like Article 15, the new Article provides for when the Inspector, having made an enquiry under Article 13 and failed to receive any of the requested information, subsequently receives some information upon further enquiry under that Article. At that point, the Inspector may follow the steps set out in Article 16, to the extent appropriate, in determining whether to cancel or replace a registration document.

Article 5 amends Schedule 4A to the Order. Schedule 4A deals with the assignment of a mark-right in respect of a vehicle where the previous owner of the vehicle is a party to the arrangement. The amendments provide for a mark-right of a registration mark to be assigned where the registration of the vehicle to which the registration mark was assigned has been cancelled following lack of any requested information or where a person other than a registered owner confirms that a vehicle has been permanently destroyed or removed from Jersey. In such circumstances, the Inspector may grant a mark-right in respect of that registration mark to another person provided that at least 12 months have elapsed from the date of cancellation. The amendments also make clear that any rights held by a person recorded as the registered owner of the vehicle immediately before cancellation are extinguished.

Article 6 sets out the title of this Order and provides for it to come into force 7 days after the day it is made. The Order was made on 28th February 2022 and came into force on 7th March 2022.

Sanctions and Asset-Freezing (Implementation of External Sanctions) (Amendment – Russia) (Jersey) Order 2022.

This Order amends the table in Schedule 1 to the Sanctions and Asset-Freezing (Implementation of External Sanctions) (Jersey) Order 2021, to implement changes in UK sanctions brought about by –

  1. the Russia (Sanctions) (EU Exit) (Amendment) (No. 2) Regulations 2022 of the UK, which came into force at the start of 1st March 2022;
  2. the Russia (Sanctions) (EU Exit) (Amendment) (No. 3) Regulations 2022 of the UK, which came into force at the start of 1st March 2022;
  3. the Russia (Sanctions) (EU Exit) (Amendment) (No. 4) Regulations 2022 of the UK, which came into force at 3 p.m. on 1st March 2022.

Those Regulations each amended the Russia (Sanctions) (EU Exit) Regulations 2019 of the UK (SI 2019/855, as amended). The amendments made by this Order add new duties and prohibitions, from the amended UK Regulations, to the list of duties and prohibitions that it is an offence to contravene. Those duties and prohibitions concern financial services and shipping (the other amendments effected by the UK Regulations took effect automatically as soon as they came into force). The new duties and prohibitions are contained in regulations 16(4A), 16(4C), 16(4E), 17A(1), 17A(2), 57A(1), 57A(2), 57B(4) and 57C(3) of the amended Russia (Sanctions) (EU Exit) Regulations 2019 of the UK.

This Order comes into force immediately after the midnight following its making. The Order was made on 1st March 2022 and came into force on 2nd March 2022.

Financial Services (Amendment of Schedules to Law) (No. 2) (Jersey) Order 2022. Minister for External Relations and Financial Services.

The Financial Services (Amendment of Schedules to Law) (No. 2) (Jersey) Order 2022 amends Schedules 1 and 2 to the Financial Services (Jersey) Law 1998 (the "1998 Law") to provide that pension schemes fall under the definition of investments according to Schedule 1 of that Law. In particular –

Article 1 substitutes paragraph 9A of Schedule 1 to the 1998 Law to provide that pensions schemes (as defined in that paragraph) fall under Schedule 1 rather than only defined benefit schemes. Article 1 also inserts a note providing that substituted paragraph 9A applies only to the giving of investment advice in respect of a pension scheme, and deletes the note appended to paragraph 10 of the Schedule.

Article 2 deletes paragraph 18 (defined benefit schemes) from Schedule 2 (exemptions) to the 1998 Law. Article 3 gives the citation and provides that Order comes into force 7 days after it is made.

The Order was made on 3rd March 2022 and came into force on 10th March 2022.

Sanctions and Asset-Freezing (Implementation of External Sanctions) (Russia Amendment No. 2) (Jersey) Order 2022.

This Order amends the Sanctions and Asset-Freezing (Implementation of External Sanctions) (Jersey) Order 2021, to implement further changes in UK sanctions Regulations in relation to Russia. In particular it makes it an offence to breach a prohibition on providing financial services to the Russian Central Bank and National Wealth Fund, introduced by the Russia (Sanctions) (EU Exit) (Amendment) (No. 5) Regulations 2022 of the UK (which came into force at 5 p.m. on 1st March 2022). It also clarifies how the UK Regulations on detention of ships apply in Jersey through the Shipping (Jersey) Law 2002 (in doing so it reproduces a provision about Crimean port directions that is already in the Order).

This Order comes into force immediately after the midnight following its making. The Order was made on 3rd March 2022 and came into force on 4th March 2022.

Trade Marks (Amendment) (Jersey) Order 2022. Minister for External Relations and Financial Services.

This Order amends the Trade Marks (Jersey) Order 2000 ("the TM Order"), following the making by the Assembly of the Trade Marks, Registered Designs and Patents (Application Forms) (Jersey) Regulations 2022 ("the Regulations"). The Regulations remove the need for the TM Order to specify the manner and form in which certain applications are made, and instead allow the Judicial Greffier (as registrar) to publish a notice on a website setting out the manner of application (or to provide an online form).

This Order therefore deletes the provisions in Articles 2 and 3 of, and Schedule 1 to, the TM Order that set out the manner and forms for the applications. But Article 2 of the TM Order also set out fees for the applications, so those fees are reproduced (without increase or decrease) by a substituted Article 2.

The Order comes into force at the same time as the Regulations, which will be 9th March 2022. The Order was made on 8th March 2022 and came into force on 9th March 2022.

Electronic Communications (Exclusion for Wills and Lasting Powers of Attorney) (Jersey) Order 2022. Minister for Economic Development, Tourism, Sport and Culture.

This Order will ensure that Articles 9B and 9C of the Electronic Communications (Jersey) Law 2000 (as inserted by the Electronic Communications (Amendment No. 2) (Jersey) Law 202-) cannot be used in relation to the execution of a will.

Article 1 provides that Article 9B of the Electronic Communications (Jersey) Law 2000 does not permit the witnessing of the signature of the testator of a will or any other document that has testamentary effect to be carried out remotely by electronic means. It also provides that Article 9C of that Law cannot be used to authorise someone other than the testator to sign a will or other such document using an electronic signature.

Article 2 provides for the citation and commencement of the Order.

The Order was made on 9th March 2022 and came into force on 11th March 2022.

This Order amends the Sanctions and Asset-Freezing (Implementation of External Sanctions) (Jersey) Order 2021, to implement further changes in UK sanctions in relation to Russia, which are made by the Russia (Sanctions) (EU Exit) (Amendment) (No. 6) Regulations 2022 of the UK (which came into force at 5 p.m. on 8th March 2022).

In particular the Order makes it an offence to breach a prohibition on directly or indirectly providing insurance or reinsurance services relating to aviation and space goods, or aviation and space technology, to a person connected with Russia, or for use in Russia. It also makes it an offence for Russian aircraft to overfly, or land in, Jersey.

This Order comes into force immediately after the midnight following its making. The Order was made on 9th March 2022 and came into force on 10th March 2022.

Taxation (Enveloped Property Transactions) (Statements) (Jersey) Order 2022 Minister for Treasury and Resources

This Order sets out the information that must be included in statements made under Articles 8 and 9 of the Taxation (Enveloped Property Transactions) (Jersey) Law 202- (the "Law").

Article 8 of the Law requires a person to deliver a statement to the Comptroller if the person acquires a significant interest in an entity that owns enveloped property.  Article 2 of this Order prescribes the information a statement must contain. The statement must contain information about the entity, about the person or entity from which the interest was acquired, about the enveloped property and about the transaction.

Article 9 of the Law requires an entity to provide a statement to the Comptroller if a relevant transaction takes place in relation to the entity and no statement has been delivered under Article 8. Article 3 of this Order prescribes the information a statement must contain and the form the statement must take. The statement must contain information about the entity and about the person who acquires a significant interest in the entity. The statement must be made using the electronic form provided by the Comptroller or by an alternative means, if any, provided by the Comptroller.

Article 4 gives the name of the Order and provides that it comes into force on the commencement of the Law.

The Order was made on 11th March 2022 and came into force on 4th April 2022.
