Suspension of meeting

The Bailiff , following the notification of lodged propositions, suspended the meeting for 40 minutes, in accordance with Standing Order 46, in order to ensure that technical measures were taken to prevent access by strangers to the digital precincts of the Assembly's meeting.

Planning Committee – appointment of member

In accordance with Standing Order 125A, the Chair of the Planning Committee indicated that he wished to have a Committee of 10 members, including the Chair, and nominated the Connétable of St. Clement as a member of the Committee.

There being no other nominations, the Bailiff declared that the Connétable of St. Clement had been duly appointed as a member of the Planning Committee.

Draft Road Traffic (No.68) (Jersey) Regulations 202- P.39/2021

THE STATES, resuming consideration of the Draft Road Traffic (No.68) (Jersey) Regulations 202-, the principles having been adopted on 9th June 2021, commenced consideration of Regulations 1 to 4 and, adopting an amendment of the Minister for Infrastructure (P.39/2021 Amd.), agreed that, in Article 2, in the substituted Article 52 –

  1. in paragraph (4) –
  1. for "If a driver of a motor vehicle reasonably believes that a cat has been struck owing to the presence of the vehicle on a road, the driver must" there should be substituted "Subject to paragraph (5), if a cat is hit by a motor vehicle while that vehicle is being driven on a road, the driver of the vehicle must";
  2. in sub-paragraph (b)(i) for "struck" there should be substituted "hit";
  1. after paragraph (4) there should be inserted –

"(5) A driver is not guilty of an offence of failing to comply with paragraph (4) if the driver of

the motor vehicle did not know and had no reason to suspect that a cat was hit by the motor vehicle.";

  1. existing paragraphs (5) to (9) should be re-numbered accordingly;
  2. in paragraph (4)(b) for "(5)" there should be substituted "(6)"; and
  3. in paragraph (8) (re-numbered as (9)) for "(5)(b)" there should be substituted "(6)(b)".

THE STATES, having been informed that the relevant scrutiny panel had indicated that it did not wish to scrutinise the draft legislation, commenced consideration of Articles 1 to 12 and 16 to 39 and, adopting both parts of an amendment of the Minister for Treasury and Resources (P.51/2021 Amd.(3)) as well as two amendments of the Corporate Services Scrutiny Panel (P.51/2021 Amd. and P.51/2021 Amd.(2)), agreed that –

in Article 12, in the inserted Article 24(2)(a), for "5" there should be substituted "4";

in Article 34, in the inserted Article 19(3)(b), for "is a person" there should be substituted "is an individual"; and

in Article 37 –

in inserted Articles 27B(2) and 27C(2), ", signed by the Comptroller or by an officer authorized by the Comptroller for the purpose," should be deleted in both places;

after inserted Article 27C(2)(c) there should be inserted –

"(d) a warning that the third party is liable to prosecution if the third party discloses

information relating to the notice to any person."; and

Article 27C(3)(c) should be deleted.

THE STATES adopted Articles 1 to 12 and 16 to 39, as amended.

The Minister for Treasury and Resources did not propose Articles 13 to 15.
