The EU Legislation (Sanctions – Republic of Maldives) (Revocation) (Jersey) Order 2019 revokes the EU Legislation (Sanctions – Republic of Maldives) (Jersey) Order 2018.

European Union (Repeal and Amendment) (Commencement No. 2) (Jersey) Order 2019.
The European Union (Repeal and Amendment) (Commencement No. 2) (Jersey) Order 2019 brings into force Articles 6 and 7 of the European Union (Repeal and Amendment) (Jersey) Law 2018.
The European Union (Repeal and Amendment) (Jersey) Law 2018 ("EURAL") was adopted by the States on 6th March 2018, sanctioned by Order of Her Majesty in Council on 23rd May 2018, and registered by the Royal Court on 1st June 2018. Articles 1, 4, 5, 8, 9, 10 and 11 were brought into force on 19th September 2018 by the European Union (Repeal and Amendment) (Jersey) Law 2018 (Commencement) (Jersey) Order 2018.
Articles 6 and 7 of EURAL amend Article 2 of the European Union Legislation (Implementation) (Jersey) Law 2014 and repeal Articles 3, 3A and 4 of that Law. One effect is to remove the power to make Orders under that Law to implement EU sanctions (or to give further effect to directly applicable EU legislation). The other effect is to amend the power to make Regulations under Article 2 of that Law (and to provide expressly for how those Regulations can grant power to make Orders).
Articles 6 and 7 of EURAL are brought into force on 19th July 2019, which is the same date as the commencement of the Sanctions and Asset-Freezing (Jersey) Law 2019 ("SAFL"). SAFL creates a new power to make Orders to implement EU sanctions (and UK sanctions), replacing the power repealed by Article 6 of EURAL (and preserving Orders already made under the repealed power). Article 53 of SAFL therefore requires that the replacement power in SAFL should come into force at or before the time that Article 6(a) of EURAL is brought into force.
The only remaining provisions of EURAL that are not in force after 19th July 2019 are Articles 2 and 3. Those Articles would repeal the European Union (Jersey) Law 1973 and the European Economic Area (Jersey) Law 1995.

Sanctions and Asset-Freezing (Miscellaneous Amendments – Information) (Jersey) Order 2019.
The Sanctions and Asset-Freezing (Miscellaneous Amendments – Information) (Jersey) Order 2019 makes provision as to duties and powers in relation to information, amending the Orders (the "preserved Orders") that implement EU sanctions, which are preserved by Article 48 of the Sanctions and Asset-Freezing (Jersey) Law 2019 (the "2019 Law").
Article 1 amends the EU Legislation (Sanctions) (General Provisions) (Jersey) Order 2014, which contains general provisions that are incorporated into all of the preserved Orders unless those Orders provide otherwise. The amendments add a new Article 10A into the Order, to ensure that the information provisions of the preserved Orders are not limited by the applicable information provisions of the 2019 Law (but a person cannot be prosecuted for 2 offences constituted by the same facts). Generally the information provisions of the 2019 Law only apply in relation to "designated persons" under that Law, but the persons to whom the preserved Orders apply are not designated persons under the 2019 Law. However, there are information provisions in Articles 32(1)(b)(ii), 33(5)(b) and 33(5)(c) of the 2019 Law that apply in relation to any offence under the 2019 Law, which includes an offence under a preserved Order (under Articles 1(3) and 48(1) of the 2019 Law), despite the preserved Order applying to persons who are not "designated persons". In particular, under all but 2 of the EU Regulations implemented by the preserved Orders, a person must provide information to the Minister without waiting to be asked for it, if the information would facilitate compliance with the implemented EU Regulation. There is an equivalent duty under Article 32 of the 2019 Law, but it applies only to "relevant financial institutions" and only to certain information. The duty imposed by the 2019 Law will not limit the duty imposed by the preserved Orders.
The amendments also delete Article 14A of the EU Legislation (Sanctions) (General Provisions) (Jersey) Order 2014, which made provision for persons newly listed by the United Nations. That provision is no longer needed because its work is done instead by Article 29(1) of the 2019 Law.
Article 2 amends the EU Legislation (Sanctions – Russia) (Jersey) Order 2014, which is one of the 2 preserved Orders mentioned above, as Article 32(1)(b)(ii) of the 2019 Law applies in relation to that Order without any equivalent provision in the implemented EU Regulation.
Article 3 similarly amends the EU Legislation (Sanctions – Ukraine) (Jersey) Order 2014, which is the other of the 2 preserved Orders mentioned above, as Article 32(1)(b)(ii) of the 2019 Law applies in relation to that Order without any equivalent provision in one of the EU Regulations implemented by the Order.
Article 4 gives the name by which the Order may be cited, and brings it into force on 19th July, which is the day on which the 2019 Law comes into force.

Police Procedures and Criminal Evidence (Application to Customs and Excise) (Amendment No. 3) (Jersey) Order 2019.
This Order amends the Police Procedures and Criminal evidence (Application to Customs and Excise) (Jersey) Order 2004 (referred to throughout this Order as the "principal Order") in order to further extend to customs officers certain police powers under the Police Procedures and Criminal Evidence (Jersey) Law 2003 (the "Law"). Those powers are accompanied by certain safeguards for persons in relation to whom the police or customs officers exercise those powers.
Article 2 amends the list contained in Schedule 1 to the principal Order of Articles of the Law that are extended so as to apply to customs officers, by adding the remainder of the provisions relating to bail in Part 5 and Articles 107 and 108 of the Law to the list.
Article 3 amends Schedule 2 to the principal Order so as to adapt some of the provisions in Part 5 of the Law. These modifications apply only in relation to the exercise by customs officers of powers under the Law.
Article 4 gives the title of this Order and provides for it to come into force immediately after the coming into force of the remainder of Part 5 of the Law in accordance with Article 1 of the Police Procedures and Criminal Evidence (Jersey) Law 2003 (Appointed Day) (No. 6) Act 2019.
The Order was made on 19th July 2019 and comes into force in accordance with Article 4.

Motor Traffic (Cabs – Fares and Charges) (Amendment No. 2) (Jersey) Order 2019.
The Motor Traffic (Cabs – Fares and Charges) (Amendment No. 2) (Jersey) Order 2019 makes provision for taxi-cab fares and charges to increase by 3.4%.
Fares and charges were last increased with effect from 15th October 2018. The Order was made on 19th July 2019 and came into force on 29th July 2019.

Court of Appeal (Civil) (Amendment No. 5) Rules 2019.
These Rules amend further the Court of Appeal (Civil) Rules 1964 ("the 1964 Rules"). Amendment of Rule 10A of the 1964 Rules
Rule 10A enables a person who has appealed to the Court of Appeal to abandon their appeal by serving a written notice on the Judicial Greffier. The amendment makes it clear that this does not apply to an appeal under the Children (Jersey) Law 2002.
Amendment of Rule 18 of the 1964 Rules
Rule 18 provides for the recovery of taxed costs. The amendment provides that taxation of costs may include a summary assessment of costs, and that interim payments on account of costs may be ordered.
Insertion of new Rule 18B in the 1964 Rules
Under Article 14 of the Court of Appeal (Jersey) Law 1961, a person cannot appeal from a decision of the Court of Appeal without the Court's permission (leave').
The new Rule 18B provides an application for leave must be made within 28 days of the Court's decision, or within 28 days of the Court giving reasons for its decision.
Coming into force
These Rules were made by the Court of Appeal on 22nd July 2019 and came into force on 23rd July 2019.

Sea Fisheries (Spider Crabs – Restrictions on Fishing) (Jersey) Order 2019.
This Order, when read with Regulations 5 and 5A of the Sea Fisheries (Miscellaneous Provisions) (Jersey) Regulations 1998, prohibits the fishing, taking or storing of soft-shelled spider crabs during the period from 1st September 2019 to 15th October 2019 inclusive. During the same period, the Order also prohibits the use of passive fishing gear within the sea area specified in the Schedule.
The Order was made on 30th July 2019 and came into force on 6th August 2019.

Immigration (Fees) (Amendment No. 4) (Jersey) Order 2019.
The Immigration (Fees) (Amendment No. 4) (Jersey) Order 2019 further amends the Immigration (Fees) (Jersey) Order 2017 to set fees that must accompany applications for limited leave to remain in respect of students or their dependants; work permit holders or their dependants; and investors or their dependants; and provides that no fees are payable in respect of applications for leave to remain by a person, who for the purposes of the Jersey Immigration Rules is to be regarded as an EU citizen, a family member of an EEA citizen or a family member of a qualifying British citizen.
Previously the fees set in relation to applications for limited leave to remain were £704 for any work permit holder or his or her dependant and £1,033 in relation to a person who is not a work permit holder or who is a dependant of such a person.
By Article 1 of this Order, which amends Article 2 of the Immigration (Fees) (Jersey) Order 2017, the fees are now £475 for applications for students or their dependants; £244 for applications for work permit holders where the work permit enables the person's employment in an unskilled job for a period not exceeding 9 months; £704 for any other work permit holders or their dependants; and £1,623 for investors or their dependants. All other applications must be accompanied by a fee of £1,033, as before.
Article 2 amends Article 4 of the Immigration (Fees) (Jersey) Order 2017 to clarify that no fee is payable in respect of an application for leave to remain by an EEA citizen, a family member of an EEA citizen or a family member of a qualifying British citizen under Appendix EU(J) to the Jersey Immigration Rules.
Article 3 gives the title of this Order and provides for it to come into force immediately upon it being made. The Order was made on 7th August 2019 and came into force forthwith.

Road Traffic ( St. Helier ) (Amendment No. 34) (Jersey) Order 2019.
This Order makes amendments to traffic restrictions in St. Helier relating to one way traffic, prohibition on waiting, roads closed to, or for restricted use by, motor vehicles, parking places on roads and parking of vehicles in roads for loading and unloading.
Article 1 is an interpretation provision.
Article 2 amends provisions relating to one-way restrictions in Gas Place.
Article 3 amends provisions relating to prohibition of waiting in Le Clos Vaze, Patrick Feely Lane and Roseville Street.
Article 4 amends provisions concerning use by pedestrians and cyclists of roads closed to, or subject to restricted use by, motor vehicles in Gas Place.
Article 5 amends provisions concerning parking places in Commercial Buildings, Mount Bingham and Roseville Street.
Article 6 amends provisions concerning loading and unloading in Commercial Buildings and the Esplanade.
Article 7 sets out the title of this Order and provides for it to come into force 7 days after the day it is made. The Order was made on 16th August 2019 and came into force on 23rd August 2019.

Children (Amendment No. 3) Rules 2019.
The Children (Amendment No. 3) Rules 2019 replace Rule 25 of the Children (Jersey) Rules 2005 with new Rules 25 and 25A. The existing Rule 25 limits disclosure of documents held by the Royal Court related to proceedings before the Court under the Children (Jersey) Law 2002.
The substituted Rule 25
The substituted Rule re-enacts the limitations on disclosure in the existing Rule 25 but makes it clear that –
- the Rule applies to documents prepared for the purpose of proceedings rather than documents related to proceedings;
- documents which are subject to Rule 25 cannot be further disclosed except in accordance with Rule 25.
The substituted Rule also expressly confirms the Court's power to grant leave subject to conditions which prevent the identification of a child.
The new Rule 25A
The new Rule provides (subject to conditions mentioned below) for certain bodies inspecting any aspect of the Children's Service or of the Jersey Family Court Advisory Service ("JFCAS") to be permitted access to a document prepared for the purpose of proceedings under the Children (Jersey) Law 2002. The bodies concerned are –
- the Health and Social Care Commission;
- the Office for Standards in Education, Children's Services and Skills;
- a person or body duly appointed to inspect the Children's Service or JFCAS.
Disclosure of a document under this Rule is subject to conditions that –
- it must be for the purpose of the relevant inspection, and for no other purpose; and
- nothing in the document is to be disclosed further without the Court's permission (and the Court may attach conditions to the permission for any purpose, but especially to prevent the identification of any child in the proceedings).
Coming into force
These Rules were made by the Superior Number of the Royal Court on 19th August 2019 and came into force on 26th August 2019.

States of Jersey (Transfer of Responsibilities and Functions) (Chief Minister to Economic Development, Tourism, Sport and Culture) Order 2019.
This Order transfers the responsibilities and functions of the Chief Minister under enactments and Orders in Council relating to data protection, digital matters and communications and broadcasting to the Minister for Economic Development, Tourism, Sport and Culture.
Article 1 contains definitions.
Article 2 transfers to the Minister for Economic Development, Tourism, Sport and Culture the responsibilities and functions of the Chief Minister under certain enactments and Orders in Council related to data protection, digital matters and communications and broadcasting. It also makes amendments that are consequential to that transfer.
Article 3 transfers to the receiving Minister any rights enjoyed and liabilities incurred by the transferring Minister in connection with the responsibilities and functions transferred by Article 2.
Article 4 provides for the continuity of any appointment, approval or other decision made, or authority to do anything given, by the transferring Minister under the enactments covered by this Order and substitutes the receiving Minister for the transferring Minister in any ongoing legal proceedings.
Article 5 sets out the name by which this Order may be cited and states that the Order comes into force on the day after the day on which it is made.
The Order was made on 21st August 2019 and came into force on 22nd August 2019.

"Further to a response given to Oral Question 186/2019 on 16th July 2019, in which a request for monthly details of departmental expenditure was refused, but an undertaking given to provide the figures for the end of June by the end of July 2019; will the Minister advise when these figures will be made available and why it was possible for the same information to be provided by way of a public Freedom of Information request?
Given that the figures at the end of April 2019 show that the Chief Operating Office was £2.1 million overspent, will the Minister provide the latest figures, including a detailed breakdown of the overspend?"
