Standing Order 123 provides for the appointment of elected members to the Public Accounts Committee. The Presiding Officer shall invite the Chair of the Committee to make the nomination (the Connétable of St. John ). The Presiding Officer will then invite alternative nominations of elected members who are neither Ministers nor Assistant Ministers. If alternative nominations are made, a secret ballot will be held. If there are no alternative nominations, the Connétable of St. John will be declared a member of the Public Accounts Committee.
The appointment of an elected member to the Committee will see it comprise 4 elected members and 4 unelected members (in addition to the Chair), in accordance with Standing Order 131.
Members of the Planning Committee
Standing Order 125A provides for the appointment of members of the Planning Committee. The Presiding Officer shall invite the Chair of the Committee to make the nomination ( Deputy J.M. Maçon of St. Saviour ). The Presiding Officer will then invite alternative nominations of elected members who are neither the Minister, nor an Assistant Minister, for the Environment. If alternative nominations are made, a secret ballot will be held. If there are no alternative nominations, Deputy Maçon will be declared a member of the Planning Committee.
The appointment of a member to the Committee will see it comprise 9 members (in addition to the Chair) in accordance with Standing Order 141A that stipulates the Committee comprises the Chair and not less than 3 but no more than 9 members.

Covid-19 (Workplace Restrictions) (Amendment No. 13) (Jersey) Order 2021. Minister for Health and Social Services.
This Order amends the Covid-19 (Workplace Restrictions) (Jersey) Order 2020 (the "2020 Order") to restore earlier requirements for visitors to workplaces to wear masks, for workers to wear masks or visors in workplaces and to make other minor changes.
Article 1 establishes that it is the 2020 Order that is to be amended.
Article 2 reinserts 3 definitions that were redundant when mask-wearing provisions were removed from the 2020 Order.
Article 3 substitutes Article 5(3) of the 2020 Order to reintroduce the requirements to wear masks in a variety of public locations that applied before the requirements were limited to public transport vehicles and premises on 14th June 2021. The exception for eating and drinking when sitting at a table in food and drink premises is extended to when in a seat of an auditorium or stadium and a new requirement to wear masks is added when attending an event at a community hall.
Article 4 substitutes Article 5A(2) of the 2020 Order to reintroduce the requirements for workers to wear masks or visors that applied before they were limited to public transport vehicles and premises on 14th June 2021. There are minor changes to limit mask-wearing to indoor areas of markets, amusement centres, entertainment facilities and auction houses to match the requirements for visitors to wear masks in those workplaces. A similar new requirement to that mentioned above for events in community halls is also added.
Article 5 removes the exemption in respect of mask-wearing that applied to certain gatherings of children in workplaces.
Article 6 contains the citation provision and provides for the Order to come into force on 21st July 2021. The Order was made on 20th July 2021 and came into force on 21st July 2021.

Access to Justice (Legal Aid Guidelines) (Jersey) Order 2021. Chief Minister.
The Access to Justice (Legal Aid Guidelines) (Jersey) Order 2021 makes provision for the publication of draft Legal Aid Guidelines (the "Guidelines") and the manner in which representations on those Guidelines may be made. In particular –
Article 1 provides that the Minister must provide a copy of the Guidelines to the relevant Scrutiny Panel, the Jersey Citizens Advice Bureau Limited and the Jersey Consumer Council. The Minister must publish the proposed Guidelines along with a notice stating: that the Guidelines are available; the time period in which representations may be made (which must be a minimum period of 8 weeks); and a postal and email address at which representations will be accepted. The notice may include alternative means by which representations may be made if a person is unable to communicate in writing.
Article 2 gives the citation and provides that the Order comes into force 7 days after it is made. The Order was made on 27th July 2021 and came into force on 3rd August 2021.

Control of Housing and Work (Temporary Exemption) (Jersey) Order 2021.

This Order provides that, for the period beginning when the Order comes into force and ending at the end of 31st October 2021, certain additional persons are to be disregarded for the purposes of complying with any condition which appears on a business licence granted under Article 27(1)(a) of the Control of Housing and Work (Jersey) Law 2012, concerning the maximum number of individuals with Licensed or Registered status who are permitted to work for an undertaking.
In particular –
Article 1 is an interpretation provision, and provides that this Order is made without prejudice to the provisions of the Control of Housing and Work (Exemptions) (Jersey) Order 2013.
Article 2 provides the definition of "eligible worker". A person is an eligible worker if that person has a registration card, has Licensed or Registered status, and is employed for at least one hour per week by an employer under its business licence.
Article 3 provides that if an eligible worker works for a second employer, that eligible worker is disregarded for the purposes of any condition which appears on a business licence granted under Article 27(1)(a) of the Control of Housing and Work (Jersey) Law 2012, concerning the maximum number of individuals with Licensed or Registered status.
Article 4 provides that the second employer of an eligible worker has a duty to take reasonable steps to ensure that the worker is still working for the first employer during his or her period of employment with the second employer.
Article 5 gives the citation, and provides that the Order comes into force 7 days after it is made, and expires on 31st October 2021.
The Order was made on 29th July 2021 and came into force on 5th August 2021.

Covid-19 (Workplace Restrictions and Gathering Control) (Amendment No. 8) (Jersey) Order 2021. Minister for Health and Social Services.
This Order mainly reduces the restrictions on gatherings imposed by the Covid-19 (Gathering Control) (Jersey) Order 2020, though it also makes minor changes to some definitions in the Covid-19 (Workplace Restrictions) (Jersey) Order 2020.
Article 1 amends the following definitions in Article A1 of the Covid-19 (Workplace Restrictions) (Jersey) Order 2020 –
- "food and drink premises – the definition now includes places as well as premises. It is also made clear (in a new paragraph (3)) that a reference in the definition to retail sale of food and/or drink includes any situation in which they are supplied in return for payment to enter to the premises or place, or in which payment is made in return for a ticket or other token entitling the holder to the food and/or drink;
- "indoor area" – the definition now covers a structure closed by more than half the surface area extending upwards from its perimeter to the height of the roof (instead of closed on more than one side which could not cover round structures);
Article 2 provides that Articles 3 to 6 amend the Covid-19 (Gathering Control) (Jersey) Order 2020 Article 3 makes the following changes to definitions in the Order –
- the definitions "construction site" and "workplace" are deleted as they are no longer needed due to the provisions relying on them being deleted;
- the definition "open air" is modified to cover a structure closed by no more than half the surface area extending upwards from its perimeter to the height of the roof, or if none, to the highest point of the structure (instead of closed on no more than half of its sides which could not cover round structures);
- the definition "home" is replaced by separate definitions of "home" and "garden".
Article 4 amends the provisions about gatherings in people's homes (which, due to the change in definition, no longer includes gardens). The limit to 20 people does not apply to a gathering in any part of a home if it is for the ceremony relating to a marriage or civil partnership or for a reception in celebration of that ceremony. This is slightly rephrased and the other exception has been removed because it related only to gardens.
Article 5 inserts new Article 3A about gatherings in people's gardens. It creates 6 separate conditions any one or more of which need to be satisfied for those gatherings to take place:
- If not more than 20 people are taking part in the gathering.
- If the gathering includes one or more children under 5 and no more than 20 people over 5 are present.
- If the gathering is (a) in the open air, (b) it is open only to guests rather than the public, (c) no charge is made for attending and (d) no food or drink is sold to guests.
- If the gathering is (a) in the open air, (b) is a fundraising event for a registered charity or other philanthropic enterprise the decision to raise funds for which was taken before this Order was made,
(c) the proceeds of the gathering are to be donated to that charity or enterprise, (d) the gathering is a controlled gathering (meaning that there is someone in charge who has taken all reasonable steps to assist in controlling the spread of Covid-19) and (e) no food or drink is consumed other than whilst seated at a table in the garden.
- If the gathering is for the ceremony relating to a marriage or civil partnership, or for a reception in celebration of that ceremony.
- If the garden is hired out for a gathering and has previously been so hired out or booked for hire on at least one occasion before 10th May 2021, when this condition was first introduced into the 2020 Order.
Article 6 deletes Article 4 of the Order, consequently all restrictions on gatherings in the open air (other than in gardens) are removed.
Article 7 provides for the citation of the Order and for it to come into force on 5th August 2021. The Order was made on 4th August 2021 and came into force on 5th August 2021.

Education (Grants and Allowances) (Academic Year 2021-2022) (Jersey) Order 2021 Minister for Children and Education
The Education (Grants and Allowances) (Academic Year 2021-2022) (Jersey) Order 2021 provides, in respect of the academic year 2021-2022 only, for the determination of applications for grants or allowances based on a student's single parent's income only.
Article 1 defines words used in this Order.
Article 2 applies this Order to a different description of case from the cases described in Article 4 of the Education (Grants and Allowances) (Jersey) Order 2018 (the "2018 Order") which provides for the meaning of "relevant" income for the purposes of determining an application for a grant or allowance. Under the 2018 Order, the gross income of both of a student's parents, whether those parents are living together in the same household as the student, or one of the parents is living separately, is determined as relevant income. Article 3 would have the effect of making an exception to the position under the 2018 Order, so that for the academic year 2021-2022 only, just the gross income of the parent with whom the student is living is determined as relevant income for the purposes of a grant or allowance.
Article 4 makes a minor amendment to Article 2 of the 2018 Order to change a reference to the Minister for Children and Housing to the Minister for Children and Education.
Article 5 provides for the title by which this Order may be cited, for it to come into force on the day after it is made and for it to expire at the end of the academic year 2021-2022.
The Order was made on 6th August 2021 and came into force on 7th August 2021.

Road Traffic ( St. Lawrence ) (Amendment No. 26) (Jersey) Order 2021. Minister for Infrastructure.
This Order amends the Road Traffic ( St. Lawrence ) (Jersey) Order 1990 in relation to La Rue de Haut by amending the designated parking areas and restrictions in that road and inserting a new restriction which excludes all vehicles wider than 6 feet 6 inches from being driven in La Ruelle de St. Claire in place of the current restriction which excludes only chars-à-banc. This Order also makes some minor drafting changes concerning the spelling of La Rue de Haut so that it is consistent throughout the Order.
This Order comes into force 7 days after the day it is made.
The Order was made on 10th August 2021 and came into force on 17th August 2021.

Sanctions and Asset-Freezing (Implementation of External Sanctions) (Amendment – Belarus) (Jersey) Order 2021.

This Order amends the Sanctions and Asset-Freezing (Implementation of External Sanctions) (Jersey) Order 2021 to implement the Republic of Belarus (Sanctions) (EU Exit) (Amendment) Regulations 2021 of the United Kingdom (S.I. 2021/922).
This Order adds to the list of UK provisions for which the Sanctions and Asset-Freezing (Implementation of External Sanctions) (Jersey) Order 2021 imposes a Jersey offence (carrying up to 7 years of imprisonment, an unlimited fine, or both) of contravening the UK provision as implemented in Jersey. Those provisions include, as implemented in Jersey in relation to Belarus: prohibitions on providing certain persons with technical assistance relating to aircraft; restrictions relating to financial instruments, loans, credit, insurance and reinsurance; restrictions on trade in services, goods and technology that relate to interception and monitoring of communications; restrictions on trade in dual-use goods and technology, goods for the tobacco industry, petroleum products and potash; prohibitions on non-compliance with directions about aircraft landing in Jersey, or entering or leaving Jersey's airspace; and a prohibition on disclosing confidential information about those directions.
The Order comes into force on the day after it is made.
The Order was made on 11th August 2021 and came into force on 12th August 2021.

Animal Health (Miscellaneous Amendments – Diseases) (Jersey) Order 2021.

This Order amends the Animal Health (Jersey) Law 2016 and the Animal Health (Miscellaneous Exotic Diseases) (Jersey) Order 2017 to add further diseases and pathogens.
Article 1 amends Schedule 1 and Part 1 of Schedule 2 to the Animal Health (Jersey) Law 2016 to add new diseases and pathogens. The amendments also replace the entry relating to Psittacosis with a more current entry referring to Avian chlamydiosis.
Article 2 amends Article 3 of the Animal Health (Miscellaneous Exotic Diseases) (Jersey) Order 2017 to add diseases to the list that allows for the slaughter of animals. It also substitutes a new table of diseases and susceptible animals in Schedule 1 to that Order. The additions to this table are: Contagious caprine pleuropneumonia, Ebola, infection with Batrachochytrium salamandrivorans, and Surra (Trypanosoma evansi). The substituted table also replaces the reference to Psittacosis with a reference to Avian chlamydiosis.
Article 3 gives the name by which the Order may be known and provides that it will come into force 7 days after it is made.
The Order was made on 13th August 2021 and came into force on 20th August 2021.

Covid-19 (Gathering Control Repeal and Workplace Restrictions Amendment) (Jersey) Order 2021. Minister for Health and Social Services.
This Order further relaxes the restrictions imposed to control the spread of Covid-19 in Jersey while extending the contact tracing requirements.
Article 1 repeals the Covid-19 (Gathering Control) (Jersey) Order 2020, thereby removing the remaining restrictions on gathering, which were limited to gathering in homes and gardens.
Article 2 amends the Covid-19 (Workplace Restrictions) (Jersey) Order 2020 by:
- in Article A1, relocating 2 definitions from elsewhere in the Order and removing 2 redundant definitions;
- deleting Article 3 to remove the remaining limitations on the opening of specified workplaces, namely food and drink premises and nightclubs;
- removing the requirements for visitors to wear masks in Article 5 except in relation to public transport vehicles or premises;
- removing the requirement for workers to wear masks in Article 5A except in relation to public transport vehicles or premises;
- extending the contact tracing requirements in Article 5B to nightclubs, indoor visitor attractions and auction houses and modifying the requirements to require contact details to be given by only one person in a group and allow those details to be given in advance.
Article 3 provides for how the Order may be cited and for it to come into force on 26th August 2021. The Order was made on 24th August 2021 and came into force on 26th August 2021.

This Order amends the Covid-19 (Workplace Restrictions) (Jersey) Order 2020, to extend the restriction period to end at the end of Thursday 30th September 2021.

Emergency Powers and Planning (Medicines and Vaccines - Covid-19 and Influenza) (Fourth Period) (Jersey) Order 2021.

This Order provides for the continuation of relaxed controls on medicines to facilitate a plan for vaccination against Covid-19. It is the fourth such Order, the previous Orders being as follows –
- Emergency Powers and Planning (Medicines and Vaccines – Covid-19) (Third Period) (Jersey) Order 2021 (in force from 5th June 2021 to end of 4th September 2021);
- Emergency Powers and Planning (Medicines and Vaccines – Covid-19) (Jersey) Order 2021 (in force from 5th March 2021 to end of 4th June 2021);
- Emergency Powers and Planning (Medicines and Vaccines – Covid-19 and Influenza) (Jersey) Order 2020 (in force from 5th December 2020 to end of 4th March 2021).
This Order reintroduces provision for vaccination against influenza on the basis that the time period overlaps with the annual influenza vaccination period.
The Order expires 3 months after it comes into force (under the Emergency Powers and Planning (Jersey) Law 1990 it cannot remain in force for longer unless renewed). As it comes into force on 5th September 2021 (to follow the expiry of the previous Order) it will therefore expire at the end of 4th December 2021.
The Order was made on 24th August 2021 and came into force on 5th September 2021.

- The Minister for Health and Social Services tabled an answer on 26th July 2021 to the following question asked by Deputy R.J. Ward of St. Helier :
"Will the Minister advise what data or research are currently being used to determine the impact of Covid-19 on children, in terms of –
- mortality rates, including whether these are calculated as a percentage of infected cases or the total population of children;
- the long-term effects on children arising from different variants of Covid-19;
- the long-term effects on children based on the severity of symptoms; and
- the different effects of Covid-19 on primary, secondary and tertiary-education aged children?"
- The Minister for Treasury and Resources tabled an answer on 26th July 2021 to the following question asked by Senator S.Y. Mézec :
"Will the Minister provide members with –
- an annual breakdown of the dividends received from the States of Jersey Development Company (S.O.J.D.C.) over the last 5 years;
- a breakdown of projects or areas on which this return has been spent;
- any existing projections for anticipated annual dividends from S.O.J.D.C. in coming years?"
- The Minister for Infrastructure tabled an answer on 26th July 2021 to the following question asked by the Connétable of St. John:
"In relation to mains drains will the Minister advise –
- whether there is a plan in place to connect to mains drains the remaining 8% of Island properties that are not currently connected; and, if so, what the expected timescale is to reduce this proportion to 5% and then to 3%;
- whether, if there is no plan in place, he will undertake to put a detailed plan in place and, if so, by when; and, if not, why not; and
- what alternative solutions, if any, has the Department considered to enable more homes to be connected to the mains drains?"
- The Minister for Children and Education tabled an answer on 26th July 2021 to the following question asked by Deputy L.M.C. Doublet of St. Saviour :
"Will the Minister provide the dates and Minutes of the last 3 meetings of the Corporate Parenting Board and also provide details of any meetings which were cancelled, and the reasons for these cancellations?"
Explanatory Note regarding the main respondents for items listed under Public Business (Item L)
In accordance with Standing Order 104A, a time limit of 15 minutes applies to speeches made during debate, unless discretion has been exercised to allow for a longer, or shorter, time limit. No time limit applies to either speech made by the proposer.
Discretion is exercised by the Presiding Officer in accordance with guidance issued by the Bailiff , following consultation with the Privileges and Procedures Committee. The current guidance was presented to the States in the report Time Limits on Speeches in Debates: Guidance on the Exercise of Discretion' (R.3/2021). The report states that discretion may be exercised to allow for a longer speech than 15 minutes where the member speaking is designated as the main respondent' to the debate.
