Education (Grants and Allowances) (2022 Academic Year) (Jersey) Order 2022.

Minister for Children and Education.

The Education (Grants and Allowances) (2022 Academic Year) (Jersey) Order 2022 increases by a further 7.2% of the 2021 academic year rate, for the 2022 academic year only, the amount of maintenance grant awarded to students with relevant income (as defined in the Education (Grants and Allowances) (Jersey) Order 2018) of less than £90,000 per year, or less than £100,000 per year in the case of students studying medicine, dentistry, nursing or veterinary science.

Article 1 is an interpretation provision.

Article 2 explains which students are eligible for the increase in the maintenance grant.

Article 3 sets out the amount of the increase in the maintenance grant by reference to the student's relevant income. The Education (Grants and Allowances) (Amendment No. 3) (Jersey) Order 2022 increased by 2.9% the amount of the maintenance grant for all students on courses in the 2022 academic year. The additional one-off cost of living increase to the maintenance grant awarded to eligible students specified in this Order represents an overall increase of 10.1%.

Article 4 makes minor housekeeping amendments to the Education (Grants and Allowances) (Jersey) Order 2018. Those amendments will not cease to have effect upon the expiry of this Order under Article 5.

Article 5 provides for the title by which this Order may be cited, for it to come into force on the day after the Minister for Children and Education signs the Order, and for it to cease to have effect on the day before the start of the academic year commencing on 1st September 2023.

The Order was made on 8th November 2022 and came into force on 9th November 2022.

Animal Health (Importation of Pork and Porcine Products – Amendment) (Jersey) Order 2022. Minister for the Environment.

This Order amends the Animal Health (Importation of Miscellaneous Goods and Animals) (Jersey) Order 2017 to prohibit the importation of pork and porcine products from any country excluding the British Islands.

It provides an exception for pork and porcine products imported from the European Union, Iceland, Liechtenstein, Norway, the Faroe Islands, Greenland or Switzerland –

  1. for human consumption, provided they have a health mark or identification mark;
  2. not intended for human consumption, provided they are –
  1. packaged correctly and include the name and address of the feed business operator responsible for the labelling on the package, or
  2. have a label attached to the packaging, container or vehicle describing the product and stating which category of animal by-products it belongs.

It also prohibits personal consignments of porcine products intended for human consumption, and such consignments not intended for human consumption, exceeding 2 kilogrammes in each case.

This Order comes into force on the day after it is made.

The Order was made on 17th November 2022 and came into force on 18th November 2022.

Nursing Homes (2023 Fees) (Jersey) Order 2022. Chief Minister.

This Order amends the Nursing Homes (General Provisions) (Jersey) Order 1995 to uprate, in line with inflation, the registration and annual fees to be paid under Articles 3 and 4 of that Order. The fees will each increase by 2.5% on 1st January 2023, when this Order takes effect. (The fees were previously increased with effect from 1st January 2022.)

The Order was made on 18th November 2022 and comes into force on 1st January 2023.

COMMON STRATEGY POLICY (P.98/2022) PROPOSED DEBATE RUNNING ORDER

The Council of Ministers has indicated it would like to propose the proposition as amended by the 1st, 4th and 7th amendments (as amended) – this will be subject to the agreement of States Members.

in accordance with Article 18(2)(e) of the States of Jersey Law 2005, to approve the statement of the Common Strategic Policy of the Council of Ministers as set out in the report of this Proposition, except that –

  1. on page 5 of the report in the "Environment" section –

before the word "environment" there should be inserted the words "urban, rural and marine environment"; and

after the word "purposefully" there should be inserted the words "and fairly.";

  1. on page 6 of the report in the "A commitment to partnership" section after the word "with the" there should be inserted the words "Parishes,";
  2. on page 7 of the report in the "Quality of Life section, after the word "housing" there should be inserted the words "open space";
  3. on page 13, Annex 1, in the "Children and Families" section after the third paragraph there should be inserted a new paragraph as follows –

"We will provide safe walking and cycling facilities to allow children to walk and cycle to school, thereby increasing their health, fitness and independent mobility and reducing the impact of the school run' on the environment.";

"By working together with the Parishes, we will provide safe, and where achievable segregated, routes for walkers and cyclists by reallocating road space around the Island and within the Town area to encourage active travel."; and

  1. in the penultimate paragraph after the word "infrastructure" there should be inserted the words "including tree planting and the provision of green spaces,";
  1. on page 15 of the report in the "Community" section, after the second paragraph there should be inserted the following new paragraph –

"We will continue to work towards ensuring that the services and facilities provided by the Government are accessible and that the government departments have access and inclusion plans in place so that all people are treated equitably.";

  1. noting the aspects important to Islanders as indicated by the Future Jersey consultation, on page 17 of the report, the words "The table over the page presents some of the key indicators we will use" should be substituted with the following –

"The Council of Ministers will continue to strive to achieve the long-term vision of Future Jersey and work towards delivering the ten desired community outcomes arising from it:

For sub-paragraphs (ii) to (v), substitute the following sub-paragraph –

- actively promote and action the disinvestment from fossil fuel linked investments from Jersey linked businesses;

- adopt a policy of opposing investment in fracking; and,

- enable Jersey as a pioneer and global leader in sustainable finance and introduce the legislation required for sustainable finance.".
