Road Traffic (Public Parking Places) (Amendment No. 17) (Jersey) Order 2022. Minister for Infrastructure.

This Order amends the Road Traffic (Public Parking Places) (Jersey) Order 2006 to provide for a temporary Shopper Zone on level 2 of the Pier Road Car Park in St. Helier . The changes come into effect on the day after the Order is made, and cease to have effect at midnight on 31st July 2023.

This Order comes into force on the day after it is made.

The Order was made on 22nd November 2022 and came into force on 23rd November 2022.

Control of Housing and Work (Fees) (Amendment No. 5) (Jersey) Order 2022. Chief Minister.

This Order amends the Control of Housing and Work (Fees) (Jersey) Order 2013 to increase, by 2.5% in each case, fees in relation to applications for registration cards, consent to acquire land, business licences, non-resident trading licences and non-resident hawker's licences, and annual charges in respect of Licensed persons and Registered persons. The increases come into effect on 1st January 2023.

The Order was made on 25th November 2022 and comes into force on 1st January 2023.

Infrastructure (Driver and Vehicle Standards – 2023 Fees) (Jersey) Order 2022.

Minister for Infrastructure.

This Order increases certain fees charged by Driver and Vehicle Standards, by approximately 2.5%. It also increases the fee charged by the provider of the compulsory basic training course by 8.2%, in line with contractual arrangements.

The majority of the fees increased by this Order were previously increased with effect from 1st January 2022. The fees under the Road Traffic (Periodic Technical Inspections – Fees) (Jersey) Order 2019 have not previously been increased.

This Order comes into force on 1st January 2023.

The Order was made on 29th November 2022 and comes into force on 1st January 2023.

Motor Vehicles (Driving Licences) (Amendment No. 18) (Jersey) Order 2022. Minister for Infrastructure.

This Order amends the Motor Vehicles (Driving Licences) (Jersey) Order 2003 ("2003 Order") in 2 respects: (a) by broadening the evidence which may be acceptable to the Inspector of Motor Traffic ("Inspector") before a person takes a driving theory test or a driving practical test and (b) by extending the list of countries issuing driving licences that may be exchanged for a Jersey driving licence.

Article 1 provides that this Order amends the Motor Vehicles (Driving Licences) (Jersey) Order 2003.

Article 2 amends the 2003 Order so that if an applicant for a driving theory test is unable to meet the current requirement to produce a driving licence authorising the applicant to drive the vehicle in which the practical test will take place, the Inspector may accept any evidence that the Inspector considers satisfactory.

Article 3 amends the 2003 Order so an applicant for a driving practical test is no longer required to produce an insurance certificate for the vehicle in which the test is to take place. Instead, the applicant must sign a declaration, with the examiner present, that such an insurance policy is in force. A further amendment is made by Article 3 so that if the applicant is unable to meet the current requirement to produce a certificate showing that the applicant has successfully passed the theory test, the Inspector may accept any evidence that the Inspector finds satisfactory.

Article 4 amends how categories of vehicle in Jersey are specified to make clear that a category which includes a "+" sign may be shown with or without the "+" sign. This is to ensure consistency with how vehicle categories are shown in Jersey driving licences and in Schedule 5.

Article 5 amends Schedule 5 to the 2003 Order by extending the list of countries issuing driving licences that may be exchanged for a Jersey driving licence to include the Cayman Islands, United Arab Emirates, Taiwan, Ukraine, and North Macedonia. Article 5 also amends Schedule 5 by removing some drafting inconsistencies and references to driving licences that are no longer in use.

Article 6 sets out the title of this Order and provides for it to come into force 7 days after it is made. The Order was made on 29th November 2022 and came into force on 6th December 2022.

This Order amends the Road Works (Permit Fees) (Jersey) Order 2019 to increase, by 2.5%, the fees required for a permit to carry out road works. These fees were last amended with effect from 1st January 2022.

This Order comes into force on 1st January 2023.

Long-Term Care Services (Health and Social Services Charges) (Amendment No. 10) (Jersey) Order 2022. Minister for Health and Social Services.

This Order amends the Long-Term Care Services (Health and Social Services Charges) (Jersey) Order 2014 to increase, by approximately 12%, the charges specified in that Order for care services provided in a care home or group home.

The charges specified for each level of long-term care services have been calculated by adding the rate for long-term care benefit for the equivalent level of standard care, to the costs of living in an approved home, excluding incidental expenses. The rate for long-term care benefit is prescribed in Article 8 of the Long- Term Care (Benefits) (Jersey) Order 2014 (the "Benefits Order"), and the costs of living in an approved home are prescribed in Article 9(c) of the Benefits Order, and both are to be uprated for 2023.

This Order comes into force on 1st January 2023.

The Order was made on 2nd December 2022 and comes into force on 1st January 2023.

Long-Term Care (Benefits) (Amendment No. 11) (Jersey) Order 2022. Minister for Social Security.

This Order amends the Long-Term Care (Benefits) (Jersey) Order 2014 to increase –

the rates of long-term care benefit for weekly standard care costs for long-term care (specified in Article 8 of that Order), by approximately 12% (Article 2);

the amounts that a person must pay towards the weekly costs of living in an approved home and for incidental expenses (specified in Article 9 of that Order), by approximately 10.4% (Article 3);

the amounts that a person must pay towards the person's standard care costs before the person qualifies to receive a long-term care benefit for standard care costs (specified in Article 10 of that Order), by approximately 12% (Article 4);

the amount that may be loaned to a person to enable the person to pay the costs of living in an approved home (specified in Article 12 of that Order), by approximately 10.4% (Article 5).

The Order comes into force on 1st January 2023.

THE STATES are asked to decide whether they are of opinion –

to receive the Government Plan 2023–2026 specified in Article 9(1) of the Public Finances (Jersey) Law 2019 ("the Law") and specifically –

  1. to approve the estimate of total States income to be paid into the Consolidated Fund in 2023 as set out in Appendix 2 – Summary Table 1 to the Report, which is inclusive of the proposed taxation and impôts duties changes outlined in the Government Plan, in line with Article 9(2)(a) of the Law;
  1. to approve the proposed Changes to Approval for financing/borrowing for 2023, as shown in Appendix 2 – Summary Table 2 to the Report, which may be obtained by the Minister for Treasury and Resources, as and when required, in line with Article 9 (2)(c) of the Law, of up to those revised approvals;
  1. to approve the transfers from one States fund to another for 2023 of up to and including the amounts set in Appendix 2 – Summary Table 3 in line with Article 9(2)(b) of the Law;
  1. to approve each major project that is to be started or continued in 2023 and the total cost of each such project and any amendments to the proposed total cost of a major project under a previously approved Government Plan, in line with Article 9(2)(d), (e) and (f) of the Law and as set out in Appendix 2 – Summary Table 4 to the Report;
  1. to approve the proposed amount to be appropriated from the Consolidated Fund for 2023, for each Head of Expenditure, being gross expenditure less estimated income (if any), in line with Articles 9(2)(g), 10(1) and 10(2) of the Law, and set out in Appendix 2 – Summary Tables 5(i) and (ii) of the Report;
  1. to approve the estimated income, being estimated gross income less expenditure, that each States trading operation will pay into its trading fund in 2023 in line with Article 9(2)(h) of the Law and set out in Appendix 2 – Summary Table 6 to the Report;
  1. to approve the proposed amount to be appropriated from each States trading operation's trading fund for 2023 for each head of expenditure in line with Article 9(2)(i) of the Law and set out in Appendix 2 – Summary Table 7 to the Report;
  1. to approve the estimated income and expenditure proposals for the Climate Emergency Fund for 2023 as set out in Appendix 2 – Summary Table 8 to the Report; and
  1. to approve, in accordance with Article 9(1) of the Law, the Government Plan 2023-2026, as set out at Appendix 3 to the Report.

Deputy R.J. Ward of St. Helier Central proposes an amendment to the Twenty-Sixth Amendment (P.97/2022 Amd.(26).Amd.):

"; the scheme will be covered by the Public Health and Safety (Rented Dwellings) (Jersey) Law 2018, which would apply to all rooms included in this scheme - the necessary legislative amendments will be put in place in 2023 to extend the Law to include where one or more individuals rent rooms in the same dwelling in which the owner resides, where the period of residency exceeds 30 days and there is some form of reward. The duties outlined in the Law and subordinate legislation apply to the owner. "Stamp Duty on immovable property

Stamp Duty is made payable on immovable property upon the discharge of a will in line with Item 46 of Schedule 1 (3) of the Stamp Duty and Fees (Jersey) Law 1998, made payable on the net value of immovable property at the time of death of the Testator. The current proportioned Stamp Duty rates on immovable property range from £250 to £429,500 on market value bands ranging from £50,000 to £6,000,000. In appraising the current Stamp Duty rate against market values on immovable properties it has been proposed that the Stamp Duty rates remain disproportionately low to immovable property market values.

To ensure the broadening of revenue raising streams, Stamp Duty on immovable property upon the discharge of a will shall be increased, no later than 1st January 2024, by raising the Stamp Duty rate bands by one-third in addition to a 0.5

percent increase to the existing proportioned charges."

"Enhanced capital allowances

Currently businesses are able, under part 12A of the Income tax (Jersey) Law 1961, to claim capital allowances on qualifying capital expenditure to offset against allowable profits at a rate set at 25% per annum on a reducing balance basis.

From 1st January 2024 a new capital allowance will be introduced for small and medium sized businesses, allowing them to offset 100% of capital expenditure for investment in the fiscal year that it is incurred."

 

The Council of Ministers propose an amendment to the Thirteenth Amendment (P.97/2022 Amd.(13).Amd.): 1 PAGE 2 –

Delete the paragraph that begins "From 1st January 2024" and insert the words "As part of the 2024 Budget, which will be delivered in 2023 and focus on innovation and enterprise, Ministers will consider a range of measures to encourage and stimulate investment, including the case for increasing the rate for capital allowances available to businesses that make qualifying capital purchases."

"Residential Land Withholding Tax

Residential Land Withholding Tax ("RLWT") is a tax paid by offshore property owners (those who own property in Jersey but are not resident) who sell their residential property.

From 1st January 2024 RLWT will be introduced at a rate of 30% of the gross sale proceeds of offshore property holders, with the rate increasing to 50% from 1st January 2025.

Amendment is proposed.

This will encourage non-resident investors to divest of their Jersey property and leave the Jersey property market prior to this date. By selling their property by the end of 2023 they will avoid having to pay RLWT in the future when selling their Jersey investments. The aim of RLWT will be to act as a deterrent for non-resident investors to continue to beneficially own Jersey residential properties."

"This Head of Expenditure is also expected to be used to secure sites relating to a new primary school on either the Gas Place or the former Play.com site (BOA Warehouse), with a rapid review of both options to be brought to the Assembly within 100 days. The school would be either set in an extension of or adjacent to the Millennium Town Park".

 

The Connétable of St. Helier proposes a second amendment to the Twenty-First Amendment (P.97/2022 Amd.(21).Amd.(2)):

The Council of Ministers propose an amendment to the Sixth Amendment (P.97/2022 Amd.(6).Amd.): 1 PAGE 2, PARAGRAPH 1 –

For the words "including the design and implementation of" substitute the words "including the provision of" and after the words "walking and cycling routes" delete the remaining words.

The States will then consider the draft Finance (2023 Budget) (Jersey) Law 202- (P.102/2022) in order to give effect to the taxation decisions taken above.

The Minister will propose the principles of the draft. Debate and vote in the usual way. The Minister will then propose the Articles, which are debated and voted on in the usual way. Draft then proposed and debated in Third Reading.
