Note: Because of the requirement for a three-week lodging period, the minimum lodging period of the proposition of Deputy L.J. Sanctions and Asset-Freezing (Amendment of Law and Order No. 2) (Jersey) Order 2023.

This Order amends the Sanctions and Asset-Freezing (Jersey) Law 2019 (the "Sanctions Law") and the Sanctions and Asset-Freezing (Implementation of External Sanctions) (Jersey) Order 2021 (the "Sanctions Order").

Part 1 – amendment of the Sanctions Law

Article 1 amends Article 2A of the Sanctions Law, which defines what is meant by the terms "owned", "held", "controlled", "directly" and "indirectly" for the purposes of the Sanctions Law.

Article 2A(4) to (8) defines when a person who is not an individual ("C") is owned, held or controlled directly or indirectly by another person ("P"). Before the amendment made by this Order, that is when one or more of 3 conditions is satisfied.

The first condition is that P is the holding body, or beneficial owner, of C.

The second condition is that P directly or indirectly holds more than 50% of the shares in C or more than 50% of the voting rights in C, or that P holds the right directly or indirectly to appoint or remove a majority of the board of directors of C.

The third condition is that it is reasonable to expect that P can secure, in most cases or in significant respects, that the affairs of C are conducted in accordance with P's wishes.

This Order removes the first condition. Part 2 – amendment of the Sanctions Order

Articles 3 to 6 amend the Sanctions Order in relation to UK sanctions on Russia and the Republic of Belarus, by making further provision about the automatic effect of UK general licences. A general licence allows a person to do something which is otherwise prohibited by the Sanctions Order or the Sanctions Law.

Russia

Paragraph 4(2) of Schedule 3 to the Sanctions Order provides that, if the UK grants a general licence under the UK's Russia (Sanctions) (EU Exit) Regulations 2019 (S.I. 2019/855, as amended, the "UK Russia Regulations"), then that general licence has automatic effect in Jersey. The Minister can grant a general licence that expressly modifies or disapplies a UK general licence. The Minister can also disapply a UK general licence altogether, without making any replacement, by publicising a notice in the same way that notices of revocation of Jersey general licences are publicised.

But a UK general licence has automatic effect under paragraph 4(2) only if it does not relate solely to asset- freeze provisions in the UK Russia Regulations, and only in relation to an act which would otherwise be an offence under Article 4 of the Sanctions Order (that is, an offence under a provision which is not an asset-freeze provision).

Amendments made by this Order provide for UK general licences granted under the UK Russia Regulations to have automatic effect in Jersey without the limitations described in the previous paragraph.

Belarus

Amendments made by this Order provide that, if the UK grants a general licence under the UK's Republic of Belarus (Sanctions) (EU Exit) Regulations 2019 (S.I. 2019/600, as amended, the "UK Belarus Regulations"), then that general licence has automatic effect in Jersey. The effect of these amendments is to replicate, for general licences under the UK Belarus Regulations, the amended provisions described above in relation to general licences under the UK Russia Regulations.

This Part also makes minor consequential changes to the Sanctions Order.

Part 3 – final provisions

Article 7 gives the name of the Order and provides that it comes into force 7 days after it is made.

States of Jersey (Transfer of Justice Functions – Chief Minister to Justice and Home Affairs) Order 2023. Chief Minister.

This Order –

  1. renames the Minister for Home Affairs as the Minister for Justice and Home Affairs and makes amendments to legislation consequential on that renaming; and
  2. amends legislation to transfer statutory functions in relation to justice to the Minister for Justice and Home Affairs from the Chief Minister.

Functions under the following legislation are transferred to the Minister for Justice and Home Affairs from the Chief Minister –

Access to Justice (Jersey) Law 2019;

Criminal Procedure (Jersey) Law 2018;

The Law Society of Jersey Law 2005 (although the power to amend by Order the definition of "limited liability partnership" in this Law will remain with the Chief Minister).

Social Security (Incapacity Benefits – Phased Return to Work) (Amendment) (Jersey) Order 2023. Minister for Social Security.

This Order amends the Social Security (Incapacity Benefits) (Jersey) Order 2004 to provide that a day is to be treated as a day of incapacity for work if a person undertakes activity that is part of an agreed plan to assist with the person's return to work. The Order comes into force 7 days after it is made.

Control of Housing and Work (Temporary Exemption – Amendment No. 4) (Jersey) Order 2023.

Planning and Building (Special Development – Haut du Mont) (Jersey) Order 2023. Minister for the Environment.

The Planning and Building (Special Development – Haut du Mont) (Jersey) Order 2023 is made by the Minister for the Environment under Articles 8 and 124 of the Planning and Building (Jersey) Law 2002 ("the Law"), and grants planning permission for the demolition of the relevant property at Haut du Mont, Pier Road, St. Helier . The developer, supported by the Haut du Mont Recovery Coordinating Group which was established by the Chief Minister following the incident on 10th December 2022, submitted an application to the Minister on 12th April 2023 for the making of a Special Development Order to grant this planning permission, and submitted supporting information on 23rd May 2023. This Order does not grant planning permission for development of the site following demolition of the relevant property, an application under Article 9 of the Law will be required.

Article 1 contains definitions: "demolition" has the meaning given in Article 3; "developer" means Andium Homes Limited; "relevant property" means the apartment buildings on the site containing a total of 9 residential units; and "site" means the land at Haut du Mont, Pier Road, St. Helier , indicated with cross- hatching on the plan in the Schedule.

Article 2 grants planning permission for demolition of the relevant property, in consideration of the exceptional circumstances surrounding the incident at Haut du Mont on 10th December 2022, and the resultant loss of life and extensive damage to the property.

Article 3 provides that the developer must ensure that demolition of the relevant property does not commence until notified by the Minister in writing of the date on or after which demolition may commence, and must ensure completion of the demolition within 6 weeks, subject to extension up to 12 weeks if completion of the demolition within 6 weeks is not possible. "Demolition" is defined as demolition of the relevant property and related structures, removal of all associated building materials and securing of the site, in accordance with Ministerial guidelines.

Article 4 set outs the conditions subject to which planning permission is granted. The developer must, within 6 months, submit to the Minister a detailed proposal regarding the development of the site and a detailed proposal regarding the development of residential units at another location to replace demolished units, and ensure compliance with a waste management plan for the site approved by the Chief Officer.

Article 5 provides that nothing in the Order exempts the developer or any other person from compliance with Building Bye-laws made under the Law or any other applicable enactment.

Article 6 gives the citation, and provides that the Order comes into force 7 days after it is made. The Order was made on 21st September 2023 and came into force on 28th September 2023.

Road Traffic (Disabled Persons) (Badges for Motor Vehicles) (Amendment No. 3) (Jersey) Order 2023. Minister for Infrastructure.

This Order amends the Road Traffic (Disabled Persons) (Badges for Motor Vehicles) (Jersey) Order 1982 (the "1982 Order") by updating Article 3 (description of disabled persons) of the 1982 Order to correct a reference to the Jersey Blind Society Incorporated to EYECAN and to make that Article gender silent in line with modern drafting style.

This Order amends the Road Traffic (Disabled Persons) (Parking) (Jersey) Order 2002 by creating new parking places for disabled persons – one in St. Helier and 2 in Grouville .

Road Traffic ( Grouville ) (Amendment No. 11) (Jersey) Order 2023. Minister for Infrastructure.

This Order amends the Road Traffic ( Grouville ) (Jersey) Order 2002 (the "2002 Order"). Article 1 provides that the Order amends the 2002 Order.

Article 2 amends Schedule 1 by creating an exemption to the one-way traffic route on La Sente Brée for patient transport vehicles and ambulances that are leaving The Hollies Day Centre.

Article 3 amends Schedule 2 to prohibit waiting on lengths of La Rue Hilgrove and La Sente Brée. Article 4 amends Schedule 6 to add a 3-hour parking disc restriction on a length of La Rue Hilgrove. Article 5 introduces the Schedule that contains minor housekeeping amendments.

Article 6 gives the citation and provides that this Order comes into force 7 days after it is made.

introduce a new fee for applications in respect of ministers of religion. The fee for those types of applicants previously fell within the category described in row 7 of the table.

remove the fee entry in the table for the dependents of people with a work permit under row 5 that is to be or has been extended for a further period. This fee is no longer relevant.

clarify that the fee in row 7 of the table applies to work permit holders who do not fall within any of the categories of temporary work permit holders described in rows 4, 5 and 6 of the table.
