Immigration (Fees) (Amendment) (Jersey) Order 2023. Minister for Home Affairs.
This Order amends the Immigration (Fees) (Jersey) Order 2022. This Order increases the standard and express fees payable for passport applications. The express fees for applicants aged under 16 increase by 3.3%. All other standard and express fees increase by between 9.2% and 9.4% except temporary emergency passport fees, which remain unchanged. The fees were last increased with effect from 1st October 2019.
The Order was made on 3rd May 2023 and comes into force on 1st June 2023.

Road Traffic ( St. Helier ) (Amendment No. 39) (Jersey) Order 2023. Minister for Infrastructure.
This Order amends the Road Traffic ( St. Helier ) (Jersey) Order 1996 (the "1996 Order").
Article 2 amends Schedule 1 to add in Part 1 a route for one-way traffic and in Part 3 an exemption for buses.
Article 3 amends an entry in Schedule 4 relating to part of a road on which waiting is prohibited. Article 4 inserts a new entry into Schedule 5 where a road is closed to through traffic.
Article 5 makes various amendments to Schedule 6 to restrict vehicular access to pedestrian roads or provide for exemptions to those restrictions.
Article 6 amends an entry in Schedule 8 relating to part of a road which has a one-hour limit on paying parking places.
Article 7 amends Schedule 10, deleting one entry and adding one entry in Part 1, concerning parking a vehicle for the purposes of loading or unloading.
Article 8 amends an entry in Schedule 11 relating to the parking places for motor cycles and mopeds. Article 9 gives the citation and provides that the Order comes into force 7 days after it is made.
The Order was made on 5th May 2023 and came into force on 12th May 2023.

Planning and Building (Cannabis) (Miscellaneous Amendments) (Jersey) Order 2023. Minister for the Environment.
The Planning and Building (Cannabis) (Miscellaneous Amendments) (Jersey) Order 2023 amends the Planning and Building (Environmental Impact) (Jersey) Order 2006 and the Planning and Building (General Development) (Jersey) Order 2011, in respect of planning matters relating to the cultivation of cannabis and the production of cannabis products.
Article 1 amends Schedule 1 to the Planning and Building (Environmental Impact) (Jersey) Order 2006 to include within the list of developments for which an environmental impact assessment is required the construction, development or installation of a building, or the change of use of a building (in whole or in part), for the purpose of cultivation of plants of the genus Cannabis or for the production of products including any part of, or derivative from, plants of the genus Cannabis.
Article 2 amends the Planning and Building (General Development) (Jersey) Order 2011. In Schedule 1 (permitted development), Class AA in Part 3 is amended to exclude development of a building for the cultivation of plants of the genus Cannabis or the production of products including any part of, or derivative from, plants of the genus Cannabis, and alterations to enable or facilitate those purposes, so that an application for planning permission would be required in every such case. In Schedule 2 (use classes), Class D is replaced to exclude from general agricultural purposes the purpose of cultivation of plants of the genus Cannabis, or the production of products including any part of, or derivative from, plants of the genus Cannabis, so that planning permission would be required for such use.
Article 3 gives the citation and provides for commencement 7 days after the Order is made. The Order was made on 10th May 2023 and came into force on 17th May 2023.

Financial Services (Disclosure and Provision of Information – Person with Standing) (Jersey) Order 2023.

The Financial Services (Disclosure and Provision of Information – Person with Standing) (Jersey) Order 2023 prescribes that a creditor of an entity is a "person with standing" for the purposes of Article 19(9) of the Financial Services (Disclosure and Provision of Information) (Jersey) Law 2020 (the "Law").
Under Article 19 of the Law, a person with standing may apply to the Royal Court for a declaration that the dissolution of an entity under Article 16(5) of the Law is void. Persons with standing include the entity itself, a significant person of the entity, a nominated person for the entity, and the Attorney General. Article 2 of this Order provides, under Article 19(9)(e) of the Law, that a creditor of an entity dissolved under Article 16(5) of the Law is also a person with standing.
Article 3 provides that, before making an application to the Royal Court under Article 19 of the Law, the creditor must notify the registrar of companies that the application is to be made.
Article 4 gives the citation and provides that the Order will commence 7 days after it is made. The Order was made on 12th May 2023 and came into force on 19th May 2023.

This Order removes South Africa from the list of jurisdictions in the Schedule to the Proceeds of Crime (Cannabis Exemption – List of Jurisdictions) (Jersey) Order 2021 to reflect the decision of the Financial Action Task Force (FATF) of 24 February 2023 to add South Africa to its list of jurisdictions under increased monitoring.
This Order comes into force 7 days after it is made.

"With reference to the Chief Minister's letter to the Corporate Services Scrutiny Panel dated 20th April 2023, will the Chief Minister provide the following information –
- who were the members of Our Hospital Political Oversight Group (OHPOG') on 28th September 2022 and which of these were present at the OHPOG meeting on that date (the OHPOG Meeting'), other than the Chief Minister, the Constable of St. John and the Infrastructure Minister;
- what was her disagreement with the Infrastructure Minister on policy matters related to the OHPOG meeting to which the Chief Minister's letter to the Infrastructure Minister dated 7th October referred;
- a copy of the minutes of the OHPOG meeting and all other meetings of the OPHOG as reconstituted during her term of office;
- whether the Council of Ministers meeting on 28th September 2022, took place after the OHPOG Meeting and included discussion of any events that took place at the OHPOG;

"On 18th April 2023 the Minister confirmed that "36 teachers left in the 12 months to the end of March 2023, and this is 4.2 per cent of teacher workforce of 855.", contrasting with the response to a Freedom of Information request published 8th March 2023, which showed that 445 teachers have left the profession over the period 2019 to 2022, an average of 111.25 of teachers per year; further to these reported figures, will the Minister advise –
- whether it is expected that a similar number of teachers will leave the profession in 2023;
- whether the average leaving rate between 2019 and 2022 was 12.54%, which is above the average leaving rate for general States of Jersey employees and significantly above the 4.2% stated for the 12 months to March 2023; and
- any disparities identified between the figure provided in the Assembly and the Freedom of Information response?"

"With reference to Table 5 of a Freedom of Information request, published 8th March 2023, which shows a pattern of female teaching staff leaving the profession in higher numbers compared to their male counterparts, particularly in the 40 to 59 age group, will the Minister advise –
- what reasons she gives for this pattern;
- what research or dialogue has been, or is due to be, undertaken to understand the loss of female teaching staff; and
- whether those replacing these staff members will reflect the age and demographic lost and, if not, whether she can provide information on the demographics of the replacement staff?"

In accordance with Standing Order 104A, a time limit of 15 minutes applies to speeches made during debate, unless discretion has been exercised to allow for a longer, or shorter, time limit. No time limit applies to either speech made by the proposer.
Discretion is exercised by the Presiding Officer in accordance with guidance issued by the Bailiff , following consultation with the Privileges and Procedures Committee. The current guidance was presented to the States in the report Time Limits on Speeches in Debates: Guidance on the Exercise of Discretion' (R.3/2021). The report states that discretion may be exercised to allow for a longer speech than 15 minutes where the member speaking is designated as the main respondent' to the debate.
