Plant Health (Phytosanitary Certificates and UK Plant Passports) (Jersey) Amendment Order 2024. Minister for the Environment.

This Order amends the table in the Schedule to the Plant Health (Phytosanitary Certificates and UK Plant Passports) (Jersey) Order 2020 (the "2020 Order") to remove the row relating to the pest  Erwinia amylovora (ERWIAM), listed in column (2) of the table.

Plants and plant products (listed in the corresponding entry in column (1) of the table) susceptible to infection by Erwinia amylovora (ERWIAM) are no longer subject to the general requirements of the 2020 Order or the special requirements in column (3) of the table.

This Order comes into force 7 days after it is made.

The Order was made on 9th December 2024 and came into force on 16th December 2024.

Multinational Corporate Income Tax (Chargeable MNE Group – Minimum Threshold Amount) (Jersey) Order 2024.

Minister for Treasury and Resources.

The Multinational Corporate Income Tax (Chargeable MNE Group – Minimum Threshold Amount) (Jersey) Order 2024 specifies the "minimum threshold amount" for the purpose of Article 5(4) of the Multinational Corporate Income Tax (Jersey) Law 202- (the "MCIT Law").

Article 5 of the MCIT Law provides that a large multinational enterprise group to which that Law applies (an "MNE group") is chargeable to tax under that Law unless its Jersey income does not meet certain minimum financial thresholds and it makes an election under Article 5. An MNE group that is not a chargeable MNE group will be subject to income tax under the Income Tax (Jersey) Law 1961 (the "ITL 1961"). There are 2 alternative minimum financial thresholds, and this Order specifies the minimum threshold amount for the purpose of 1 of them (the other is provided for under Article 5(3) of the MCIT Law).

The minimum threshold amount is £100,000.

This Order comes into force on 1st January 2025, which is the same day on which the MCIT Law comes into force.

The Order was made on 10th December 2024 and came into force on 1st January 2025.

Environment (2025 Miscellaneous Fees) (Jersey) Amendment Order 2024. Minister for the Environment.

This Order increases the following prescribed fees and charges by approximately 2.5%, with 1 exception –

  1. the fee to accompany an application for a licence under the Food Safety (Ice-Cream Stalls etc.) (Jersey) Order 1969;
  2. the fee to accompany a complaint made under the High Hedges (Jersey) Law 2008;
  3. fees to accompany certain applications and notices of appeal under the Planning and Building (Jersey) Law 2002;
  1. fees payable in respect of certain applications under the Waste Management (Jersey) Law 2005 and fees payable periodically by licensees or registered persons under that Law;
  2. annual charges payable under the Water Resources (Jersey) Law 2007 in respect of a water resources licence.

The exception is the fee to accompany a notice of appeal in cases specified in item 8D of the table in Schedule 3 to the Planning and Building (Fees) (Jersey) Order 2008 (appeal against the service of a notice requiring action including an enforcement notice). The fee is increased from £118.30 to £609.40.

The fees and charges were last increased with effect from 1st January 2024. These increases come into effect on 1st January 2025.

Social Security Law (Parental Allowance and Death Grant) Amendment (Jersey) Commencement Order 2024.

Minister for Social Security.

This Order brings the Social Security Law (Parental Allowance and Death Grant) (Jersey) Amendment Regulations 2024 into force on 16 December 2024. Those Regulations amend Article 22 (entitlement to parental allowance) and Article 26 (death grant) of the Social Security (Jersey) Law 1974.

The Order was made on 13th December 2024 and came into force on the same day.

Social Security (Death Grant and Claims and Payments) (Jersey) Amendment Order 2024. Minister for Social Security.

This Order amends the Social Security (Death Grant) (Jersey) Order 1974 and the Social Security (Claims and Payments) (Jersey) Order 1974.

Article 1 replaces Article 3 (children) of the Social Security (Death Grant) (Jersey) Order 1974 to provide that a death grant is payable in respect of a stillborn child.

Article 2 amends Article 7 (information to be given when making a claim for benefit) of the Social Security (Claims and Payments) (Jersey) Order 1974 to provide that, when making a claim for a death grant in respect of a stillborn child, a stillbirth certificate must be provided.

Article 3 gives the citation and provides that this Order comes into force on the same day as the Social Security Law (Parental Allowance and Death Grant) (Jersey) Amendment Regulations 2024.

The Order was made on 13th December 2024 and came into force on 16th December 2024.

Social Security (Parental Benefit) (Jersey) Amendment Order 2024. Minister for Social Security.

This Order amends the Social Security (Parental Benefit) (Jersey) Order 2020 (the "principal Order") because of the insertion of new Article 22B (additional period for which parental allowance is payable – child requiring urgent medical care) into the Social Security (Jersey) Law 1974 (the "Law") by the Social Security Law (Parental Allowance and Death Grant) (Jersey) Amendment Regulations 2024 (the "Amendment Regulations").

Article 1 states that this Order amends the principal Order.

Article 2 makes some minor amendments consequential on the amendment of Article 22 (entitlement to parental allowance) and the insertion of Article 22A (period for which parental allowance is payable to a parent) into the Law by the Amendment Regulations.

Article 3 inserts new Article 7A, the effect of which is to trigger the payment of additional weeks of parental allowance (calculated in accordance with Article 22B of the Law) if the child of a parent entitled to that allowance requires, in the first 28 days of life, urgent medical care in hospital for a period of 7 or more days.

Article 4 makes amendments to reflect the language used in Article 22C of the Law about the payment of the parental allowance for weeks specified by 2 nominated parents entitled to the allowance. The amendments also provide that, in the case of 2 parents, each parent's entitlement to the parental allowance is extended for an additional number of weeks if Article 22B of the Law applies, and the total period of 32 weeks for which the allowance is payable is also extended if Article 22B of the Law applies. An amendment is also made to clarify that a parental allowance is still payable in respect of a specified week in which a child is being looked after by the Minister for Children and Families, or in which a child has died.

Article 5 is a renumbering amendment. Article 6 removes a spent provision.

Article 7 gives the title by which this Order may be cited and for it to come into force immediately after the commencement of the Amendment Regulations.

The Order was made on 13th December 2024 and came into force on 16th December 2024.

Cremation (Fees) (Jersey) Amendment Order 2024. Minister for Health and Social Services.

This Order amends the Cremation (Fees) (Jersey) Order 2007 to increase the fee for cremating the remains of a person aged 18 or over from £828 to £848.70, an increase of 2.5%. The fee for cremating the remains of a person aged under 18 remains nil. The Order also increases the maximum fee that a registered medical practitioner may charge for completing the medical certificate required by Regulation 6(a) of the Cremation (Jersey) Regulations 1961 from £100 to £102.50, an increase of 2.5%.

The fees were last increased with effect from 1st January 2024.

The Order was made on 13th December 2024 and came into force on 1st January 2025.

Road Traffic (Public Parking Places) (Jersey) Amendment No. 2 Order 2024.

This Order amends the Road Traffic (Public Parking Places) (Jersey) Order 2006 (the "2006 Order"). Article 1 states that this Order amends the 2006 Order.

Article 2 amends the definition of "controlling body" in Article 1 of the 2006 Order (that is, the body responsible for parking places) to remove the reference to the Minister for Sustainable Economic Development as a controlling body.

Article 3 amends Article 5 of the 2006 Order to make clear in which public parking places a season ticket may be used in addition to other means of payment.

Article 4 amends Article 8B of the 2006 Order, which sets out the excess charges payable under an excess charge notice, to remove the entry relating to excess charge notices issued by the Minister for Sustainable Economic Development.

Article 5 amends the entries for Pier Road Car Park in Schedule 1 of the 2006 Order to include level 2 in the Shopper Zone and to include level 13 as a season ticket parking place. It also corrects the name of La Route du Nord Car Park.

Article 6 amends Schedule 2 of the 2006 Order to move the entry for La Route du Nord Car Park from Part 1 to Part 4, meaning that the maximum parking period for that parking place is a total of 12 hours in any continuous 24-hour period. It also corrects an error in Schedule 2.

Articles 7 and 8 make minor amendments to correct errors in Schedules 3 and 4 of the 2006 Order.

Articles 6, 7 and 8 also alter the presentation of the parking place codes in Schedules 2, 3 and 4 to list them according to the parishes in which they are situated. The order of the parishes in Schedules 2, 3 and 4 reflects the order of the parishes in Schedule 1.

Article 9 gives the name of this Order and states that it comes into force on 1st January 2025. The Order was signed on 17th December 2024 and came into force on 1st January 2025.

Misuse of Drugs (Licence Fees) (Jersey) Amendment Order 2024. Minister for Health and Social Services.

This Order amends the Misuse of Drugs (Licence Fees) (Jersey) Order 2020 (the "principal Order") to increase the licence application fees specified in the Schedule to the principal Order by approximately 13%. These fees have not been increased since the principal Order came into force in November 2020.

This Order comes into force on 1st January 2025.

The Order was signed on 17th December 2024 and came into force on 1st January 2025.

Road Traffic ( St. Helier ) (Jersey) Amendment Order 2024. Minister for Infrastructure.

This Order amends the Road Traffic ( St. Helier ) (Jersey) Order 1996 in relation to restrictions on turning, parking places and loading bays.

Article 2 and Article 3 delete, respectively, the redundant provisions of Article 4(4) and Schedule 2, Part 4, relating to compulsory left-hand turns from car parks.

Article 4 amends Schedule 8, Part 3B to remove the existing entry giving a 10-minute limit for parking on La Rue de L'Etau.

Article 5 amends and adds entries in Schedule 10, Part 1 relating to locations and periods of time during which loading and unloading is permitted on La Rue de L'Etau. The entry for Charles Street is also amended to extend loading and unloading permissions.

Article 6 gives the title of the Order and provides for it to come into force 7 days after it is made. The Order was made on 17th December 2024 and came into force on 24th December 2024.

Control of Housing and Work (Fees) (Jersey) Amendment Order 2024. Chief Minister.

This Order amends the Control of Housing and Work (Fees) (Jersey) Order 2013 to increase the fees payable under that Order. Fees payable by non-resident undertakings are increased by 4.9% to 5%. All other fees are increased by 2.1% to 2.5%. The fees were last increased from 1st January 2024.

The Order was made on 19th December 2024 and came into force on 1st January 2025.

Environment (Animals and Fisheries Fees) (Jersey) Amendment Order 2024. Minister for the Environment.

This Order amends various fees relating to licences, permits, certificates and other similar matters in animals and fisheries legislation. The fees are increased by amounts ranging from 0.9% to 2.5% and were last increased with effect from 1st March 2024.

The Order was made on 19th December 2024 and came into force on 1st January 2025.

Employment (Minimum Wage) (Jersey) Amendment Order 2024. Minister for Social Security.

This Order amends the Employment (Minimum Wage) (Jersey) Order 2007 to increase the hourly rate of the minimum wage from £11.64 to £13 (Article 2).

Article 3 increases the maximum monetary amounts that may be attributed to benefits in kind provided by an employer. If food and living accommodation are both provided, the amount is increased from £169.98 to £194.60 a week or from £24.28 to £27.80 a day.

If living accommodation is provided but food is not, the amount is increased from £127.54 to £146.02 a week or from £18.22 to £20.86 a day.

The Order was made on 19th December 2024 and comes into force on 1st April 2025.

Road Traffic ( St. Saviour and Disabled Persons Parking) (Jersey) Amendment Order 2024. Minister for Infrastructure.

This Order amends the Road Traffic (Disabled Persons) (Parking) (Jersey) Order 2002 and the Road Traffic ( St. Saviour ) (Jersey) Order 2000.

Article 1 amends the Road Traffic (Disabled Persons) (Parking) (Jersey) Order 2002 to provide a parking place in La Chasse Brunet for vehicles used by disabled persons.

Article 2 amends the Road Traffic ( St. Saviour ) (Jersey) Order 2000. It inserts a new Article 6B and Schedule 3B. These provisions state that the part of Elizabeth Street on which the entrance to St. Luke's School is situated (that is, Elizabeth Street from the junction with La Route du Fort to the junction with Dicq Road) is closed to traffic between 7.45 a.m. and 9.15 a.m. and between 2.00 p.m. and 3.30 p.m. on any day when the school is open to children. But these restrictions do not apply to vehicles driven by people who reasonably need vehicular access to premises on that part of Elizabeth Street, vehicles used by disabled people, emergency vehicles and bicycles. Of those vehicles, emergency vehicles and bicycles may enter that part of Elizabeth Street from either direction, but the rest may only enter and exit at the junction with Dicq Road.

Article 2 also imposes parking restrictions on Bagatelle Road, La Rue du Trot, and Wellington Road. Article 3 gives the name of the Order and provides for it to come into force on 6th January 2025. The Order was made on 24th December 2024 and came into force on 6th January 2025

Infrastructure (Driver and Vehicle Standards – 2025 Fees) (Jersey) Order 2024. Minister for Infrastructure.

This Order increases certain fees charged by Driver and Vehicle Standards, by between 1.74% and 2.5%.

Article 1 increases fees under the Motor Cars (Driving Instruction) (Jersey) Order 1982 for the examination and registration of driving instructors. Those fees were last increased with effect from 1st January 2024.

Article 2 increases fees relating to public service vehicles under the Motor Traffic (Public Service Vehicles) (Fees) (Jersey) Order 2008. The fee in Article 2(5)(c) of that Order was last increased with effect from 1 January 2023 and the others were last increased with effect from 1st January 2024.

Article 3 increases fees under the Motor Vehicles (Construction and Use) (Jersey) Order 1998. The fee in Article 121(1) of that Order has not been increased since the Order came into force in 1999, the fee in Article 2(7)(a) of that Order was last increased with effect from 1st January 2024 and the others were last increased with effect from 1st January 2023.

Article 4 increases the fees relating to the prescribed test under the Motor Vehicles (Driving Licences) (Jersey) Order 2003. Those fees were last increased with effect from 1st January 2024.

Article 5 increases fees relating to motor vehicle registration and trade licences under the Motor Vehicle Registration (General Provisions) (Jersey) Order 1993. The fee in paragraph 3(4) of Schedule 4A to that Order has not been increased since it was introduced in April 2019, one of the fees in paragraph 4(a) of Schedule 2 to that Order was last increased with effect from 1st January 2023, and the others were last increased with effect from 1st January 2024.

Article 6 increases the fees for an inspection under Article 78A of the Law, set out in Road Traffic (Periodic Technical Inspections – Fees) (Jersey) Order 2019. Those fees were last increased with effect from 1st January 2024.

Article 7 increases permit fees under the Road Works (Permit Fees) (Jersey) Order 2019. Those fees were last increased by around 7.5% with effect from 1st May 2024.

The Order was made on 24th December 2024 and came into force on 1st January 2025.
