Companies (General Provisions) (Amendment No. 6) (Jersey) Order 2022. Minister for External Relations and Financial Services
This Order amends the Companies (General Provisions) (Jersey) Order 2002 to prescribe new qualifications for the appointment, registration and supervision of liquidators; the minimum liquidated sum and the form of a demand for the sum of a debt due if a company is deemed unable to pay its debts.
Article 1 introduces the amendments to be made to the Companies (General Provisions) (Jersey) Order 2002.
Article 2 amends Article 7 of the Companies (General Provisions) (Jersey) Order 2002, which deals with the qualifications of liquidators, so that a person is only eligible for appointment as a liquidator of a company to which that Article applies if the person is registered as an approved liquidator and entered on the Register of Approved Liquidators by the Viscount. A person is not qualified to be registered as an approved liquidator and entered on the Register of Approved Liquidators unless the person is ordinarily resident in Jersey, is an individual who has the level of experience determined by the Viscount in writing and is licensed in the United Kingdom to act as an insolvency practitioner or is a member of the Association of Certified and Chartered Accountants, the Institute of Chartered Accountants of Ireland, the Institute of Chartered Accountants of England and Wales or the Institute of Chartered Accountants in Scotland. The person must also have in place a general bond of £250,000 plus a specific bond of between £5,000 and £5,000,000 for each appointment to protect against fraud and dishonesty by the liquidator.
Article 2 also amends Article 7 of the of the Companies (General Provisions) (Jersey) Order 2002 to allow an individual who is not ordinarily resident in Jersey but is otherwise qualified in accordance with new Article 7(2A)(b) and (c) to be appointed as a liquidator of a company and to be registered as a non-Jersey liquidator. The individual may only be appointed as a liquidator together with an individual who is registered as an approved liquidator and entered in the Register of Approved Liquidators.
Article 3 inserts new Articles 8, 9 and 9A of the Companies (General Provisions) (Jersey) Order 2002. New Article 8 provides for the investigation into the conduct of liquidators by the Viscount. New Article 9 provides for the prescribed minimum liquidated sum under Article 157A of the Companies (Jersey) Law 1991 to be £3,000. New Article 9A provides for the prescribed form of a statutory demand under Article 157A(2) of the Companies (Jersey) Law 1991 to be set out in the Schedule.
Article 4 provides for the insertion into the Schedule of Part 3 which contains the form for statutory demand.
Article 5 gives the name by which this Order may be cited as the Companies (General Provisions) (Amendment No. 6) (Jersey) Order 202- and it comes into force on the same day as the Companies (Amendment No. 8) (Jersey) Regulations 2022 come into force.
The Order was made on 25th February 2022 and came into force on 1st March 2022.

Emergency Powers and Planning (Medicines and Vaccines – Covid-19) (Sixth Period) (Jersey) Order 2022. Minister for Health and Social Services.
This Order provides for the continuation of relaxed controls on medicines to facilitate a plan for vaccination against Covid-19. It is the sixth such Order, the previous Orders being as follows –
- Emergency Powers and Planning (Medicines and Vaccines – Covid-19 and Influenza) (Fifth Period) (Jersey) Order 2021 (in force from 5th December 2021 to end of 4th March 2022);
- Emergency Powers and Planning (Medicines and Vaccines – Covid-19 and Influenza) (Fourth Period) (Jersey) Order 2021 (in force from 5th September 2021 to end of 4th December 2021);
- Emergency Powers and Planning (Medicines and Vaccines – Covid-19) (Third Period) (Jersey) Order 2021 (in force from 5th June 2021 to end of 4th September 2021);
- Emergency Powers and Planning (Medicines and Vaccines – Covid-19) (Jersey) Order 2021 (in force from 5th March 2021 to end of 4th June 2021);
- Emergency Powers and Planning (Medicines and Vaccines – Covid-19 and Influenza) (Jersey) Order 2020 (in force from 5th December 2020 to end of 4th March 2021).
The Order expires 3 months after it comes into force (under the Emergency Powers and Planning (Jersey) Law 1990 it cannot remain in force for longer unless renewed). As it comes into force on 5th March 2022 (to follow the expiry of the previous Order) it will therefore expire at the end of 4th June 2022.
The Order was made on 28th February 2022 and came into force on 5th March 2022.

In accordance with Standing Order 104A, a time limit of 15 minutes applies to speeches made during debate, unless discretion has been exercised to allow for a longer, or shorter, time limit. No time limit applies to either speech made by the proposer.
Discretion is exercised by the Presiding Officer in accordance with guidance issued by the Bailiff , following consultation with the Privileges and Procedures Committee. The current guidance was presented to the States in the report Time Limits on Speeches in Debates: Guidance on the Exercise of Discretion' (R.3/2021).
