Regulation of Care (Standards and Requirements) (Reinstatement of Covid-19 Modifications) (Jersey) Order 2021.

Minister for the Environment.

This Order reinstates the effect of Regulation 17A(1) to (5) (the "reinstated provisions") of the Regulation of Care (Standards and Requirements) (Jersey) Regulations 2018 (the "Regulations"). The reinstated provisions are Covid-19 related measures. If conditions are met, the reinstated provisions temporarily disapply certain requirements that would otherwise apply to a registered person under the Regulations, but with which the registered person cannot comply because of an outbreak of Covid-19. The requirements that may be disapplied include the requirement to ensure that every worker in a regulated activity is suitably qualified, skilled, competent and experienced for the duties to which the worker is assigned. The conditions that must be met before a requirement can be disapplied are that the registered person –

has put in place a plan to mitigate the effects of a shortage of suitably qualified workers caused by an outbreak of Covid-19 in Jersey; and

has reasonable grounds for declaring that, due to the outbreak and despite the plan, the registered person is unable to comply with the requirement.

This Order comes into force on the day after it is made.

Sanctions and Asset-Freezing (Implementation of External Sanctions) (Amendment – Burundi) (Jersey) Order 2021.

This Order amends Schedule 1 to the Sanctions and Asset-Freezing (Implementation of External Sanctions) (Jersey) Order 2021, to implement in Jersey the sanctions in the Burundi (Sanctions) Regulations 2021 of the United Kingdom. Those Regulations repeal and replace the Burundi (Sanctions) (EU Exit) Regulations 2019 of the United Kingdom, which were already implemented by the Sanctions and Asset- Freezing (Implementation of External Sanctions) (Jersey) Order 2021. The amendments take effect from midnight between 13th and 14th December 2021.

The Order was made on 13th December 2021 and came into force on 14th December 2021.

Social Security (Class 1 Minimum Earnings Threshold) (Jersey) Order 2021. Minister for Social Security.

This Order specifies the Class 1 minimum earnings threshold for the purposes of Article 5(3)(b) of the Social Security (Jersey) Law 1974, as substituted by the Social Security (Amendment of Law – Minimum Earnings Threshold) (Jersey) Regulations 2021 (the "Amendment Regulations"). Under that provision (once the substitution provided for the Amendment Regulations has come into force), where a person's monthly earnings equal or exceed the "Class 1 minimum earnings threshold", and the other conditions of Article 5 are met, Class 1 contributions will be payable.

Article 1 provides that the Class 1 minimum earnings threshold is £438.

Article 2 gives the citation of the Order and provides that it will come into force on 1st January 2022 (on the commencement of the Amendment Regulations).

The Order was made on 13th December 2021 and came into force on 1st January 2022.

Social Security (Collection of Class 1 and Class 2 Contributions) (Amendment) (Jersey) Order 2021. Minister for Social Security.

This Order amends the Social Security (Collection of Class 1 and Class 2 Contributions) (Jersey) Order 2013 (the "2013 Order").

Article 1 amends Article 4 of the 2013 Order, which requires employers to deliver contribution schedules to the Comptroller of Revenue. The amendments alter the requirement so that contribution schedules are delivered on a monthly, rather than on a quarterly, basis.

Article 2 gives the citation of the Order and provides that it will come into force on 1st January 2022. The Order was made on 13th December 2021 and came into force on 1st January 2022.

Control of Housing and Work (Fees) (Amendment No. 4) (Jersey) Order 2021.

This Order amends the Control of Housing and Work (Fees) (Jersey) Order 2013 to increase, by 10% in each case, certain fees in relation to applications for registration cards, business licences, non-resident trading licences and non-resident hawker's licences. The increases come into effect on 1st January 2022.

The Order was made on 15th December 2021 and came into force on 1st January 2022.

Nursing Homes (2022 Fees) (Jersey) Order 2021. Chief Minister.

This Order amends the Nursing Homes (General Provisions) (Jersey) Order 1995 to uprate, in line with inflation, the registration and annual fees to be paid under Articles 3 and 4 respectively of that 1995 Order. The fees will each increase by 2.5% on 1st January 2022, when this Order takes effect. (The fees were previously increased with effect from 1st January 2021.)

The Order was made on 20th December 2021 and came into force on 1st January 2022.

Marriage and Civil Partnership (Amendments – Fees) (Jersey) Order 2021. Minister for Home Affairs.

This Order amends fees prescribed by the Civil Partnership (Forms, Registration and Fees) (Jersey) Order 2012 (the "Civil Partnership Order") and the Marriage and Civil Status (Jersey) Order 2018 (the "Marriage Order").

Most of the amended fees have been increased by 2.5%. The exceptions to this are:

The fee payable under the Civil Partnership Order for a certified copy of an entry in a book or register is increased from £20 to £30.75. The fee payable under the Civil Partnership Order for a search of indexes is increased from £20 per hour or part of an hour to £30.75 per hour or part of an hour. These increases bring the fees into line with the corresponding fees charged under the Marriage Order.

The fee payable under the Marriage Order to the Superintendent Registrar for an application for the approval of a location for the solemnization of a specified marriage is increased from £25 to £130. The fees payable to the Superintendent Registrar for an application for the approval of a location for the solemnization of marriage for 3 years and for an application for the renewal of an approval are each increased from £100 to £130. These increases are to reflect more accurately the costs of considering an application.

The fee payable under the Marriage Order for applying to convert a civil partnership to a marriage is increased from £0 to £205. The fee was set at £0 as an initial measure when the Marriage and Civil Status (Amendment No. 4) (Jersey) Law 2018 was enacted. It is now being set at the same rate as the fee for an application for notice of intended marriage.

The fee payable under the Marriage Order for the issue of a conversion declaration form is increased from £0 to £307.50. The fee was set at £0 as an initial measure when the Marriage and Civil Status (Amendment No. 4) (Jersey) Law 2018 was enacted. It is now being set at the same rate as the fee for the issue of a marriage schedule.

The new fees come into force on 1st January 2022.

The Order was made on 20th December 2021 and came into force on 1st January 2022.

Home Affairs (Fire and Rescue and Petroleum) (2022 Fees) (Jersey) Order 2021. Minister for Home Affairs.

The Home Affairs (Fire and Rescue and Petroleum) (2022 Fees) (Jersey) Order 2021 increases the fees payable under the Fire Precautions (Fees) (Jersey) Order 2010 by 2.4%, other than the fee payable for amendment of a certificate in respect of a change of owner of premises, which is reduced to £50. The Order also increases fees payable under the Fire and Rescue Service (Charges) (Jersey) Order 2012 by 1.7 to 2.4%, and fees payable under the Petroleum (Licensing) (Fees) (Jersey) Order 2012 by 1.8 to 2.5%. The fees were last increased as of 1st January 2021. The Order comes into force on 1st January 2022.

Social Security (Classification and Contributions) (Amendment) (Jersey) Order 2021. Minister for Social Security.

This Order amends the Social Security (Classification) (Jersey) Order 1974 (the "Classification Order") and the Social Security (Contributions) (Jersey) Order 1975 (the "Contributions Order").

Part 1 (Articles 1 to 3) amends the Classification Order (as provided for by Article 1).

Article 2 inserts a new Article 3A in the Classification Order, which provides that where a person is employed by 2 or more associated employers, but the amount of earnings from each of those employments (taken individually) is lower than the Class 1 minimum earnings threshold, the employers can agree that the person is to be treated for social security purposes as employed by only one of them (and the earnings are aggregated for those purposes accordingly). The Class 1 minimum earnings threshold is provided for by the Social Security (Class 1 Minimum Earnings Threshold) (Jersey) Order 2021 which will come into force on the same day as this amendment. This Article also makes a minor consequential amendment to the heading of Article 3 of the Classification Order.

Article 3 removes the special provision for certain categories of employment from Part 2 of Schedule 1 (persons treated as Class 2 insured persons). Paragraph (a) removes the special provision for employment as a sub-postmaster. Paragraph (b) removes the special provision for employment for less than 8 hours in a week. This change is connected with the amendments made by the Social Security (Amendment of Law – Minimum Earnings Threshold) (Jersey) Regulations 2021 (the "MET Regulations"), which replace Article 5(3)(b) of the Social Security (Jersey) Law 1974, with effect from 1st January 2022, so that the condition under that paragraph will in future operate by reference to the Class 1 minimum earnings threshold instead of by reference to a prescribed number of hours. Paragraph (c) removes the special provision for employment as an interviewer from Part 2 of Schedule 1 (persons treated as Class 2 insured persons).

Part 2 (Articles 4 and 5) includes a further minor amendment and the citation and commencement provisions.

Article 4 substitutes Article 8(1A) of the Contributions Order. That Article currently provides that the exception from liability to pay contributions for persons imprisoned or detained in custody does not apply where the person is undertaking paid work outside the prison, as part of a programme of rehabilitation, for more than the number of hours prescribed, for a week, under Article 5(3)(b) of the Social Security (Jersey) Law 1974. As noted above, the MET Regulations replace Article 5(3)(b) of that Law with effect from 1st January 2022, so that the condition will in future operate by reference to the Class 1 minimum earnings threshold instead of a prescribed number of hours. The amendment made by this draft Order brings the test for prisoners' liability to pay contributions in line with the new test under Article 5(3)(b).

Article 5 gives the citation of the Order and provides that it will come into force on 1st January 2022. The Order was made on 20th December 2021 and came into force on 1st January 2022.

This Order corrects an error in Article 3(a) of the Social Security (Television Licence Benefit – Income Threshold) (Jersey) Order 2021, which sets out how relevant total income is determined for the threshold in Regulation 6 of the Social Security (Television Licence Benefit) (Jersey) Regulations 2009. The amendment changes the amount to be used in the calculation for a couple's income from £27,170 to £26,170. The amendment comes into force 7 days after the Order is made.

Social Security (Contributions) (Covid-19) (Amendment No. 4) (Jersey) Order 2021. Minister for Social Security.

The Social Security (Contributions) (Covid-19) (Amendment No. 4) (Jersey) Order 2021 amends the Social Security (Contributions) (Covid-19) (Jersey) Order 2020 (the "principal Order") to extend the provisions of the principal Order for an additional two quarters. In particular –

Article 1 provides that this Order amends the principal Order.

Article 2 amends Article 1 of the principal Order, to define Quarter D 2021 as the period of 3 months beginning 1st October 2021, to define Quarter A 2022 as the period of 3 months beginning 1st January 2022, to define a "relevant Quarter" as any of Quarters A, B, D, A 2021, D 2021 or A 2022, and to remove a spent definition.

Article 3 amends Article 2 of the principal Order, to provide that an employer required to make a Class 1 contribution in respect of Quarter D 2021 or Quarter A 2022 may apply to defer payment of those contributions by up to 24 months.

Article 4 amends Article 3 of the principal Order, to provide that an insured person required to pay a Class 2 contribution in respect of Quarter D 2021 or Quarter A 2022 may apply to defer payment of those contributions by up to 24 months.

Article 5 amends Article 4 of the principal Order, to include Quarter D 2021 and Quarter A 2022 as quarters for which recovery of a relevant benefit may be made for any relevant benefit paid if a deferral is made under Article 3, and that the Minister may seek to recover survivor's benefit from the survivor of a person who makes a deferral under that Article 3.

Article 6 deletes Article 4A of the principal Order, which is a spent provision.

Article 7 gives the citation and provides that the Order comes into force 7 days after it is made. The Order was made on 20th December 2021 and came into force on 27th December 2021.

Covid-19 (Workplace – Thirtieth Extension) (Jersey) Order 2021. Minister for Health and Social Services.

This Order amends the Covid-19 (Workplace Restrictions) (Jersey) Order 2020, to extend the restriction period to end at the end of Monday 31st January 2022.

This Order comes into force on 1st January 2022.

The Order was made on 21st December 2021 and came into force 1st January 2022.

Infrastructure (Driver and Vehicle Standards – 2022 Fees) (Jersey) Order 2021. Minister for Infrastructure.

This Order increases certain fees charged by Driver and Vehicle Standards from 1st January 2022 by an average of approximately 2.5% (the fee increases being rounded down to the nearest 50p).

The Order was made on 21st December 2021 and came into force on 1st January 2022.

Road Works (Permit Fees) (Amendment) (Jersey) Order 2021. Minister for Infrastructure.

This Order amends the Road Works (Permit Fees) (Jersey) Order 2019 to increase the fees required for a permit to carry out road works by approximately 5%. The permit fees were last amended with effect from 1st January 2020. This Order comes into force on 1st January 2022.

Road Traffic (Public Parking Places - Charges) (Amendment No. 6) (Jersey) Order 2021. Minister for Infrastructure.

This Order amends the Road Traffic (Public Parking Places – Charges) (Jersey) Order 2017 so as to increase the charges for parking units and monthly season tickets by approximately 2.4%. The fees were last increased with effect from 1st March 2021. This Order comes into force on 1st February 2022.

Road Traffic (Parking) (General Provisions and Penalties) (Repeal) (Jersey) Order 2021. Minister for Infrastructure.

This Order repeals the Road Traffic (Parking) (General Provisions and Penalties) (Jersey) Order 2021. That Order would have come into force on 1st February 2022. This Order comes into force on 10th January 2022.

The Order was made on 21st December 2021 and came into force on 10th January 2022.

Environment (2022 Fees) (Jersey) Order 2021. Minister for the Environment.

This Order increases, with effect from 1st January 2022, fees charged under legislation relating to animals and veterinary matters, planning, plant health, sea fisheries, waste management and water resources. The fees have been increased from a year ago by up to 2.5% (subject to rounding).

The Order also removes fees under the Planning and Building (Fees) (Jersey) Order 2008 to the extent that they relate to the installation of a solar panel (or its repair or replacement) or the replacement of a fossil fuel boiler with a non-fossil fuel alternative.

The Order was made on 22nd December 2021 and came into force on 1st January 2022.

Covid-19 (Workplace Restrictions) (Amendment No. 15) (Jersey) Order 2021 Minister for Health and Social Services.

This Order amends the Covid-19 (Workplace Restrictions) (Jersey) Order 2020 to reintroduce requirements for visitors to, and workers in, indoor areas of workplaces to which the public have access, to wear masks (Articles 2 and 3). Before this change compulsory mask-wearing was limited to public transport vehicles and premises. The reintroduced restrictions do not apply to visitors to food and drink premises, nightclubs or any part of physical activity facilities and does not apply in churches and other religious venues except during funerals.

The various exceptions to the mask-wearing requirements are now consolidated into a single Article (Article 4). The new requirements apply from 4th January 2022.

The Order was made on 23rd December 2021 and came into force on 4th January 2022.

"Will the Minister advise whether a contract has been awarded with the aim of reducing the waiting list for cataract surgery, and if so, will he state –

  2. the number of patients requiring rehabilitation services on Plémont Ward at the General Hospital for the 12-month period after the of closure of Samarès Ward in May 2020, broken down by month;
  3. of the patients in (b), how many were provided with detailed care packages upon discharge from Plémont Ward ;
  4. following the relocation of rehabilitation services to Plémont Ward , how many individual appointments for care were made for patients with the following services in the subsequent 12 months –
