Telecommunications Law Amendment (Jersey) Commencement Order 2024. Minister for Sustainable Economic Development.
This Order brings the Telecommunications Law (Jersey) Amendment Regulations 2024 (the “Regulations”) partially into force on 1 October 2024.
The Regulations insert new Part 5A (Articles 24A to 24ZI and Schedules 1-3) into the Telecommunications (Jersey) Law 2002 (the “Law”).
In brief –
• Articles 24A to 24J relate to designated vendor directions. They enable the Minister for Sustainable Economic Development (the “Minister”) to designate vendors who supply goods, services or facilities to providers of public electronic communications networks (“PECN”) and providers of public electronic communications services (“PECS”), if the Minister considers the designation is necessary in the interests of the security of Jersey. The Minister may then issue a designated vendor direction to providers of PECN, providers of PECS and any person who makes associated facilities available for use in an electronic communications network or service, imposing requirements on them with respect to their use of the designated vendor’s goods, services or facilities.
• Schedule 1 contains compliance and enforcement provisions relating to designated vendor directions.
• Articles 24K to 24Z relate to security duties. They impose duties on the providers of PECN and PECS, requiring them to take steps to identify and mitigate the risks of security compromises occurring in relation to their PECN or PECS, and to take steps in response to any security compromise that occurs.
• Schedule 2 contains compliance and enforcement provisions relating to the security duties.
• Articles 24ZA to 24ZI are general provisions and provisions relating to both designated vendor directions and security duties. They include, for example, provisions about appeals and a provision enabling the Jersey Competition Regulatory Authority (the “JCRA”) to require information for the purposes of carrying out its functions under the Law.
• Schedule 3 contains compliance and enforcement provisions relating to the JCRA’s power to require information.
This Order commences provisions in the Regulations that –
• insert Articles 24A to 24J (the designated vendor provisions) and Schedule 1;
• insert Articles 24ZA to 24ZI (the general provisions) and Schedule 3; and
• make consequential amendments to the Law.
But this Order does not commence provisions in the Regulations that insert Articles 24K to 24Z (the security duties provisions), Schedule 2, or provisions in Articles 24A, 24ZA, 24ZC, 24ZF and 24ZI that only relate to the security duties provisions.
The Order was made on 16 September 2024 and came into force on the same day.

- detail the evidentiary basis underpinning the reduction in Marine Protected Areas from the draft MSP including any further research undertaken within these areas since the publication of the initial draft MSP;
- provide an itemised timetable for the further research as proposed in the MSP and the expected date of the research results;

“Further to the reduction in the GST de minimis level from £135 to £60 for overseas consumer purchasers that do not have GST charged at point of purchase, will the Minister provide information on –
- the total GST collected, broken down by month, from 1st July 2023 to date;
- the amount of time spent analysing the possible impact of reducing the GST de minimis level prior to implementation;
- the cost to develop the Customs and Excise System for the Administration of Revenue (CAESAR) in preparation for the reduction in the de minimis level;

“Further to the closure of the Jersey Recovery College (‘the Charity’), will the Minister advise –
- when his department became aware that there were financial problems at the Charity;

“Further to requests for traffic calming measures on Rue des Prés in St Saviour over the last two years, and his meeting with residents in April 2024, will the Minister –
- provide an update on what progress, if any, is being made on these measures;
- advise when residents can expect traffic calming measures to be installed;
- confirm what traffic monitoring, besides that undertaken by the Parish, has been carried out by the Department for Infrastructure in this area in the last 5 years, and the subsequent outcomes of any such monitoring; and

“Further to the decrease in the rate of home completions from 2012 to 2021 compared to the previous ten years as referenced in the Jersey’s Fiscal Policy Panel Housing Market Review (Pg.4), will the Minister advise the following for the period 2021 to date –
- the total number of residential developments granted permission and the current status of those developments (completed, in progress, or not started); and, if any of the developments have not started, advise the reasons, if known; and

“In respect of Jersey’s Cannabis Industry (‘the Industry’), will the Minister advise –
- what plans, if any, exist to develop a strategy for the Industry;
- the annual amount of funding, if any, allocated to and spent on supporting the Industry since 2022 and the amount proposed for 2025;
- the estimated annual revenue of the Industry to the Island since 2022 to date;
- what key benefits to the Island were agreed by the Government when the development of the Industry started, and what evidence the Government holds that these benefits are being delivered;
- what aspects of the Industry, in terms of policy and legislation, fall under the remit of other Ministers; and

“In relation to new housing developments built next to growers, horticulturalists, glasshouses and small business parks in the last 15 years, will the Minister advise –
- the total number of noise complaints received by his department from house owners or tenants;

- how many, if any, of these businesses have ceased trading?”

- whether it is a contractual requirement for employees of the States Employment Board to be resident or ordinarily resident in Jersey, and if it is not, why not;
- the process by which authorisation is granted for individuals who do not reside in Jersey to be engaged by a Government department, through any structure, and who grants authorisation;
- how many contractual arrangements are currently in place with external consultants or agency workers across Government departments, and provide a breakdown of these by department;

In accordance with Standing Order 104A, a time limit of 15 minutes applies to speeches made during debate, unless discretion has been exercised to allow for a longer, or shorter, time limit. No time limit applies to either speech made by the proposer.
Discretion is exercised by the Presiding Officer in accordance with guidance issued by the Bailiff , following consultation with the Privileges and Procedures Committee. The current guidance was presented to the States in the report ‘Time Limits on Speeches in Debates: Guidance on the Exercise of Discretion’ (R.3/2021). The report states that discretion may be exercised to allow for a longer speech than 15 minutes where the member speaking is designated as the ‘main respondent’ to the debate.
