Health Insurance (Approved Prescribing Practitioners) (Jersey) Order 2025. Minister for Social Security.
This Order sets out the process by which certain classes of prescribing practitioner may be approved by the Minister for Social Security (the "Minister") under Article 26(1E) of the Health Insurance (Jersey) Law 1967 (the "Health Insurance Law").
The classes of prescribing practitioner are –
- doctors who are not already approved under Article 26(1A) of the Health Insurance Law (referred to in the Order as "non-GP doctors");
- nurse independent prescribers;
- paramedic independent prescribers; and
- pharmacist independent prescribers.
The Health Insurance (Medical Prescribing Practitioners) (Jersey) Order 2018 and the Health Insurance (Approved Prescribing Practitioners – Midwives and Nurses) (Jersey) Order 2018 already set out the process by which the Minister may approve prescribing practitioners in (a) and (b). This Order repeals and replaces those Orders.
The prescribing practitioners in (a) to (d) may prescribe and administer prescription-only medicines under the Medicines (Jersey) Law 1995 (see Article 57(1) of that Law and Article 5 of the Medicines (Prescription Only) (Jersey) Order 1997).
If they are approved by the Minister under Article 26(1E) of the Health Insurance Law, a prescribing practitioner may also prescribe medicines, drugs and medical appliances ("pharmaceutical benefit") under the Health Insurance Law at the cost of the Health Insurance Fund.
This Order also makes a related amendment to the Health Insurance (Pharmaceutical Benefit) (General Provisions) (No. 2) (Jersey) Order 2002 to allow electronic prescriptions under the Health Insurance Law.
Article 1 is the interpretation provision.
Article 2 sets out the conditions with which a prescribing practitioner must comply in order to be approved under Article 26(1E) of the Health Insurance Law.
Article 3 sets out the requirements of an application for approval. These include that the prescribing practitioner makes a declaration that they practise in Jersey in a primary care setting and that, if they are approved, they will issue pharmaceutical benefit under the Health Insurance Law only to insured persons and they will comply with the conditions in Article 4.
Article 4 sets out the conditions with which an approved prescribing practitioner must comply. These are that they must not issue pharmaceutical benefit to a person unless they have access to that person's GP records, and that they must comply with the relevant requirements of their regulatory body when issuing pharmaceutical benefit.
Article 5 requires applicants for approval, and approved prescribing practitioners, to notify the Minister if there is a change in their circumstances that is material to their approval.
Article 6 enables the Minister to withdraw the approval of a prescribing practitioner in certain circumstances.
Article 7 repeals the Health Insurance (Medical Prescribing Practitioners) (Jersey) Order 2018 and the Health Insurance (Approved Prescribing Practitioners – Midwives and Nurses) (Jersey) Order 2018, and Article 8 provides that prescribing practitioners who were approved under those Orders are treated as if they have been approved under this Order.
Article 9 amends Article 5 of the Health Insurance (Pharmaceutical Benefit) (General Provisions) (No. 2) (Jersey) Order 2002, which prescribes the form of prescriptions for the supply of pharmaceutical benefit under the Health Insurance Law. The amendment removes the requirements that the prescription is printed and watermarked, so that prescriptions can now be sent electronically.
Article 10 gives the name of this Order and states that it comes into force 7 days after it is made. The Order was made on 26th June 2025 and came into force on 3rd July 2025.
Single-Use Plastics etc. (Exemptions) (Jersey) Order 2025. Minister for the Infrastructure.
This Order replaces guidance published by the Minister for Infrastructure under the Single-Use Plastics etc. (Restrictions) (Jersey) Law 2021 (the "Law"), to allow traders to continue to import or supply certain types of single-use or non-recyclable bags for specified purposes and in specified circumstances.
Article 2 provides that Articles 2 (trader must not supply certain single-use or non-recyclable items) and 4 (trader must not import certain single-use or non-recyclable items) of the Law do not apply to certain single-use or non-recyclable bags supplied, or imported to be supplied, for a range of purposes. These purposes include –
• as packaging for uncooked meat, poultry or fish, if those products are packaged on the trader's premises;
• as a container for live fish;
• as a container for an item prescribed by a registered medical practitioner;
• to be purchased and used by the customer for their intended purpose of food storage or containing waste (for example, freezer bags, pet waste bags, nappy sacks and refuse bin liners);
• to allow compliance with port security requirements (for example, clear bags for taking liquids through security and sealable duty-free bags at airports);
• as integral product packaging in which products are sealed before supply;
• as a foil-lined paper carrier bag that is a container for hot food;
• as a bag, which can be purchased by an individual customer as a sole item without the purchase of other goods, to be used by an individual to wrap gifts.
Article 3 provides that Article 2 of the Law does not apply to certain single-use or non-recyclable bags donated by a trader to a registered charity, if those bags were already in Jersey when the Law came into force.
Article 4 gives the title of this Order and provides for it to come into force on 1st August 2025, which is when the Single-Use Plastics etc. (Restrictions) (Jersey) Amendment Law 2025 comes into force.
The Order was made on 30th June 2025 and comes into force on 1st August 2025.
Single-Use Plastics etc. (Restrictions) Amendment (Jersey) Commencement Order 2025. Minister for Infrastructure.
This Order brings the Single-Use Plastics etc. (Restrictions) (Jersey) Amendment Law 2025 into force on 1 August 2025.
The following legislation comes into force immediately after that Law comes into force –
• Single-Use Plastics etc. (Restrictions) (Jersey) Amendment No. 2 Law 2025;
• Single-Use Plastics etc. (Restrictions) Law (Jersey) Amendment Regulations 2025.
The overall effect is to amend the Single-Use Plastics etc. (Restrictions) (Jersey) Law 2021 (the "2021 Law") to –
• prohibit traders and individuals from importing and supplying single-use vapes;
• add types of prohibited carrier bags to the Schedule;
• insert an Order-making power for the Minister for Infrastructure to create exemptions to the 2021 Law for certain types of carrier bags;
• include the Chief Inspector of Weights and Measures in the list of people who may issue a notice to a person who fails to comply with the 2021 Law;
• disapply the minimum price that a trader must charge for a recyclable plastic or paper bag if the bag is supplied by wholesale from 1 trader to another trader or supplied second-hand under a trader's bag reuse scheme; and
• update some provisions of the 2021 Law to align with current drafting practice.
The Order was made on 30th June 2025 and came into force on the same day.
Criminal Procedure (Jersey) Amendment Rules 2025. Criminal Procedure Rules Committee.
The Criminal Procedure (Jersey) Amendment Rules 2025 (the "Rules") amend the Criminal Procedure (Jersey) Rules 2021 (the "2021 Rules") by inserting a new provision relating to the Proceeds of Crime (Jersey) Law 1999 (the "Law").
Rule 1 provides that the Rules amend the 2021 Rules.
Rule 2 amends the preamble to the 2021 Rules to refer to all powers under which the Criminal Procedure Rules Committee can make rules.
Rule 3 inserts Rule 63A into the 2021 Rules. Rule 63A sets the rate of interest, for the purposes of Article 18 of the Proceeds of Crime (Jersey) Law 1999, at 2% above the UK selected retail banks short term money rates (base rate) from time to time, calculated on a daily basis.
Rule 4 sets out the name by which the Rules may be cited. It also provides that the Rules come into force 7 days after they are made.
The Rules were made on 3rd July 2025 and come into force on 10th July 2025.
Explanatory Note regarding the selection and appointment processes (Item F)
Appointment of the Chair of the Privileges and Procedures Committee
The Presiding Officer will invite nominations for the position of Chair of the Privileges and Procedures Committee. Ministers and Assistant Ministers are not eligible for appointment to this position. Each nomination must be seconded. If there is only one nomination, the Member nominated will speak for up to 10 minutes followed by a 20-minute question period; after which the Member will be selected for appointment. If there is more than one nomination, the Presiding Officer shall then draw lots to determine the order in which they shall be invited to speak. Each candidate will speak for up to 10 minutes with a 20-minute question period. Other candidates must withdraw from the Chamber during the speeches and question period.
Following the speeches and question periods, a recorded vote will be held until one candidate receives an overall majority of the votes cast. The electronic voting system will be used where there are no more than two candidates; an open ballot will take place in instances where there are more than two candidates.
