Sanctions and Asset-Freezing (Implementation of External Sanctions) (Russia – Amendment No. 8) (Jersey) Order 2022.
Deputy Chief Minister K.F. Morel of St. John , St. Lawrence and Trinity for and on behalf of the Minister for External Relations and Financial Services.
This Order amends the Sanctions and Asset-Freezing (Implementation of External Sanctions) (Jersey) Order 2021, in relation to further changes in UK sanctions on Russia which are made by the Russia (Sanctions) (EU Exit) (Amendment) (No. 11) Regulations 2022 of the UK (S.I. 2022/792). Those Regulations came into force on 15th July 2022 and had immediate effect in Jersey subject to modifications, except where they create offences that are not based on provisions already in the list in column 5 of Schedule 1 to the amended Order.
This Order amends that list of UK prohibitions covered by the existing Jersey offence (carrying imprisonment for up to 7 years and an unlimited fine) of breaching implemented sanctions provisions. It does so to reflect the renumbering of several of the UK prohibitions following the removal of a prohibition relating to supply and delivery of interception and monitoring services from third countries.
This Order comes into force immediately after the midnight following its making. The Order was made on 15th July 2022 and came into force on 16th July 2022.

Sanctions and Asset-Freezing (Implementation of External Sanctions) (Russia – Amendment No. 9) (Jersey) Order 2022.
Minister for External Relations and Financial Services.
This Order amends the Sanctions and Asset-Freezing (Implementation of External Sanctions) (Jersey) Order 2021, in relation to further changes in UK sanctions on Russia which are made by the Russia (Sanctions) (EU Exit) (Amendment) (No. 12) Regulations 2022 of the UK. Those Regulations come into force on 19th July 2022 and will have immediate effect in Jersey subject to modifications, except where they create offences that are not based on provisions already listed in column 5 of Schedule 1 to the amended Order.
This Order extends the existing Jersey offence (carrying imprisonment for up to 7 years and an unlimited fine) of breaching implemented sanctions provisions, so that it applies to breaches of a new prohibition of investment activities in relation to Russia.
This Order comes into force immediately after the midnight following its making. The Order was made on 18th July 2022 and came into force on 19th July 2022.

This Order amends the Sanctions and Asset-Freezing (Implementation of External Sanctions) (Jersey) Order 2021, in relation to further changes in UK sanctions on Russia which are made by the Russia (Sanctions) (EU Exit) (Amendment) (No. 14) Regulations 2022 of the UK. Those Regulations come into force on 21st July 2022 and have immediate effect in Jersey subject to modifications, except where they create offences that are not based on provisions already listed in column 5 of Schedule 1 to the amended Order.
This Order extends the existing Jersey offence (carrying imprisonment for up to 7 years and an unlimited fine) of breaching implemented sanctions provisions, so that it applies to breaches of the new prohibitions related to: energy-related goods and related activities; G7 dependency and further goods list goods; oil and oil products; gold; coal and coal products; and professional and business services.
This Order comes into force on 21st July 2022.

Sea Fisheries (Spider Crabs – Restrictions on Fishing) (Amendment No. 3) (Jersey) Order 2022.
Minister for the Environment.
This Order amends the Sea Fisheries (Spider Crabs – Restrictions on Fishing) (Jersey) Order 2019 so that in 2022 the specified period, during which fishing for protected spider crabs is restricted, runs from the start of 1st September to the end of 15th October.
The Order comes into force 7 days after it is made.
The Order was made on 20th July 2022 and came into force on 27th July 2022.

Sanctions and Asset-Freezing (Implementation of External Sanctions) (Exceptions and Licences – Amendment) (Jersey) Order 2022.
Minister for External Relations and Financial Services.
This Order amends the Sanctions and Asset-Freezing (Implementation of External Sanctions) (Jersey) Order 2021 to make fresh provision about exceptions and licences relating to asset-freezing prohibitions.
The effect of the amendment is that a UK exception to an implemented UK asset-freezing prohibition has effect in Jersey as an exception to the corresponding asset-freezing prohibition in Part 3 of the Sanctions and Asset-Freezing (Jersey) Law 2019. Also the existing provision on licences is amended so that a UK power or duty to grant a licence, in relation to an implemented UK asset-freezing prohibition, has effect in Jersey as a ground for granting a licence in relation to the corresponding asset-freezing prohibition in Part 3 of the Law. The UK exceptions and licence provisions are to be read for this purpose with any necessary modifications for their application to Jersey (beyond those already in Schedule 2 to the Order, and subject to any special modifications for particular regimes in Schedule 3 to the Order).
This Order comes into force immediately after the midnight following its making. The Order was made on 25th July 2022 and came into force on 26th July 2022.

APPOINTMENT OF MINISTERS, COMMITTEES AND PANELS (See Item F)
Privileges and Procedures Committee: appointment of a member of the Scrutiny Liaison Committee
Standing Order 122 provides that the Chair of the Privileges and Procedures Committee shall nominate one member of the Scrutiny Liaison Committee as a member of the Committee.
After the Chair has made the nominations the Presiding Officer will invite alternative nominations. Only members who are members of the Scrutiny Liaison Committee are eligible for appointment. If alternative nominations are made there will be a secret ballot.
Elected members of the Public Accounts Committee
Standing Order 123(1) provides that the Chair of the Public Accounts Committee shall indicate the number of elected members (being not less than 2) that he or she wishes to have as members of the Committee and should then nominate elected members (who are neither Ministers nor Assistant Ministers) as candidates for appointment. Standing Order 131(1)(b) provides that there must be an even number of members (but not less than 4) and half must be persons who are not members of the States.
After the Chair has made her nomination the Presiding Officer will invite alternative nominations. If alternative nominations are made, a secret ballot will be held.
Public Accounts Committee: Appointment of unelected members
In accordance with Standing Order 124(1) the Chair of the Public Accounts Committee has given notice of her nominations for the positions of unelected member of the Public Accounts Committee as follows –

In accordance with Standing Order 131(1)(b), the constitution of the Public Accounts Committee provides that (not including the Chairman) there must be equal numbers of elected members (who are not Ministers or Assistant Ministers) and non-States members.
In accordance with Standing Order 124(2) any alternative nominations for membership of the Public Accounts Committee must have been received by the Greffier of the States no later than 2 clear working days before the meeting, namely no later than 8th September 2018. No alternative nominations were received.
Biographies
- Mr. Graeme Phipps
A professional geophysicist and geologist with over 45 years' experience in the international oil and gas industry. Graeme has served on 11 different Boards with roles on Audit, Reserves, Compensation, Corporate Governance, EH&S and Special Committees plus being Chairman and CEO of one public company. He also served as President and in senior executive positions, plus in Corporate Planning including as VP Corporate Planning and Business Development. Graeme recently served as an independent member of the Public Accounts Committee between November 2020 and May 2022 and his in-depth knowledge and experience of the PAC's work over the last two years will provide expertise and continuity for the new members
- Mr. Philip Taylor
Philip is a Fellow of the Institute of Chartered Accountants. He was the Senior Partner of the PwC Channel Islands Firm and was the Global Leader of PwC's Global Audit Quality Assurance programme. Since retiring from PwC in 2009 Philip has been a Commissioner on the Jersey Financial Services Commission, a Member of the Conduct & Case Management Committees of the UK Financial Reporting Council and Chair of the States of Jersey Treasury Advisory Panel. He has been a director of a number of public and private companies in Jersey including Royal Bank of Scotland International Limited. His charitable work has included acting as Chair of the Jersey College for Girls and of its Foundation. He is currently Chair of Jersey Trees for Life.
- Mr. Matthew Woodhams
Matthew Woodhams is by profession a Solicitor, qualified for 26 years, with a background of undertaking prosecutions and litigation against professional service providers. Until moving to Jersey last year, with his husband, he spent 5 years in the City as compliance and risk consultant. His move to Jersey was based on striving to get a proper work life balance and be part of a community where he can make a real difference. He is the Head of Compliance for Apex Jersey where has introduced a new compliance operating model and regulatory risk management culture based on Conduct, Culture and Ethics.
Process
There was open competition for the new appointments. An advertisement was placed locally, together with social media postings and a LinkedIn campaign managed by the States Greffe in conjunction with PeopleHub. A range of local community groups and organisations were also contacted directly with the information in order to assist in disseminating it to their membership (e.g. Institute of Directors, Chamber of Commerce and third sector organisations etc.) The advert sought experienced professionals able to demonstrate a successful track record in, but not limited to, IT, finance, HR, regulatory, legal or the third sector environments. The applicants needed to demonstrate they could work constructively as part of a team, with an analytical approach and strong communication skills.
The recruitment process was successful in attracting a number of high-calibre candidates. All applicants for the lay member vacancies were provided further information detailing the role and responsibilities of unelected members, including the recently introduced Code of Conduct for lay members of the PAC in an information pack available alongside the advert. Lay members will be asked to adopt this code until the end of their term. A shortlisting process was undertaken which reviewed the knowledge and skill sets of the applicants as well as their reasons and values for wishing to become a member of the Committee. The highest scoring applicants from this process were subsequently invited to interview.
The shortlisting and interview panel comprised the Chair, the Greffier of the States and the Practice Director of the Law Officers' Department, abiding by Appointments Commission guidance, including the appropriate documentation and management of any conflicts of interest. It used a scoring matrix in order to assess the candidates objectively, both at the shortlisting and the interview stage. Five applicants were shortlisted for interview and interviews took place between 4th and 9th August 2022.
The candidates were advised that the non-elected member or lay roles are not remunerated, and expenses are not ordinarily payable. Given that successful candidates would be expected to attend and participate in (at least) 2 meetings per month, be called to attend other working meetings or public hearings and could expect to receive significant quantities of documentation to review, they were advised of the demanding workload accordingly. Candidates were also advised that if successfully appointed, they would be expected to abide by the Code of Conduct, a draft copy of which was supplied to them on application. The Code is attached to this paper for information and is appended to the most recent update to the Scrutiny and Public Accounts Committee Proceedings: Code of Practice.
Following the interviews, the Panel was unanimous in its agreement to nominate the three candidates. In making the recommendation for appointment, the selection panel carefully considered the merits of all the candidates and their professional and academic backgrounds, with the aim of complementing the experience and background of the States Members of the PAC.
The Panel was delighted to be able to nominate Mr Graeme Phipps who served on the previous PAC. His in-depth knowledge and experience of the PAC's work over the last two years will provide expertise and continuity for the new members. Mr Phipps has spent his working life in various management and director positions including roles as President and Chair of the Board, member of Audit and Corporate Governance Committees and other related roles. As a Jersey citizen with Canadian heritage, his skills and experience in consulting services and as a director of 2 international oil and gas companies, will continue to provide a fresh perspective to the Committee.
Mr Philip Taylor is a Fellow of the Institute of Chartered Accountants and provides significant experience from the financial services industry as well as having served on numerous boards in both non-executive and Chairing roles. Most recently Mr Taylor acted as the Chair of the Treasury Advisory Panel and he was the Global Leader for PwC Quality Assurance between 2003 and 2009. The Panel is delighted to nominate a lay member with significant experience within this sector and Mr Taylor will bring his impressive wealth of knowledge to assist the Committee in this regard.
Mr Matthew Woodhams provides the Committee with a varied range of skills acquired through work in the legal and compliance and regulatory sectors across a range of jurisdictions. Mr Woodhams currently serves as the Head of Compliance for Apex Group, Jersey and provides Strategic leadership of compliance function in funds, corporate and compliance services business. He brings a varied experience to the Committee including a detailed understanding of risk management and governance which will complement the skills within the Committee from other elected and lay members.
Two members of the Jersey Police Authority
The Jersey Police Authority consists of not less than 5 and not more than 7 members, up to 2 of whom are elected members of the States. The Presiding Officer will invite nominations for the position of member of the Police Authority. If there are more than 2 nominations, a secret ballot or ballots will be held. Article 5(6) of the States of Jersey Police Force Law 2012 stipulates that none of the following may be appointed as a member of the Police Authority –
- a police officer;
- a person who is a member of the Honorary Police;
- an office holder of a Crown appointment;
- the Minister or his or her Assistant Minister;
- a Connétable ;
- a States' employee;
- a person who is bankrupt, whether under the law of Jersey or under the law of a country or territory outside Jersey;
- a person who has been a police officer at any time during the previous 5 years; or
- a person who has been a member of the Honorary Police at any time during the previous 5 years.
In addition, it was recognised in 2014 that serving on the Children, Education and Home Affairs Scrutiny Panel could potentially constitute a conflict of interest with membership of the Jersey Police Authority.

In accordance with Standing Order 104A, a time limit of 15 minutes applies to speeches made during debate, unless discretion has been exercised to allow for a longer, or shorter, time limit. No time limit applies to either speech made by the proposer.
Discretion is exercised by the Presiding Officer in accordance with guidance issued by the Bailiff , following consultation with the Privileges and Procedures Committee. The current guidance was presented to the States in the report Time Limits on Speeches in Debates: Guidance on the Exercise of Discretion' (R.3/2021).
