This Order amends the Residential Tenancy (Deposit Scheme – Fee) (Jersey) Order 2015 so that, for deposits in relation to residential tenancies entered into on or after 1st November 2023, there is no prescribed fee to be paid and deducted from a deposit under Regulation 32 of the Residential Tenancy (Deposit Scheme) (Jersey) Regulations 2014.

This Order comes into force on 1st November 2023.

This Order amends the Dormant Bank Accounts (Distribution of Fund Money) (Jersey) Order 2020 so that, for a further 4 years (2024-2027), the Chief Minister must use a portion of the Jersey Reclaim Fund to meet the costs of the Charity Commissioner's services and of the staff, accommodation and equipment required for the proper and effective discharge of its functions. This Order also deletes a provision that applied in relation to 2020 and is no longer required.

This Order comes into force 7 days after it is made.

The Probate (Forms and Particular Holders) (Jersey) Order 2023 designates particular holders who may, in accordance with Article 19B of the Probate (Jersey) Law 1998 (the "Law"), release movable estate without a grant. The Order also specifies –

the information that must be contained in an application under that Article to release movable estate, and

the information that must be contained in an application under Article 19C, which provides that an item worn by a deceased person may be released for buried or cremated with the person.

The Order comes into force on the commencement of the Probate (Amendment) (Jersey) Law 2023. The Order was made on 24th October 2023 and came into force on 27th October 2023.

Financial Services (Amendment of Schedules to Law) (No. 3) (Jersey) Order 2023.

The Financial Services (Amendment of Schedules to Law) (No. 3) (Jersey) Order 2023 amends Schedules 1 (investments), 2 (exemptions), 5 (transitional provisions) and 6 (securities) to the Financial Services (Jersey) Law 1998 (the "1998 Law").

Article 2 provides that in Schedule 1 to the 1998 Law, Note (2) to paragraph 7 is amended to provide additional situations in which a contract not falling within Note (1) of that paragraph is to be regarded as made for commercial purposes. Article 2 further amends the definition of contracts for difference under paragraph 8, and inserts a new paragraph 8A providing that financial derivatives are to be an investment under Schedule 1.

Article 3 amends Schedule 2 (exemptions) to the 1998 Law to provide various exemptions from the activity of making arrangements for another person to deal in investments. The exemptions apply to professional investment clients, sophisticated and high net worth investors, persons who are not remunerated, persons acting as introducers only, persons acting in relation to professional investor regulated schemes or special purpose regulated schemes, and persons providing advice who are registered to carry on investment business under the 1998 Law.

Article 4 amends Schedule 5 (transitional provisions) to the 1998 Law to provide that a person who has (in the 6 months before the commencement of the relevant Regulation of the Financial Services (Amendment of Law) (No. 6) (Jersey) Regulations 2023) made arrangements with a view to another person dealing in investments, or operated an investment exchange, does not commit an offence by any action taken in the course of that business during the transition period. The transition period is the 6 months after the commencement date, or the period up to the date that the person's application to carry on investment business in relation to that arranging dealing in investments or operation of an investment exchange is determined.

Article 5 amends the definition of "contracts for difference" in paragraph 7 of Schedule 6 (securities) to the 1998 Law and inserts a new paragraph 8A to insert "financial derivatives" as a category of security.

Article 6 gives the citation and provides that the Order comes into force on the same day as the Financial Services (Amendment of Law) (No. 6) (Jersey) Regulations 2023.

The Order was made on 27th October 2023 and came into force on 31st October 2023.

Employment (Minimum Wage) (Amendment – Single Rates) (Jersey) Order 2023. Minister for Social Security.

This Order amends the Employment (Minimum Wage) (Jersey) Order 2007 (the "Minimum Wage Order") to increase both the minimum wage and the maximum monetary amount attributed to the employer's provision of food and accommodation. This Order removes provisions that allow different amounts to be paid or attributed if an employee is a trainee.

As a result of the amendments, the Minimum Wage Order applies in the same way to all employees who have ceased to be of compulsory school age, regardless of whether they are trainees.

The Order was made on 31st October 2023 and comes into force on 1st January 2024.

Lodging Houses (General Provisions) (Application Fee – Amendment) (Jersey) Order 2023. Minister for Housing and Communities.

This Order amends the Lodging Houses (General Provisions) (Jersey) Order 1962 to increase the fee to accompany an application for registration, or renewal of registration, of a lodging house. The new fee is £15.46 multiplied by the maximum number of people aged 5 years and over who can be lodged at the property. This is an increase of 2.5% from the current fee of £15.08 per person.

This Order comes into force on 1st December 2023.

The Order was made on 1st November 2023 and comes into force on 1st December 2023.
